A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
REINSTATING AND APPROVING CONDITIONAL USE PERMIT NO. 3p03,
AND AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTION NO. PC97-39,
ADOPTED THEREWITH
WHEREAS, on April 14, 1997, Resolution No. PC97-39 was adopted by the Anaheim City
Planning Commission to approve, in part, Conditional Use Permit No. 3903 and permit a transmission
repair facility within an existing 12,399 sq.ft, industrial building with waiver of minimum number of parking
spaces (approved) and permitted outdoor uses (deni~d) at 2830 East Gretta Lane; and
WHEREAS, s2!d Resolution No. PC97-39 includes the foilowing condition of approvai:
"12. That subject use permit is hereby approved for a period of two (2) years, to expire
on April 14, 199?."
WHEREAS, this preperty is developed with a 12,399 sq.ft. industriai building (including a
1,692 sq.ft. outdoor storage area) in Development Area 1(Industrial Area) of the Noriheast Area Specific
Plan (~P 94-1); that the Anaheim General Plan designates this property for General Industrial land uses;
and that this property is located within lhe Alpha ProJect Northeast Redevelopment Area; and
WHEREAS, the petitioner has requested reinstatement of this condit;anal use permit to
retain the truck transmfssion repair facility pursuant to Code Section 18.03.093 of the P,naheim Municipal
Code; and
WHEREAS, the City Planning Commission did hold a public hearing at the Cfvic Center in
the City of Anaheim on March 29, 1999, at 1:30 p.m., nolice of said public hearing having been duly given
as required by law and in accordance with the provisions of lhe Anahei~~; Munici~al Code, Chapter 18.03,
to hear and consider evidence for and against said proposed amendmenQ and~to inves:igate and make
findings and recommendations in connection therewith; and
WHEREAS, sa(d Commission, after due inspection, investi~ation and study made by itself
and in its behalf, and after due consideration of all evidence and reporta offered at said hearing, does find
and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit is authorized by
the Zoning Code.
2. That the proposal, as amended, will not advarsely affect lhe adjoining land uses and the
gro~Nth and development of the area in which it is located.
3. That the size and shape of the site for the use proposed to be retained is adequate to
allow full development of the use in a manner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
4. That the traffic generated by lhis use, as amended, will r,ot impose an undue burden uoon
the streets and highways designed and improved to carry the traffic in the area.
5. That granting this reinstatement, under the conditions imposed, will not be detrimental to
the peace, health, safety and general weifare of the citizens of the City of Anaheim.
6. That this conditionai use permit is being exercised in substantially the same manner and
in conformance with ail conditions and stipulations originally approved by the Planning Commission.
7. That this conditional use permit is being exercised fn a manner not detrimental to the
particular area and surrounding land uses, nor to the public peace, health, safety and general welfare.

8. That no one indicated their presence at the public hearing in opposition to the proposal; .
and that no correspondence was ~eceived in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FIP71'jI;JG: That the Anaheim City
Planning Commission has reviewed the proposal to ret2in a truck trans;~iission repair facility on property
consisting of 0.57 acre having a frontage of 132 feet on the south sid~~ of Gretta Lane, a maximum depth
of 186 feet, and being located 366 feet ~ast of the centerline of Blua ~?um Street (283~ East Gretta L2ne);
and does hereby find that the Negative Deciaration previously a~»~ ~ved in connection with Conditional
Use Permit No. 3903 is adequate to serve as the required envf~~ - mental documentation in connection
with this request upon finding lhat the declaration reFlects the Incl~.pe;identjudgment of the lead agency
and that it has ccinsidered the prev(ously approved Negativ:, ueclaration together with any comments
received during the public review process and further finding on the basis of the initial study and any
comments received that the~e is no substantial evidence that lhe project will have a significant effect on
the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby amend Resolution No. PC97-39, adop!ed in connection with Conditional Use Per-nit No. 3903, to
reinstate this conditional use permit and to amend Condition No. 12 therein to read as foilows:
12. That lhis conditionai use permit shall expire on April 14, 2003.
AND BE IT FURTHER RESOLVED that the Planning Commission does hereby add the
following new condition:
13. That the trash storage areas shail be refurbished to r,omply witti approved plans on
file with the Public Works Department.
THE FOREGOING RESOLUTION ~as dopted at the Planning Commission meeting of
March 29, 1999.
