RESOLUTION NO. 86R-241
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DECLARING ITS INTENTION TO MAKE
CERTAIN IMPROVEMENTS UNDER THE AUTHORITY OF
THE STREET LIGHTING ACT OF 1931. DESCRIBING
THE IMPROVEMENTS TO BE MADE. NAMING THE
STREETS UPON walCH THE IMPROVEMENTS ARE TO BE
MADE. REFERRING TO THE REPORT OF THE
SUPERINTENDENT OF STREETS ON FILE IN THE
OFFICE OF THE CITY CLERK. FIXING THE PERIOD OF
TIME FOR WHICH THE IMPROVEMENTS ARE TO BE
MADE. AND SETTING A TIME AND PLACE FOR HEARING
PROTESTS.
WHEREAS. the City Council of the City of Anaheim is of
the opinion that public interest and convenience requires that a
po~tion of the st~eet liqhtinq system be maintained and se~viced
upon ce~tain streets in the City of Anaheim. as hereinafter set
fo~th: and
WHEREAS. the City Council did ~equi~e the supe~intendent
of Streets to make and file with the City Clerk a written report
with ~ega~d to the contemplated imp~ovements: and
WHEREAS. said ~epo~t of the Supe~intendent of St~eets was
approved by the City council of the City of Anaheim on the 3rd day
of June. 1986. by Resolution No.86R-240. and filed with the City
Cle~k.
NOW. THEREFORE. BE IT RESOLVED by the City Council of the
City of Anaheim. as follows:
1. Public inte~est and convenience does ~equi~e that
improvements be made to certain property in the City of Anaheim.
and the City Council of the City of Anaheim does here~y declare
its intention to make the following described improvements under
the authority of the Street Lighting Act of 1931.
2. ThA improVAmantg to bA madA arA thA maintAnan~A and
servicing of an ornamental type street lighting system along and
upon Helena Street between South Street and approximately 120 feet
no~tb of Hampshi~e St~eet in Tract No. 1392.
3. A ~epo~t of the Superintendent of St~eets has been
approved by the City Council of the City of Anaheim and is on file
with the City Cle~k of the City of Anaheim. designated IIStreet
Lighting Maintenance District 1980-4.11 Said ~eport contains an
estimate of the cost of the imp~ovements and incidental expenses
for the period of time the improvements are to be made. a diaqram
o~ map Showing the st~eet affected and Showing each lot or pa~cel
of land abutting such street. a proposed assessment of the total
amount of the estimated cost and expenses upon the seve~al lots o~
parcels of land shown on the diagram or map in p~opo~tion to the
estimated benefits to be received by each lot or parcel of land
for the period of time of the improvements, and plans and
specifications settino out the general type of street liOhting
system and the location of the lights to be se~viced and
maintained: and reference to such report is hereby made as though
set forth in full herein, and all persons are directed to such
report on file with the City Clerk for more particulars.
4. The period of time for which the improvements are to be
made is hereby set at five (5) years, to commence on or about July
1, 1986, and to continue for five (5) years from such date.
AND BE IT FURTHER RESOLVED that the 1st day of July,
1986. at the hour of 1:30 p.m. in the Council Chamber of the Civic
Center in the City of Anaheim, is he~eby declared as the day, hour
and place when and where any and all persons having any objections
to the proposed improvements or to the assessment as set forth in
the report of the Superintendent of Streets. may appear before the
legislative body and show cause why the proposed improvements
should not be carried out in accordance with the report of the
superintendent of Streets on file with the City Clerk. Protests
must be in writing and must contain a description of the property
in which each signor thereof is interested, and be delivered to
the City Clerk not later than the time set for the hearing.
Protests may be against the proposed improvements or against the
estimated amount of the assessment.
BE IT FURTHER RESOLVED that the Superintendent of Streets
of the City of Anaheim shall cause notice of the improvements and
of the passage of this Resolution of Intention to be conspicuously
posted along the lines of the contemplated imp~ovements, at not
more than 300 feet apa~t, but not less than th~ee (3) in all, and
such posting shall be fully completed at least ten (10) days
befo~e the date set fo~ hea~ing of p~otests of objections. The
contents of such notice shall be in conformity with the
requirements of the St~eet Lighting Act of 1931.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Anaheim be. and she is hereby. directed to publish this Resolution
of Intention by insertion in the Anaheim Bulletin, a daily
newspaper of general circulation. published and ci~culated in the
City of Anaheim. Such pUblication shall be not less than ten (10)
days prior to the date of pUblic hearing as set fo~th in this
resolution.
THE FOREGOING RESOLUTION is app~oved and adopted by the
City council of the City of Anaheim this 3rd day of June. 1986.
