A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONDITIONS OF APPRflVAL OF RESOLUTION NO. 84R-415,
ADOPTED IN CONNECTIOfV WITH CONDITIONAL USE PERMIT NO. 2612
WHEREAS, on October 16, 1984, Resolution No. 84R-415 was adopted by the City
Council to approve Conditional use Permit No. 2612 and permit a board and care facility for a maximum of
i 5 adults; and that said resolution includes the following condition of approval:
That the maximum occupancy for this facility shall be limited to and shall not
exceed fifteen (15) older adult residents plus one (1) couple for management and
housekeeping duties.
WHEREAS, this property is d2veloped with a 4-unit apartment complex converted to a
board and care facility with a common iriterior hallway providing access to each of the four units; that it is
located in the RM-1200 (Residantial, Multipis Family); and that the Anaheim Generai Plan Land Use
Element designates the property for Medium Density Residential land uses; and
WHEREAS, the petitioner requests to amend or delete Condition No. 5 pertaining to an
age limitation for residents under authority of Code Section 18.03.092.060 of the Anaheim Municipal Code
to aermit adults residents between the ages of 21 and 59 years (instead of "older adult residents" only);
and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on April 12, 1999 at 1:30 p.m., notice of said public hearing having been duly given as
required by law and in 2ccordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit is authorized by
the Zaning Code.
2. That the proposed modification is reasonably necessary to protect the public peace,
heallh, safety or general welfare, or necessary to permit reasonable operation under the conditional use
permit as granted.
3. That this ; equest is approved because this facility has been, and will continue to be,
compatible with the surrounding multiple-family land uses in the area.
4. That this use is being exercised in a manner not detrimental to the particular area and
surrounaing land uses, nor to the public peace, health and safety and general welfare.
5. That no one indicated their presence at the public hearing in opposition; and that no
correspondence was received in opposition to the subject petition.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to amend a condition of approval to permit a board and
care facility for a maximum of 15 adult residents belween the ages of 21 and 59 years (instead of "older
adult residents" only) and does heraby determine that the Negative Deciaration previousiy approved in
connection with Conditional Use Permit No. 2612 is adequate to serve as the required environmental
documentation in connection with this request upon finding that the declaration reflects the independent
judgment of the lead agency and that it has considered the Negative Declar2tion together with any
comments received during the public review process and further finding on the basis of the initial study
and any comments received during the public review process that there is no substantiai evidence that the
project wiil have a significant effect loon the evidence that the project will have a significant effect on the
environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. 84R-415, adopted in conneciion with Conditional Use Permit No.
2612, to amend Condition No. 5 to read:
That the maximum occupancy for this facility shall be limited to, and shali not
exceed, fifteen (15) adult residents plus one (9) couple for management and
housekeeping duties. ~
AND BE IT FURTHER RESOLVED that the Planning Commission does hereby add the
followiny new condition of approval:
8. That a maximum of four (4) resident vehicles shall be permi;ted.
