2005-101RESOLUTION N0. 2005-141 A RESOLUTION OF APPLICATION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO INITIATE PROCEEDINGS PURSUANT TO THE CORTESE-KNOX-HERTZBERG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 FOR REORGANIZATION OF PROPERTY RELATED TO IMPERIAL HIGHWAY WHEREAS, the City Council of the City of Anaheim desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code, for reorganization of the City of Anaheim boundary involving de-annexation of uninhabited territory from the City of Anaheim and annexation of said uninhabited territory to the City of Yorba Linda; and, WHEREAS, the territory proposed to be de-annexed occupies 11.48 acres within two parcels and a description of the boundaries is set forth in Exhibits "A" and "B," attached hereto and by this reference incorporated herein; and, WHEREAS, reasons for the proposed annexation are as follows: l . The proposed territory for de-annexation is bordered by the City of Yorba Linda and the proposed annexation is a logical extension of present City of Yorba Linda boundary. 2. The proposed territory for de-annexation will facilitate future construction of the Imperial Highway Grade Separation Project. 3. The proposed territory for de-annexation will facilitate future medianllandscape improvements for Imperial Highway; and, WHEREAS, the City of Yorba Linda will extend the full range of municipal services to said territory to serve needs of said properties and their owners; and, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that this Resolution of Application is hereby adopted and approved by the City Council of the City of Anaheim, State of California, and the Local Agency Formation Commission of the County of Orange, State of Califomia, is hereby requested to undertake proceedings for de- annexation ofterritory described in Exhibits "A" and "B" and for reorganization of the City of Anaheim boundary according to terms and conditions stated above and in the manner provided by the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.
