RESOLUTION NO. 82R-496
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SUPPORTING LEGISLATION TO AMEND
THE CALIFORNIA REVENUE AND TAXATION CODE TO
PROVIDE AN EXEMPTION FROM THE IMPOSITION OF
SALES AND USE TAXES ON SALES TO AND PURCHASES
BY LOCAL GOVERNMENTAL AGENCIES.
WHEREAS, city, county, and local governments provide
essential services to residents of California from funds
generated by the imposition of ad valorem taxes on real property~
and
WHEREAS, Articles XIII A and B of the State
Constitution, enacted by the people of California by passage of
Proposition 13, limit ad valorem tax revenue available to local
governments~ and
WHEREAS, the State deemed it necessary to provide
alternate funds to local governments to maintain essential
services at levels necessary to the preservation of the health
and well being of the people of this State~ and
WHEREAS, State funding of local governments diminishes
local control of local programs and State funding is now limited
due to the depletion of the State surplus and State Budget
constraints; and
WHEREAS, State and local sales and use taxes are
imposed on purchases of tangible personal property including
purchases by local governments of property used to provide
essential services; and
WHEREAS, payment of the State sales and use taxes by
local governments transforms local property tax revenues into
State General Fund revenues and local governments must pay a
fee to the State for collection of local sales and use taxes
which transforms additional property tax revenues to State
revenues.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Anaheim that it does support legislation to amend
the California Revenue and Taxation Code to provide an exemption
from the imposition of sales and use taxes on sales to and
purchases by local governmental entities.
BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby, authorized to transmit copies of this resolution
to the Governor and Lieutenant Governor of California, to the
Speaker of the Assembly, to the Chairman of the Assembly and
the State Committees on Taxation, and to each Senator and
Assemblyman in the Legislature of California.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 12th day of
October, 1982.
