RESOLUTION NO. 71R-238
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING ~JD DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHN1GED.
\~HEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 70-71-50 to consider an amendment to

Title 18 of the Anahel.m r.1un~cipal Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission diti duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the pro-
posed amendment be adopted by the City Council and that a
certain zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 81:h day
of __._ J~e _.' 19......::1.1.. as the time, and the City Council
Chambers 1n the City HaIr of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said
property, hereinafter described, from the zone or zones in
which it is now situated and the incorporation thereof in the
zone or zones hereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings and recommendation; and
WHEREAS, the City Cou:L~cil does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County
of Orange, state of California, to wit:

That portion of the Second Class Lands allotted to V.
Yorba, Tomas Yorba, P. Yorba, Y. Y. de eota, and other
allotments including Kalisher and Wartenberq and the
B. Yorba house and vineyard land, according to a map
attached to and made a part of the Decree of Partition
of the Rancho Canon de Santa Ana, rendered in Case No.
1978 of the 17th Judicial District Court of Los Angeles
County, California, a certified copy of which is recorded
in book 28, page 158, of Deeds of said Los Angeles County,
located in the County of Orange, State of California,
described as follows:
Beginning at the Northwest corner of said Second Class
Land allotted to de Cota; thence Southerly 10753.00
feet along the Westerly line of said Allotment to the
Southwest corner of the land described in the deed from
Anaheim Union llater Company to Samuel Kraemer, recorded
December 3, 1906 in book 139, page 144 of Deeds~ thence
Easterly along the Southerly line of the land described
in said deed the following courses and distances: South
890 20' East 274.80 feet, North 810 45' East 214.50 feet,
South 770 50' East 278.50 feet, South 660 50' East 378.80
feet, North 860 40' East 455.40 feet to the Easterly line
of aforementioned allotment to said de Cota; thence leaving
said Southerly line South 1061.63 feet along the East line
of the aforementioned allotment to the Northerly line of
B. Yorba Vineyard as shown on "Diagram F" referred to and
made a part of the said Final Decree of the Partition of
said Rancho Canon de Santa Ana; said point being also
Station 11 of said Y. Y. de Cota Allotment; thence
Southerly 945.31 feet along a direct line to Station 10 on
the line between the Allotments of First and Third Class
Land to Wolf Ka1isher and Henry Wartenberg in the Partition
of said Rancho; thence continuing South 1240.20 feet to
the Northerly line of Lot 6, as shown on a map of land
owned by E. Walter pyne filed in book 2, page 19 of Record
of Surveys, in the office of the County Recorder of Orange
County, California; thence along the Northerly line of
Lots 6 and 5 of said land of E. Walter pyne, North 690
East 524.90 feet to an angle point in the North line of
said Lot 5; thence continuing along the Northerly line of
said Lot 5 and the Easterly extension thereof 120.80 feet;
thence South 176.00 feet to the compromise line as shown
on a map filed in book 1, page 38 of Record of Surveys, in
the office of the County Recorder of Orange County,
California; thence along said line North 670 East 1258.00
feet; thence North 750 East 400.00 feet; thence North 460
East 404.10 feet to the end of said compromise line; thence
North 390 East 510.00 feet to the Easterly line of the land
described in the deed from Angeline Y. Kraemer to Samuel
Kraemer, recorded September 18, 1915 in book 270, page 7,
of Deeds; thence Northerly 12832.00 feet along the Easterly
line of the land described in said last mentioned deed to
the Northerly boundary of said Rancho Canon de Santa Ana;
thence Westerly 4306.40 feet along said Northerly boundary
line to a point of beginning.
EXCEPTING THEREFROM that portion lying Northerly of the
following described line:
Beginning at the intersection of the Westerly line of
said land with Course No. 8 as described in the deed to the
state of California recorded December 22, 1967 in book 8474,

page 102 of Official Records, of said Orange County,
thence along course Nos. 8, 9, 10 and 11 as described
in said deed to the state, the following courses and
distances: North 530 58' 4411 East 44.96; thence North
590 40' 4311 East 600.08 feet; thence North 600 13' 27"
East 600.02 feet; thence North 600 13' 27" East 800.02
thence North 600 38' 00" East 1154.12 feet to the Easterly
line of said land.
Lots 5, 6, and 7 as shown on a map recorded in Book 2,
at page 19, Record of Surveys in the records of Orange
County, California.
EXCEPT any portion of said Lot 5 conveyed to F. M. Dean
and Edna B. Dean, husband and wife, by deed recorded
January 11, 1949 in book 1785, page 193, Official Records.
That certain real property situate in the County of
Orange, State of California, described as:
Beginning at a point in the center line of the Santa
Ana Valley Irrigation Company's Canal, as it existed
April 30, 1912, where the West boundary of E. Po11oreno
Allotment of the Rancho Santiago de Santa Ana intersects
said canal; thence North 740 01' East along said center
line 517.37 feet to the West line of Lot One of the land
of E. Walter Pyne, as shown on a ~2P filed in Book 2,
Page 19 of Record of Surveys in the Office of the County
Recorder of Orange County, California; thence North 00
201 West along the West line of said Lot One, 1187.09
feet to a point in the Southeasterly right of way line
(70 feet wide) described in the Deed to the Orange County
Flood Control District, recorded February 6, 1939, in Book
979, Page 403 of Official Records; thence South 780 18'
West along said right of way line 507 feet to a point in
the West line of said E. Polloreno Allotment; thence South
on 161 45" East along said West line 1226.73 feet to the
point of beginning.
EXCEPTING THEREFROM the South 23 feet included in the
quitclaim deed from Jotham Bixby Company and others to the
Santa Ana Valley Irrigation Company, recorded July 18, 1934
in Book 685, page 255 of Official Records

be excluded from ORANGE COm~TY A-1, AGRICULTURAL DISTRICT, and
incorporated in the CITY OF ANAHEIl~ R-Ar AGRICULTURAL ZONE,
subject to the following condition:
1. That these reclassification proceedings are granted
subject to the completion of annexation of subject
property to the City of Anaheim.
BE IT FURTHER RESOLVED that the city Attorney be, and
he is herebv authorized and directed to prepare and submit to
the City Co~ncil an ordinance amending Tlt1~ 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
