2005-110RESOLUTION N0.2005- 110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING RATES OF COMPENSATION AND PAY POLICIES FOR UNREPRESENTED EVENT-RELATED PART-TIME JOB CLASSIFICAtIONS AND SUPERSEDING RESOLUTION N0.97R-101 AND AMENDMENTS THERETO WHEREAS, the Human Resources Director has recommended in a staff report dated June 14, 2005, that the rates of cor>7pensation and pay policies for unrepresented event-related part-time job classifications be established; and ~, WHEREAS, the need exists to supersede Resolution No. 97R-101 and amendments thereto pertaining to rates of compensation and pay policies for unrepresented part-time job classifications; and WHEREAS, the City Council of the City of Anaheim does find that establishing new rates of compensation and pay policies for unrepresented event-related part-time job classifications is in the best interest of the City of Anaheim. Section 1. Compensation for the classification of Convention Center Concessionaire is computed as follows: Concessionaires are guaranteed minimum wage for all hours worked. Additionally, they will receive commission income based on a minimum percentage of 10% of gross commission sales or such other percentage as may be negotiated by the Convention Center Manager, less California State Sales Tax. The negotiated percentage of gross commission sales, less California State Sales Tax, is split proportionately among Concessionaire employees assigned to the event according to number of hours worked. The minimum wage rate earnings are subtracted from the net" commission split and the remainder constitutes the amount of the commission. In no event shall a Concessionaire earn less than the minimum wage for hours worked in this assignment. The net commission compensation earned will be used to calculate overtime payments and is subject to 457P Plan deductions as well as State and Federal taxes. Section 3. Part-time employees who are required to speak, read, andlor write in Spanish or other languages as well as English as part of the regular duties of their position will be compensated at the rate of $.50 per hour in addition to their regular pay. Such compensation shall be effective the first pay period following competency review. Section 4. All part-time employees covered by this Resolution who are not CaIPERS members, shall be required to participate in the 457P Plan and shall contributed 7.5% of their gross biweekly pay. Section 5. Part-Time employees covered by this Resolution who are Miscellaneous CaIPERS members, shall pay 3.75% of the statutorily required 7% CaIPERS employee contribution to the retirement system. Anaheim shall pay 3.25% of the statutorily required 7% employee contribution to the retirement system. Such contributions shall be designated as "employer pick up" contributions under the provisions of Section 414th)~2) of the Internal Revenue Code. BE IT FURTHER RESOLVED that the effective date of this Resolution is June 17, 2005.
