A RESOLUTION OF THE ANAHEIM CITY PL/\NNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 96-89-08 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified petition for
Reclassi ication for certain rea~ p~operty situated in the City of Anaheim, County of Orange, State of
Cal~fornia, described as follows:
PARCEL 1: LOT 11 OF TRACT 3177, IN THE CITY CF ANAHEIM, AS PER MAP
RECORDED IN BOOK 96, PAGE 47 AND 48 OF MISCELLANEOUS MAPS, IN
TI-IE OFFICE aF THE COUNTY RECORDER OF SAID COUNTY.

WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on January 4, 1999, at 1:30 p.m., notice of said public hearing having been duly given as
required by law a~ ~~ in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed reclassifics!ion and lo investigato and make
findings and recommendations in connection therewilh; and

WHEREAS, said Commission, after due inspection, inves4igation and study made by itseif
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the petitioner proposes rec~assification of subject property from lhe RS-A- 43,000
(Residentiai/Agricultural) Zone to the CL (Commercial, Limited) Zone, or a less intense zone.
2. That the Anaheim General Plan land use designation for subject property is Low Density
Residential; and that General Plan Amendment No. 360, filed in conjunction with this reclassification and
proposing to amend the land use designation to Generaf Commercial, was denied.
3. That the pr~posed reclassification of subject property is not necessary nor desirable for the
orderiy and proper development of the community.
4. That the proposed reclassifi~at;on of subject property does nct properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and their
permitted uses generally established throughout the community.
5. That two people spoke in favor of the proposal and that correspondence in favor of the
proposal was received.
6. That no one indicated their presence at the public hearing in opposition to the proposal; and
that a petition was received in opposition to subject petition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to reclassify subject propehy from the RS-A-43,000
(Residential/Agricuitural) zone to il:e CL (Commercial, Limited) zone, or a less intense zone, an a 6.1-acre
irregularly-shaped parcel having a frontage of 301 feet on the west side of Euclid Street, a maximum
depth of 1,271 feet, and being located 220 faet south of the centerline of Cris Avenue at 1631 South
Euclid Street (Southern California Edison easement); and does hereby apprave the Negative Declaration
upon finding that the declaration reflects the independent judgment of the lead agency and that it has
considered the Negative Deciaration together with any comments received during the public review process
and furlher finding on the basis of the initial study and any cornments received that there is no substantial
evidence that the proJect will have a significant effect on the environment.
NOW, THEREFORE; EiE IT RESOLVED that the Anaheim City Planning Commission does
hereby deny this Petition for Reclassification on the basi of the afor entioned findings.
