WHEREAS, on April 13, 1998, the Planning Cumm,`,ssion a~c„ied Resolution No. PG9H-
57 to approve Conditional Use Permit No. 4013 and to permit a pP%1n~ ;r: commercia~ office/light
manufacturing complex with seven buildings up to 38 feet in heig'~1t anc with waivers of reGuired Iot
frontage, minimum parking lot landscaping, minimum number of parkinc spaces and minim~m str•~ ~:!~a~~ j
setback adjacent to interior boundary lines on property located at 8181-8201 East Kaiser 2auieva;d;, ~nd
WHEREAS, this property is developed as a commercial o~ce/light ~n~anut2:turing
complex in the CO (SC) (Commercial Office and Professional - Scenic Cacidor 0~~~~r~ay; zonr; an~i that
the Anaheim General Plan designates tne property for General Commercial land uses; an~
WHEREAS, the petitioner requests an amendment to this condltional use cerrr~ft ta ~ermit
roof-mounted equipment. ~
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim or March 1, 1999 at 1:30 p.m., notice of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and that the hearing was continued from the
February 1, 1999 Commission meeting; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit is authorized by
Anaheim Municipal Code Section 18.84.062.032 to permit roof-mounted equipment for the previously-
approved planned commercial office/light industrial complex.
2. That the proposed use will not adversely affect the adjoining land uses and the growth
and development of the area in which it is proposed to be located because this prop~sal meets the criteria
of Code Section 18.84.062.032 by the integration of the roof screening devices into !he archite~;t~~ral
design of the building and complying with the Nne-of-sight mitigation for surrou~ding properties sa as not
to adversely affect the adjoining land uses nor the growth and development of the area.
3. That the size and shape of the site for the proposed use is adequate to allow full
development of the proposal in a manner not detrimental to the particular area nor to the peace, health,
safety and general welfare.
4. That the traff:c generated by the proposed use will not (mpose an undue burden upon the
streets and highways designed and improved to carry the traffic (n the area.
5. That granting of this conditional use,aermit, under the conditions imposed, if will not be
detrimental to the peace, heallh, safety and generai welfare of the citizens of the City of Anaheim.
6. That no one indicated their presence at the publi(: ~~earing in opposition, and no
correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUA+,;"•.~Y ACT FINDING: That the Anaheim City
Plannfng Commission has reviewed the proposal to p~-:,:i; roof-mounted equipment for a previously-

approved planned commercial o~ce4ight industrial complex on a irregularly-shapee) 6.~-acre ~:rop3~.`y
located at the southwest comer of Santa Ana Canyun Road and Weir Canyon R~aA, having fro~atagcs of
301 feet on the south side of Santa Ana Canyon Road and 700 feet on the tvest side of Weir Car~ron
Road (8181-8201 East Kaiser Boulevard); and does hereby approve the Negative Declaration u~+cn
finding that the declaration reflects the independent;udgment of the lead agency and that it has
considered the Negative Declaration together with any comments received during the public review
process and further finding on the basis of the initial study and any comments received that there is no
substantial evidence that the project will have a significant effect on the environment.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Anaheim City Planning
Commission does hereby amend Resolution No. PC98-57, adopted in connection with Conditional Use
Permit No. 40t3, as follows:
(a) Amend the use, under authority oF Anaheim Municipai Code Section 18.84.062.032, to permit
roof-mounted equipment for the previously-approved planned commerciai office/light industrial
complex.
(b) Amend Condition No. 16 to read:
16. That subject property shall be developed substantially in accordance wilh pfans and
specifications submitted to the City of Anaheim by the petitioner and whl ,h pians are on
file with the Planning Department rnarked Exhibit Nos. 1 through 36, and as conditfoned
herein.
(c) Add the following new conditions:
23. That prior to final buildinb and zonEng inspectiuns, 'Lor}ng Divis(on staff shall inspect the
property to verify compliarzce with the line-nF_;ite drawings an~ the elevation rende, ings
shown on approved Exhibit Nos. 16.a ~seven pages of line-of-sight photographs) and
16.b (seven pages), and Exhibit Nos. 33, 34, 35 and 36 (computer renderings), and as
cond(tioned herein.
24. That the roof-mounted equipment shall not exceed the height of the screening device
enclosure.
25. That all roof-mounted equipment shall be the same color as the roof.
26. That if Zoning Division inspections reveal visibility of the roof-mounted equipment, grated
screens shall be placed on top of the equipment screens to cover and conce2l the
equipment. That tt~a equipment screens shall be dn~~neered to ailow for the installation of
grated top screens as may be require/;~3 " - ~'~
