RESOLUTION NO. - 86R-172
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING A LETTER OF
UNDERSTANDING BETWEEN THE CITY OF
ANAHEIM AND ANAHEIM FIREFIGHTERS
ASSOCIATION LOCAL NO. 2899.
WHEREAS, on August 21, 1984 the City Council approved Resolution No.
84R-32l adopting a Memorandum of Understanding between the City of Anaheim and
the Anaheim Firefighters Association, Local No. 2899 and
WHEREAS, the Human Resources Director met and conferred with
officials and employee representatives of the Anaheim Firefighters
Association, Local No. 2899 to discuss specific concerns relative to the
implementation of FLSA.
WHEREAS, a Letter of Understanding dated April 25, 1986 between the
parties has been prepared and signed amending provisions of"' the current
Memorandum of Understanding effective April 15, 1986 and
WHEREAS, the City Council of the City of Anaheim does find that
adoption of said Letter of Understanding is in the best interest of the City
of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that the Letter of Understanding dated April 25, 1986 between the City
of Anaheim and Anaheim Firefighters Association, Local No. 2899 is hereby
approved.

LETTER OF UNDERSTANDING
BETWEEN
THE CITY OF ANAHEIM
AND
ANAHEIM FIRE ASSOCIATION
The City of Anaheimt hereinafter referred to as the "City~" and the Anaheim
Firefighters Association Local 2899t hereinafter referred to as "AFA~" have
reached the following agreement on implementation of the Fair Labor Standards
Act (FLSA).
1. Fire Engineers and Fire Fighters are non-exempt under FLSA.
2. For the term of this agreement and on a non precedential basis for
the purpose of this agreement only Fire Captains are considered
exempt under FLSA and AFA will not contest that issue.
3. Fire Captains will earn time and 1/2 pay for all situational manning
worked.
4. All voluntary committee work by Fire Captains will be considered
non-compensable.
5. All voluntary special training functions performed by Fire Captains
will be considered non-compensable.
6. All overtime work presently compensated at time-and-one-half under
the terms of the Memorandum of Understanding will continue to be so
compensated.
7. Compensatory time for suppression employees shall be earned at a rate
of 24 hours to be banked, with a 12 hour cash pay-off to occur in the
pay period following the time worked.
8. City agrees not to increase staffing to eliminate overtime for
situational manning.

DURATION:
This Letter of Understanding will be in effect until rescinded in writing by
either party. If rescinded all pay, benefits~ and working conditions provided
by this agreement will automatically cease.
