RES-2022-032RESOLUTION NO. 2022-032 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING CERTAIN PROPERTY TO BE "EXEMPT SURPLUS" PROPERTIES PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 54221(b)(1) WHEREAS, the Surplus Land Act, codified in California Government Code Section 54220 et wq, ("SLA") defines "surplus land" as land owned in fee by any local agency for which the local agency's governing body takes formal action in a regular public meeting declaring that the land is surplus and is not necessary for the agency's use; and WHEREAS, effective January 1, 2020, Assembly Bill (AB) 1486 amended the SLA to require the City of Anaheim to formally declare properties as "surplus land" or "exempt surplus land" prior to taking actions to dispose of such properties; and WHEREAS, a declamtion of surplus land, and the issuing of notices of availability required by the SLA, is a process adopted in State law, with the intent of ensuring prioritization of affordable housing; and WHEREAS, the City of Anaheim may satisfy the SLA by declaring multiple parcels as "surplus land" or "exempt surplus land" on an annual basis; however, such a declaration does not obligate the City to subsequently dispose of these properties or require the City to move forward with disposition of any property; and WHEREAS, pursuant to the SLA, "exempt surplus land" includes property that is (i) less I = 5,000 square feet in area, (ii) less than the minimum residential building lot size, or (ui) has no record access and is less than 10,000 square feet in area; and is not contiguous to land owned by a state or local agency that is used for open -space or low- and moderate -income housing purposes; and WHEREAS, as required by the Redevelopment Agency Dissolution Act, the Successor Agency to the Anaheim Redevelopment Agency prepared and received approval from the Department of Finance of a Long Range Property Management Plan pursuant to Health and Safety Code Section 34191.1, which identified certain properties to be retained by the City for future redevelopment activities; and WHEREAS, pursuant to AB 1486, properties identified either for sale or for future listed on the City's Long Range Property Management Plan resulting from the dissolution of the Anaheim Redevelopment Agency are considered to be surplus unless a property was contractually obligated prior to December 31, 2020, and the disposition completed by December 31, 2022; and WHEREAS, the City owns 4 properties located throughout the City of Anaheim, and identified in Exhibit A. that qualify as "exempt surplus land" for the reasons set forth in Exhibit A and WHEREAS, this declaration of "Exempt Surplus" land does not obligate the City to subsequently dispose of the land and the City may in the future determine that these properties are necessary for its use and not move forward with any disposition of any specific property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: Based on the above recitals and its independent review of Exhibit A the City Council hereby declares the properties listed in Exhibit A to be "Exempt Surplus" Properties for the reasons set forth in Exhibit A. 2. The City Council finds and determines that this action results in no binding commitment to authorize or advance the disposition of any of the Exempt Surplus Properties; will not result in a direct or indirect physical change in the environment; and does not constitute an "approval" of a "project" pursuant to CEQA Guidelines Sections 15004 and 15352.
