A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
DETERMINING THAT A CLASS 1 CATEGORICAL EXEMPTION SERVES AS THE
APPROPRIATE ENVIRONMENTAL DOCUMENTATION AND
APPROVING CONDITIONAL USE PERMIT NO 2009-05454 AND DENYING
VARIANCE NO. 2009-04794

WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit No. 2009-05454 to permit a 50 foot tall mono-pine
telecommunication facility and Variance No. 2009-04794 to permit less landscaping than
required by Code on certain real property situated in the City of Anaheim, County of Orange,
State of California, shown on Exhibit "A", attached hereto and incorporated herein by this
reference; and
WHEREAS, the property proposed for a mono-pine telecommunications facility
is developed with Prince of Peace church located in the Transition (T) zone, and the Anaheim
General Plan designates this property for Medium Density Residential land uses; and
WHEREAS, the Anaheim City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on October 26, 2009, at 3:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the provisions of the
Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said
proposed conditional use permit and variance and to investigate and make findings and
recommendations in connection therewith; and
WHEREAS, the Anaheim City Planning Commission. after due inspection,
investigation and study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing with respect to the request for a conditional use
permit, does find and determine the following facts:
1. A telecommunications facility designed as mono-pine with a height of 50 feet in
the Transition (T) zone is properly one for which a conditional use permit is authorized by
Anaheim Municipal Code Section 18.38.060.050.0511 (Antennas Telecommunications).
2. The height of the telecommunications facility would not adversely affect the
adjoining land uses or the growth and development of the area in which it is proposed to be
located because the facility would be located 417 feet from Bali Road, 200 feet from the single
family residents to the north, 134 feet from the multi-family residences to the east and 194 feet
from the single family residences to the west and as a condition of approval three live pine trees
would minimize visual impacts by helping to disguising the facility as a natural object and
helping to blend the mono-pine into the surrounding environment.
