A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
ESTABLISHING A COMMERCIAL FACADE IMPROVEMENT
PROGRAM (PROGRAM) AND APPROVING GUIDELINES FOR THE
PROGRAM; DIRECT AND AUTHORIZE THE DIRECTOR OF
ECONOMIC DEVELOPMENT, OR DESIGNEE, TO EXECUTE ALL
RELATED DOCUMENTS, AND TO TAKE SUCH ACTIONS AS
NECESSARY OR ADVISABLE TO IMPLEMENT AND ADMINISTER
THE PROGRAM ON BEHALF OF THE CITY; AND DETERMINING
THAT THE PROGRAM IS CATEGORICALLY EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the City of Anaheim (the "City") is a California municipal corporation and
charter city; and
WHEREAS, the City Council of the City of Anaheim ("City Council") desires to establish
a Commercial Building Fagade Program (the "Program") and, in connection with establishing the
Program, adopt Guidelines for the implementation and administration of the Program; and
WHEREAS, the City has budgeted funds for the Program for the current fiscal year; and
WHEREAS, the City prepared a report pursuant to Section 53083 of California
Government Code summarizing the Program and providing additional required information (the
"Report") and made such Report available for public review and inspection prior to the public
meeting considering establishment Program as required by law; and
WHEREAS, pursuant to and in accordance with the provisions of the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as
"CEQA"), the State of California Guidelines for Implementation of the California Environmental
Quality Act (herein referred to as the "CEQA Guidelines"), and the City's CEQA Procedure
Manual, the City is the "lead agency" for the preparation and consideration of environmental
documents for "projects," as that term is defined in Section 15378 of the CEQA Guidelines; and
WHEREAS, the City desires to assist qualified commercial businesses within the City by
providing grants to make facade improvements that will promote beautification and business
revitalization in key commercial corridors and will be targeted to control and prevent blight and
deterioration within the City along with promoting business retention and expansion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ANAHEIM:
Section 1. The City Council hereby finds and determines that the foregoing recitals are
true and correct and are a substantive part of this Resolution.
Section 2. The City Council hereby establishes the City of Anaheim Commercial
Facade Improvement Program and, in connection therewith, approve the Guidelines for the
administration and implementation of the Commercial Fagade Improvement Program, which
Guidelines have been submitted concurrently with this resolution.
Section 3. The City Council hereby finds and determines that the Program and related
approval and authorizations thereto are Categorically Exempt from CEQA pursuant to Class 1,
Section 15301 (Existing Facilities) of the CEQA Guidelines because implementation of the
Program will involve repair, maintenance, permitting, and/or minor alteration to existing private
structures and facilities involving negligible or no expansion of use beyond that existing at this
time.
Section 4. In addition to the authorization of Section 2 above, the Director is hereby
authorized, on behalf of the City, to sign all documents necessary or appropriate to carry out and
implement the Program, to implement and administer the Guidelines including all exhibits thereto
and including causing the issuance of warrants in implementation thereto, to enter into grant
agreements with Program recipients in such form as approved by the City Attorney, and to
administer the City's obligations, responsibilities and duties to be performed under the Program
and Guidelines thereto.
Section 5. The City Clerk shall certify to the adoption of this Resolution.
