Houry of Anaheim Postal Place, and the property owner is Andrea M. Johnson of Lugaro Enterprises. REQUEST: The applicant requests approval of a conditional use permit to allow an Equipment Rental – Large use for a U-Haul truck rental for five vehicles in conjunction with Anaheim Postal Place in an existing commercial retail center. RECOMMENDATION: Staff recommends that the Planning Commission find and determine that a Class 1 – Existing Facilities Categorical Exemption under the California Environmental Quality Act (CEQA) (Public Resources Code, Sections 21000-21189.57) as set forth in Sections 15301 and 15300.2 of the State CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3, Sections 15000- 15387) is the appropriate environmental documentation for this request; and adopt the attached resolution approving Conditional Use Permit No. 2021-06108. BACKGROUND: The subject property is 2.17-acres in area and developed with a 20,747 square foot, one-story commercial building that includes general offices, retail stores, restaurants, and medical offices. Anaheim Postal Place occupies a 1,200 square foot unit on the property, and it is used as a mailbox rental and retail store for shipping products and postal services. The property is in the “C-G” General Commercial Zone and is designated for Corridor Residential land uses in the General Plan. The project site is bordered by commercial uses to the north, and residential uses to the south, east, and west across Magnolia Avenue. Anaheim Postal Place has operated at this location since 2011. The business operates with one employee every day, Monday through Friday from 11:00am to 7:00pm, on Saturday from 10:00am to 7:00pm and Sunday 10:00am to 2:00pm. The unit is shown in gray on the site plan below. Conditional Use Permit No. 2021-06108 October 24, 2022 Page 2 of 4 SITE PLAN PROPOSAL: The applicant proposes to add U-Haul truck and trailer rentals to the existing mailbox rental and retail services. The request includes the conversion of five parking spaces (indicated in blue) for parking of the U-Haul trucks. The proposed parking spaces would be located along the east property line directly behind the Anaheim Postal Place unit, at rear of the project site away from Magnolia Avenue. No fence or permanent screening for the rental trucks is proposed. The truck rental pick-up services would operate during existing store hours on Monday through Friday from 11:00 a.m. to 7:00 p.m., on Saturday from 10:00 a.m. to 7:00 p.m. and Sunday 10:00 a.m. to 2:00 p.m. Rental returns would occur 24-hours a day to designated storage spaces. Renters would book their rental through the U-Haul website and pick up the rented truck or trailer keys from the Anaheim Postal Place employee. Customers would return the truck when ready to this location or authorized neighborhood retailer in the area. The spaces would be restriped to be 23 feet long and 9 feet wide to accommodate the storage of up to five U-Haul rental trucks or trailers ranging from 10 feet to 15 feet long. Minor restriping of the parking spaces on the property is proposed with this request. No expansion of the building is proposed. FINDINGS AND ANALYSIS: Conditional Use Permit: Before the Planning Commission may approve a conditional use permit, it must make a finding of fact that the evidence presented shows that all of the following conditions exist: 1) That the proposed use is properly one for which a minor conditional use permit or a conditional use permit is authorized by this code; Conditional Use Permit No. 2021-06108 October 24, 2022 Page 3 of 4 2) That the proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located; 3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety; 4) That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 5) That the granting of the minor conditional use permit or conditional use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim. This request is classified as “Equipment Rental-Large” in the Anaheim Municipal Code ("Code”) and is permitted in the C-G Zone subject to approval of a conditional use permit. The proposed request would not adversely affect the adjoining land uses or development of the area as the rental trucks and trailers would be located behind the commercial buildings and away from the public view. The size and shape of the property is adequate to accommodate the proposed use, and the property has sufficient parking to include the storage of the trucks and trailers. The Code requires 112 parking spaces for the existing uses on the property and 129 spaces are provided. The applicant is proposing to use five parking spaces for the storage of the rental trucks and trailers. With the use of five spaces for storage of the rental trucks and trailers, the property would have 12 parking spaces more than required by Code. Conditions of approval are included in the draft resolution limiting the business to five truck and trailer storage spaces as well as limiting length to15 feet for rental trucks and trailers to ensure that they will fit in the standard parking spaces. 5 12 Conditional Use Permit No. 2021-06108 October 24, 2022 Page 4 of 4 The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area since the proposed use would operate for rental pick-up during the normal operating hours of the commercial center with 24- hour rental drop off and the business is limited to five rental trucks or trailers. The granting of the conditional use permit for the use under the conditions imposed would not be detrimental to the health and safety of the citizens of the City of Anaheim. Environmental Impact Analysis: The Project qualifies for a Class 1 – Existing Facilities Categorical Exemption under the California Environmental Quality Act (CEQA) (Public Resources Code, Sections 21000-21189.57) as set forth in Sections 15301 and 15300.2 of the State CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3, Sections 15000-15387). Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The proposed project is for addition of use the property’s existing facility. Pursuant to Section 15300.2 (c) and 15301 of Title 14 of the California Code of Regulations, and as further described in this staff report, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project would be categorically exempt from the provisions of CEQA. CONCLUSION: Staff believes that the addition of the U-Haul rentals to the Anaheim Postal Place use would be compatible with the existing commercial retail center and surrounding uses. The proposed use would be consistent with the zoning and General Plan land use designation for the property, and the project is designed and conditioned to ensure that the rental use would not impact surrounding properties. Based on the analysis included in this report and the findings in the draft resolution, staff recommends that the Planning Commission approve this request. PC2022-*** A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM APPROVING CONDITIONAL USE PERMIT NO. 2021-06108 AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH (DEV2021-00140) (532 North Magnolia Avenue) WHEREAS, the Planning Commission of the City of Anaheim (the "Planning Commission") did receive a verified petition to approve Conditional Use Permit No. 2021-06108 to permit an Equipment Rental – Large use for a U-Haul truck and trailer rental for five vehicles in conjunction with Anaheim Postal Place in an existing commercial retail center (the “Proposed Project”), on certain real property located at 532 North Magnolia Avenue in the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit A attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS, the Property is approximately 2.17 acres in area and is developed with a 20,747 square foot, one-story commercial building. The Land Use Element of the General Plan designates this property for Corridor Residential land uses. The property is located in the “C-G” General Commercial Zone. The development standards and regulations of Chapter 18.08 (Commercial Uses) of the Anaheim Municipal Code (the “Code”) apply to the Proposed Project; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 24, 2022 at 5:00 p.m., with notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against proposed Conditional Use Permit No. 2021-06108 and to investigate and make findings and recommendation in connection therewith; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's CEQA Procedures, the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds that the effects of the proposed project are Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines, Section 15301, Class 1 (Existing Facilities). Class 1 consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of use beyond that existing at the time of this determination. The Proposed Project is within an existing multi-tenant commercial building. Pursuant to Section 15300.2 (c) and Section 15301 of Title 14 of the California Code of Regulations, and as further - 2 - PC2022-*** described in this staff report, there are no unusual circumstances in respect to the project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for Conditional Use Permit No. 2021-06108, does find and determine the following facts: 1. The Proposed Project is properly one for which a conditional use permit is authorized as an allowable use within the General Commercial zone under subsection .010 of Section 18.08.030 (Uses) of Chapter 18.08 (Commercial Zones) of the Code, subject to a conditional use permit for Equipment Rental-Large uses. 2. The Proposed Project, as conditioned herein, would not adversely affect the adjoining land uses, or the growth and development of the area because the project would not include any new construction or development on the Property and would not significantly affect the neighboring commercial and residential properties because the use will operate during the normal hours of the existing commercial retail center. 3. The size and shape of the site is adequate to allow the full development of the Proposed Project in a manner not detrimental to either the particular area nor to the health and safety of the public because the existing commercial retail center property can accommodate the parking, traffic, and circulation without creating detrimental effects on adjacent properties. 4. The traffic generated by the Proposed Project would not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the traffic generated by the Proposed Project will not exceed the anticipated volumes of traffic on the surrounding streets. 5. The granting of the conditional use permit would not be detrimental to the health and safety of the citizens of the City of Anaheim because the Proposed Project would be compatible with the commercial retail center and surrounding area, subject to compliance with the conditions contained herein; and WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that negate the findings made in this Resolution. This Planning Commission expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, this Planning Commission does hereby approve Conditional Use Permit No. 2021-06108, contingent - 3 - PC2022-*** upon and subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the Property for which Conditional Use Permit No. 2021-06108 is applicable in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition, (ii) the modification complies with the Code, and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. BE IT FURTHER RESOLVED, that any amendment, modification, or revocation of this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit Approval) and 18.60.200 (Revocation or Modification of Permits) of the Code. BE IT FURTHER RESOLVED, that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED, that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation, or requirement. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of October 24, 2022. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 (Procedures) of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in the event of an appeal. Planning and Building Department, Planning Services Division 5 Owner/Operator shall remove all unpermitted outdoor storage on the project site located in the parking spaces to be consistent with the approved project plans. Planning and Building Department, Planning Services Division 6 An approved fire access road/lane shall be maintained for this proposal. The fire access road/lane shall be a minimum of 20 feet in width, with 14 feet of vertical clearance. No rental truck or piece of equipment shall obstruct or be parked within the approved fire access road/lane. Fire and Rescue Department 7 All vehicles associated with this site shall be operable and parked in designated parking stalls. Public Works Department, Traffic Engineering 8 All new landscaping shall be installed in conformance with Chapter 18.46 “Landscape and Screening” of the Anaheim Municipal Code and shall be maintained in perpetuity. Landscaping shall be replaced in a timely manner in the event that it is removed, damaged, diseased, and/or dead.
