A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DECLARING A PORTION OF CITY-OWNED
PROPERTY TO BE "EXEMPT SURPLUS" PROPERTIES
PURSUANT TO CALIFORNIA GOVERNMENT CODE
SECTION 54221(b)(1) AND NOTICE OF INTENT TO SELL A
PORTION OF CITY-OWNED REAL PROPERTY
WHEREAS, the Surplus Land Act, codified in California Government Code Section
54220 et seq., ("SLA") defines "surplus land" as land owned in fee by any local agency for
which the local agency's governing body takes formal action in a regular public meeting
declaring that the land is surplus and is not necessary for the agency's use; and
WHEREAS, effective January 1, 2020, Assembly Bill (AB) 1486 amended the SLA to
require the City of Anaheim to formally declare properties as "surplus land" or "exempt
surplus land"prior to taking actions to dispose of such properties; and
WHEREAS, a declaration of surplus land, and the issuing of notices of availability
required by the SLA, is a process adopted in State law,with the intent of ensuring prioritization
of affordable housing; and
WHEREAS, pursuant to the SLA, "exempt surplus land" includes property that is (i) less
than 5,000 square feet in area, (ii) less than the minimum residential building lot size, or(iii) has
no record access and is less than 10,000 square feet in area; and is not contiguous to land owned
by a state or local agency that is used for open-space or low- and moderate-income housing
purposes; and
WHEREAS, the State of California Surplus Land Act ("SLA; Government Code section
54221 (f)(1)(B)) requires that prior to a local agency's disposition of surplus land, the agency
must send a written notice of availability ("NOA") to certain parties designated by the SLA,
unless the subject properties are determined to be Exempt Surplus Land; and
WHEREAS, the City owns that certain real property located at 6501 East Nohl Ranch in
the City of Anaheim, County of Orange, State of California, APN 085-571-24, generally known
as Anaheim Hills Golf Course; and
WHEREAS, a portion of Anaheim Hills Golf Course consisting of approximately 4,878
square feet has not been used by the City, is not required for municipal use, and is described in
Exhibit"A" and depicted on"B" attached hereto; and
WHEREAS, this declaration of "Exempt Surplus" land does not obligate the City to
subsequently dispose of the land and the City may in the future determine that these properties
are necessary for its use and not move forward with any disposition of any specific property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:

1. The above recitals are true and correct and incorporated herein by reference.
2. Based on the above recitals and its independent review of Exhibit "A" and `B",
the City Council hereby declares that portion of property described in Exhibit"A"
and depicted in Exhibit `B" to be "Exempt Surplus" Property pursuant to
California Surplus Land Act because the parcel is less than 5,000 square feet in
area, is less than the minimum legal residential building lot size, has no record
access, is part of APN 085-571-24 and is not contiguous to land owned by a state
or local agency.
3. The City Council finds and determines that this action results in no binding
commitment to authorize or advance the disposition of any of the Exempt Surplus
Property.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that a notice of
intent to sell shall be given by posting a copy of this Resolution in a public place and on the
Exempt Surplus Property.

City of Anaheim this 4th day of October , 2022,by the following roll call vote:
