A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 1223
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an app1ica~ion for a conditional use permit
from HUGH D. and LELA F. PROCTOR, OWNERS, to establish on-sale
liquor sales in an existing res.taurant as a conforming use on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
All that certain real property in the Southwest
quarter of the Southwest quarter of the Northwest
quarter of Section 23, Township 4 South, Range 10
West, San Bernardino Base and Meridian, in ~e City
of Anaheim, County of Orange, State of California,
more particularly described as follows:
Beginning at a point in the Westerly boundary line
of said Section 23, said point being distant along
said Westerly line South 00 13' 30" East 953.59 feet.
from an iron pin marking the Northwest corner of
said Southwest quarter 'of the Northwest quarter of
Section 23, said iron pin being shown on plans of
California State Highway Division VII, Or~ge, Route
2, Section D., Sheet 20 in State Highway"Map.Book
No. Ii thence from said point of beginning North 890
461 30il East 70.19 feet, more or less, to a point in
the Westerly line of aforesaid California State High-
way (u.S. 101), 100 feet in width; thence along said
Westerly line of the State Highway North 60 58' 1511
West 192.86 feet; the.nce South 890 54' 4511 West
47.54 feet, more or less, to a point in said Westerly
line of the Northwest quarter of Section 23, said point
being distant along said Westerly line North 00 13'

Westerly prolongation of the center line of Cerritos
Avenue; thence along said Westerly line, So~th 00 13'

AND WHEREAS the City Planning Commission did. hold a
public hearing at th~ City Hall in the City o~ Anaheim upon
said application on ADril l.9 , 19 71 , notices of
which said public hearing were duly given as required by 1~
and the provisions of Title 18, Chapter 18.76 of the Anaheim-
MUnicipal Code; and
WHEREAS, said Commission, after due inspection., in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC 71-68 Series

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in -!pprovinq said conditional use
permit and did thereupon fix--flie 25th day of Max. ,
19 7l ,as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim MUnicipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing,'that:
1. The proposed" use is properly ODe for which a
conditional use permit is authorized by the
Anaheim MDnicip.l Code.
2. The proposed use will not adversely affect the
adjoining land uses" and the growth and development
of the area in which it is proposed to"be located.
3. The size and shape of the site propo8~d .for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental. to the
particular area nor to the peace, health, safety
and general welfare.
4. The traffic generated by the proposed, use. will not
impose an undue burden upon the streets" and high-
ways designed and improved to carry the traffic in
the area.
s. The granting of tbe conditional use permit under
the conditions imposed will not be detrimental to
the peace, beal th, safety and general we.lfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the ~ity Planning Com-
mission ;rantinq said conditional use permit be, and
the 8ame 18 ereby --.iilili'tiil1cYiF>Q. , and that Conditional Use
Permit No.. 1223 be, an the same 1s hereby, granted
permitting the establishment of on-sale liquor sales in an
existing restaurant as a conforming use on the property herein-
before described subject to the following conditions:
l. That this conditional use pe~it is granted subject
to the completion of Reclassification No. 70-7l~32.

That subject property be developed in accordance with
the Site Development Standards of the C-l Zone, pro-
vided, however, that tandem parking may be provided
along the north part of the property and the entire
setback in front of the building shall be landscaped
and landscaping shall be provided where the parking
area abuts a street.

The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause 'or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
