RESOLUTION 2010- 016
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF AN ELECTRICAL
.PUBLIC UTILITY EASEMENT LOCATED AT 2052 WEST
GREENLEAF AVENUE PURSUANT TO CALIFORNIA
STREETS AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (Abandonment No. ABA 2009 - 00198)
WHEREAS, an applicant has requested the vacation of a portion of an easement for
public utility purposes located at 2052 West Greenleaf Avenue, Anaheim, California, in order to
clear title to the land and facilitate the development of a 52 unit multi - family affordable housing
project; and
WHEREAS, the public utility easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easement; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order vacation of a portion of an electrical public utility easement, as set forth
in the Partnership Easement Deed recorded February 7, 1990 as Instrument Number 90- 069070 of
Official Records, Orange County, State of California and more particularly described in Exhibits "A"
and "B" attached hereto.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, upon relocation of the existing electrical facilities and dedication of a new
easement.
BE IT FURTHER RESOLVED that from and after the .date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 26th day of January , 2010, by the following roll call vote:
