RESOLUTION NO. 82R-591
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING PERSONNEL RULE 17, SICK
LEAVE, AND AMENDING RESOLUTION NO. 81R-151.
WHEREAS, Resolution No. 76R-182 established sick leave provisions;
and
WHEREAS, Resolution No. 80R-588 amended said provisions, by
converting a portion of the accumulated sick leave of employees working in job
classifications in specific units of representation and employee groups to
cash value to be paid with interest at retirement, layoff, or upon death of
the employee to his beneficiary as designated by Public Employees' Retirement
System Records; and
WHEREAS, Resolution No. 81R-24 extended this provision to all
other regular, full time employees of the City of Anaheim; and
WHEREAS, Resolution No. 81R-151 incorporated these and other
changes into the City of Anaheim Personnel Rules; and
WHEREAS, the Human Resources Director has recommended that
employees in classifications designated as management be allowed to receive
all or part of his accumulated cash value under conditions other than those
currently required by Personnel Rule 17; and
WHEREAS, the City Council of the City of Anaheim does find that
the adoption of the recommended new provisions is in the best interests of the
City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that Personnel Rule 17, Sick Leave, and Resolution No. 81R-151 be
amended by adding Rule 17, Subsection 17.93 to read as follows:
"17.93 An employee in a classification designated as management
who has more than five (5) years of continuous City
service and is age 50 or older may elect once each
calendar year to receive all or a portion of his/her
Employee Sick Leave Trust Fund amount. When requested,
suoh payments may be diverted to the employee's Deferred
Compensation account, or paid in cash by separate check
subject to standardized withholding taxes. When partial
payment is requested, the amount shall not be less than
251 of the balance, and a maximum of four (4) such partial
payments shall be allowed with the fourth payment paying
the entire remaining balance in the account.
BE IT FURTHER RESOLVED that except to the extent amended herein,
Resolution No. 81R-151 shall remain in full force and effect; and
BE IT FURTHER RESOLVED that the effective date of this resolution
shall be December 7, 1982.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim this 7th day of December
1982.
