ORDINANCE NO. 4817
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 18.02.026 OF CHAPTER 18.02 OF TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING, DECLARING THE URGENCY THEREOF, AND
DECLARING THAT THIS ORDINANCE SHALL TAKE
EFFECT IMMEDIATELY.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Section 18.02.026 of Chapter 18.02 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"18.02.026 ZONING CODE -COMPLIANCE WITH PROVISIONS.
.010 All departments, officials or public
employees vested with the duty or authority to issue
permits or licenses where required by law shall conform
to the provisions of this title. No such license or
permit for uses, buildings or purposes where the same
would be in conflict with the provisions of this title
shall be issued. Any such license or permit, if issued
in conflict with the provisions herein, shall be null
and void; provided, however, the Building Official of
the City shall have the discretion to issue building
permits and other entitlements specified in Title 15 of
this Code for uses, buildings or purposes which would
otherwise conflict with any provision of this Title
then in effect but which would not so conflict upon the
effective date of any ordinance which has theretofore
been adopted by the City Council but which has not as
yet become effective due solely to the fact the
referendum period for such ordinance as specified by
law has not expired as of such date. Any permits
issued by the Building Official during such referendum
period shall be subject to such conditions, exactions
and limitations as the Building Official shall require.
.020 No premises or land shall be occupied
-� or used, nor shall any buildings or structures be
erected, altered or used until the occupant, owner,
tenant or user of the land, building or structure shall
have applied for, and been issued a zoning permit by
the Director of the Community Development and Planning
Department or a designee of the Director."
SECTION 2. DECLARATION OF URGENCY
This ordinance is hereby declared to be an emergency
measure and shall be in full force and effect immediately upon its
adoption. The facts constituting such urgency are that if
builders and developers are unable to obtain building permits
during the normal thirty -day period between the adoption of the
ordinance authorizing such development and the effective date of
such ordinance such projects will be delayed during this period of
time. This delay would postpone the completion of numerous
projects including health care facilities and public safety
facilities. Therefore, the adoption of this ordinance is
necessary as an emergency measure for the immediate preservation
of the public peace, health or safety.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 31st day of March, 1987.
