6527ORDINANCE NO. 6527 AN ORDINANCE OF THE CITY OF ANAHEIM, CALIFORNIA, ADJUSTING THE CITY COUNCIL VOTING DISTRICT BOUNDARIES FOLLOWING THE 2020 DECENNIAL CENSUS, ADOPTING A NEW COUNCIL DISTRICT MAP TO IMPLEMENT THE REDRAWN DISTRICT BOUNDARIES, AMENDING CHAPTER 1.26 OF THE ANAHEIM MUNICIPAL CODE TO MAKE CORRESPONDING CHANGES, AND DETERMINING THAT SAID ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15061(b)(3) OF THE STATE CEQA GUIDELINES BECAUSE THEY WILL NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT WHEREAS, on February 9, 2016, the City Council of the City of Anaheim adopted Ordinance No. 6360 transitioning from an at -large election system to a by -district election system for electing City Council Members; and WHEREAS Ordinance No. 6360 created six (6) City Council Districts, established a sequence of elections for the election of City Council Members, and maintained a directly -elected Mayor, with by - district elections commencing with the November 2016 general municipal election; and WHEREAS, California Elections Code Section 21601 and Section 500.1 of the City Charter of the City of Anaheim requires that following each decennial federal census, the City Council shall, by ordinance or resolution, adjust the boundaries of any or all of the Districts of the City so that the Districts shall be as nearly equal in population as possible, consistent with laws applicable to the creation and rearrangement of the boundaries of local districts; and WHEREAS, on September 27, 2021, the California Statewide Database reported the official population for the City of Anaheim as 347,757 residents; and WHEREAS, on August 10, 2021, October 5, 2021, and November 2, 2021, the City Council held public hearings pursuant to California Elections Code Section 21607.1(a) where the public was invited to provide input regarding the composition of Council Districts; and WHEREAS, on January 25, 2022, the City Council held a public hearing pursuant to California Elections Code Section 21607,1(a) where the public was again invited to provide input regarding the composition of Council Districts and on proposed public submitted boundary maps, in addition to maps prepared by the City's retained demographer, National Demographics Corporation, Inc.; and WHEREAS, at the January 25, 2022 public hearing, the City Council selected four (4) focus draft maps, designated as MAP 102, MAP 104, MAP 106, and MAP 114; and directed the City's retained demographer to create alternative focus maps based on comments from the City Council and testimony from the public; and WHEREAS, the City's retained demographer created MAP 116 and Map 117 and said maps were posted to the City's Redistricting webpage for public review and comment; and WHEREAS, Elections Code Section 21608(d)(1) requires the draft map to be published for at least seven days before being adopted by the City Council as a final map; and WHEREAS, MAP 102, MAP 104, MAP 106, and MAP 114, as well as alternative focus maps, MAP 116 and MAP 117, were posted on the City's Redistricting webpage by February 22, 2022; WHEREAS, on March 1, 2022, the City Council held a fifth, duly noticed public hearing, and after closing the public hearing, selected MAP 1 1 4 as the new Council District Map for the City of Anaheim and introduced this Ordinance for first reading. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The map entitled "MAP 1 1 4 " attached hereto as Exhibit "A" to this Ordinance and incorporated herein by this reference is hereby approved and adopted as the new Council District Map for the City of Anaheim. SECTION 2. Section 1.26.020.010 of the Anaheim Municipal Code is hereby amended to read in full as follows: Beginning with the November 2022 general municipal election, the members of the City Council (other than the Mayor) shall be nominated and elected on a "by district" basis as described in Section 1.26.010.020 from the Council Districts named and depicted in the map attached hereto as Exhibit "A", which map is hereby adopted in the form and content attached to Ordinance No6527. A true and correct copy of said map shall be kept in the Office of the City Clerk. If necessary to facilitate the implementation of this Chapter 1.26, the City Clerk is authorized and directed to make technical adjustments to the Council District boundaries that do not substantively affect populations in the Council Districts, the shapes of the districts, the eligibility of candidates, or the residence of elected officials within any Council District. The Clerk shall advise the City Council of any such adjustments that are found to be required in the implementation of Council Districts. If any such action is taken, the City Clerk shall consult with the City Attorney, and report such technical adjustments to the City Council. SECTION 3. Adjusting the district boundaries from which voters elect their City Councilmembers is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that the change will not have any potentially significant adverse impact on the environment. SECTION 4. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one (or more) section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance; and shall cause the same to be printed once within (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim. SECTION 6. This ordinance shall become effective thirty (30) days after its passage and adoption.
