RES-2022-140RESOLUTION NO. 2022 - 1 4 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A LETTER OF UNDERSTANDING WITH THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, LOCAL 2002 (AFSCME); AND AMENDING APPENDIX B OF THE MEMORANDUM OF UNDERSTANDING BETWEEN AFSCME PROFESSIONAL/TECHNICAL MANAGEMENT UNIT AND THE CITY OF ANAHEIM BY WAY OF AMENDMENT TO RESOLUTION NO.2021-120 WHEREAS, AFSCME Local 2002 is the exclusive representative for the AFSCME Professional/Technical Management Unit; and WHEREAS, the City Council of the City of Anaheim adopted Resolution No. 2021- 120 adopting a Memorandum of Understanding between the City of Anaheim and AFSCME (MOU); and WHEREAS, the MOU includes APPENDIX B, a list of classifications represented by AFSCME including the classification of Chief Policy Advisor to the Mayor; and WHEREAS, the City of Anaheim have met and conferred and agreed that the classification of Chief Policy Advisor to the Mayor is to be returned to unrepresented status; and WHEREAS, the City Council of the City of Anaheim finds that approval of a LETTER OF UNDERSTANDING between the AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES LOCAL #2002, Professional/Technical Management Unit signed by AFSCME on October 21, 2022 and amendment of the MOU APPENDIX B, is in the best interest of the City of Anaheim. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the LETTER OF UNDERSTANDING between the AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES LOCAL #2002, Professional/Technical Management Unit signed by AFSCME on October 21, 2022 and included as Attachment 1 a revised MOU APPENDIX B, as set forth in the document attached hereto and incorporated by reference herein, be and the same is hereby adopted and the effective date of such Letter of Understanding and revised MOU APPENDIX B be November 25, 2022. BE IT FURTHER RESOLVED that the Human Resources Director shall be delegated with the authority to publish the authorized salary schedule in APPENDIX B in any format meeting the requirements of California Code of Regulations section 570.5. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 15 day of November 2022, by the following roll call vote: AYES: Mayor Pro Tem O'Neil and Council Members Diaz, Ma'ae, Moreno, Valencia and Faessel NOES: None ABSENT: None ABSTAIN: None [Mayoral vacancy] MAYOR VRO TEM M THE CITY OF ANAHEIM AT CITY CLE OF THE CITY OF ANAHEIM LETTER OF UNDERSTANDING between the AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, Local 2022, Professional/Technical Management Unit and the CITY OF ANAHEIM The American Federations of State, County, and Municipal Employees, Local 2022, Professional/Technical Unit ("AFSCME") and the City of Anaheim ("ANAHEIM"), collectively herein the "PARTIES", reached agreement on initial terms and conditions of employment for ANAHEIM employees represented by AFSCME and memorialized same in the Memorandum of Understanding between the American Federations of State, County, and Municipal Employees, Local 2022, Professional/Technical Unit and the City of Anaheim with a term of December 24, 2021 through June 30, 2023 ("MOU"). Prior to certification of AFSCME as the recognized representative of the classifications included in APPENDIX B of the MOU, such classifications were not formally represented. Following ratification and implementation of the MOU, the PARTIES began discussing and have agreed to revise APPENDIX B of the MOU to eliminate the classification of Chief Policy Advisor to the Mayor and return this classification to its previous unrepresented status. The PARTIES further agree that this classification is limited to use for only one position and by a single incumbent in such position at any given time. Upon approval of this Letter of Understanding by the ANAHEIM City Council, APPENDIX B shall be updated to remove the Chief Policy Advisor to the Mayor classification.
