APPROVING CONDITIONAL USE PERMIT NO. 2010-05488

WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit No.2010-05488, to permit a tutoring facility within an
existing commercial center for certain real property situated in the City of Anaheim, County of
Orange, State of California, shown on Exhibit “A”, attached hereto and incorporated herein by
this reference.
WHEREAS, this property is developed with a commercial center located in the
General Commercial (C-G) - Scenic Corridor (SC) Overlay Zone and the Anaheim General Plan
designates the property for neighborhood commercial land uses; and
WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on April 26, 2010, at 3:30 p.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed
conditional use permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Planning Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing with respect to the request for a conditional use permit, does find and
determine the following facts:
1. That the proposed tutoring facility is properly one for which a conditional use
permit is authorized by Anaheim Municipal Code Section 18.08/030.040.0402 (Educational
Institutions-General).
2. The operation of a tutoring facility will not adversely affect the adjoining land
uses or the growth and development of the area in which it is proposed to be located because the
use is will be conducted entirely within an existing building with no outside activities and it is
compatible with existing commercial uses on the site.
3. The size and shape of the site for the use is adequate to allow the full development
of the proposed use in a manner not detrimental to the particular area or to the health and safety
because this use will be located within an existing tenant space of an established commercial
center.

4. The traffic generated by the tutoring facility will not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area. A total of
141 parking spaces are provided for the property, including the tutoring facility, and the use
would have the same parking demand ratio as other offices uses in the complex, therefore, a
parking variance is not required for this request.
5. The granting of the conditional use permit will not be detrimental to the health
and safety of the citizens of the City of Anaheim because the use is similar to commercial uses in
the area and activities would occur entirely within the existing tenant space.
WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Class 1 (Existing Facilities) as defined in the State CEQA Guidelines, and is
therefore, exempt from the requirement to prepare additional environmental documentation.
NOW THEREFORE BE IT RESOLVED, that the Anaheim City Planning
Commission does hereby approve Conditional Use Permit No. 2010-05488 subject to the
conditions of approval described in Exhibit “B” attached hereto and incorporated by this
reference which are hereby found to be a necessary prerequisite to the proposed use of the
subject property in order to preserve the health, safety and general welfare of the citizens of the
City of Anaheim. Extensions for further time to complete conditions of approval may be granted
in accordance with Section 18.60.170 of the Anaheim Municipal Code.
BE IT FURTHER RESOLVED, that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of
any court of competent jurisdiction, then this Resolution, and any approvals herein contained,
shall be deemed null and void.
BE IT FURTHER RESOLVED, that this conditional use permit is approved
without limitations on the duration of the use.
BE IT FURTHER RESOLVED, that approval of this application constitutes
approval of the proposed request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal regulations. Approval does not
include any action or findings as to compliance or approval of the request regarding any other
applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all
charges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice. Failure to pay all charges shall result in delays in the issuance of
required permits or the revocation of the approval of this application.

WHEREAS, on May 15, 1995, the Anaheim City Planning Commission, by its
Resolution No. PC95-53, did approve an expansion of an existing convenience market to combine an
existing convenience market with an existing liquor store; and
WHEREAS, on December 16, 2002, the Anaheim City Planning Commission, by its
Resolution No. PC2002-181, did approve an amendment to Conditional Use Permit No. 3763 to
amend the hours of operation to extend the hours of operation and added additional conditions of
approval pertaining to the sale of alcoholic beverages for off-premises consumption including the
condition pertaining to the restriction of the sale of single serving alcoholic beverages which the
applicant requested be deleted: and
WHEREAS, Resolution No. PC95-53, as previously amended, includes the following
conditions of approval:
“2. That subject convenience market shall continuously adhere to the following conditions as
required by the Police Department:
(k) That no person under twenty one (21) years of age shall buy, or be permitted to sell,
any alcoholic beverage.
(l) That beer shall not be sold in packages containing less than a six (6) pack; and that
wine coolers shall not be sold in packages containing less than a four (4) pack.”
WHEREAS, this property is currently developed with a 3,307 square foot convenience
market and is located in the General Commercial (C-G) zone and the Anaheim General Plan
designates this property for Residential Corridor land uses; and
WHEREAS, the Anaheim City Planning Commission did receive a verified Petition to
amend Conditional Use Permit No. 3763, to modify or delete a condition of approval pertaining to
the sales of single-serving alcoholic beverages Condition No.2 (l), pursuant to Code Section No.
18.60.190 of the Anaheim Municipal Code for certain real property situated in the City of Anaheim,
County of Orange, State of California, shown on Exhibit “A”, attached hereto and incorporated
herein by this reference; and

WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on April 26, 2010, at 3:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code,
Chapter 18.60 “Procedures”, to hear and consider evidence for and against said proposed
amendment and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. The facts necessary to support each and every finding for the original approval of the
entitlement as set forth in this chapter exist.
2. The permit is being exercised substantially in the same manner and in conformance
with all conditions and stipulations originally approved.
3. The existing permit has been consistently exercised in a manner not detrimental to the
particular area and surrounding land uses, nor to the public peace, health, safety and general welfare
as there have not been any code violations on this property.
4. With regard to the deletion of Condition No. 2 (k) that a person under twenty one years of
age be permitted to sell beer and wine and Condition No. 2 (l) pertaining to the sales of single-serving
alcoholic beverages, such deletion is appropriate because it has been demonstrated that the use has
operated in a manner that is appropriate in the underlying zone and the surrounding area.
5. The existing use at the time of approval was properly one for which a conditional use
permit was authorized by the Zoning Code.
6. The use, as amended, will not adversely affect the adjoining land uses and the growth
and development of the area in which it is located as the convenience market has been operating in
conformance with all conditions of approval and there have been no code violations on the property.
7. The size and shape of the site for the existing use is adequate to allow the full
development of the use, in a manner not detrimental to either the particular area or health and safety
as the convenience market has been operating in conformance with all conditions of approval and
there have been no code violations on the property.
8. The traffic generated by the existing use will not impose an undue burden upon the
streets and highways designed and improved to carry the traffic in the area as the convenience
market has been operating in conformance with all conditions of approval and there have been no
code violations on the property or complaints of parking or traffic impacts.
9. Police Department recommends approval of the request to delete the conditions of
approval. Based upon research of crime statistics for the area and calls for service to this location,
there is no indication of any identifiable problems associated with the proposed sales of singles.

WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Class 1 (Existing Facilities) as defined in the State CEQA Guidelines, and is therefore,
exempt from the requirement to prepare additional environmental documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission, for the reasons hereinabove stated does hereby approve the amendment to Conditional
Use Permit No.3763, as previously amended, to delete Condition No. 2 (k) and (l) of Resolution No.
PC2002-181 pertaining to the age restriction relating to the sale of alcoholic beverages and the sale
of beer in packages containing less than a six (6) pack and wine in packages containing less than a
four (4) pack.
BE IT FURTHER RESOLVED that the Planning Commission does hereby amend, in
their entirety, the conditions of approval adopted in connection with Planning Commission
Resolution No. PC95-53, as previously amended by Planning Commission Resolution No. PC2002-
181, to read as shown in Exhibit “B” attached hereto and incorporated herein by this reference,
which conditions are hereby found to be a necessary prerequisite to the proposed use of the subject
property in order to preserve the health, safety and general welfare of the citizens of the City of
Anaheim.
BE IT FURTHER RESOLVED, that this permit is approved without limitations on the
hours of operation or the duration of the use. Amendments, modifications and revocations of this
permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit Approval)
and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Anaheim Municipal
Code.
BE IT FURTHER RESOLVED that, except as expressly amended herein, the
provisions of Resolution No. PC2002-181, approving Conditional Use Permit No.3763, as previously
amended, shall remain if full force and effect.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's
compliance with each and all of the conditions hereinabove set forth. Should any such condition, or
any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
BE IT FURTHER RESOLVED that approval of this application constitutes approval
of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code
and any other applicable City, State and Federal regulations. Approval does not include any action or
findings as to compliance or approval of the request regarding any other applicable ordinance,
regulation or requirement.

WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit No. 2010-05481, to sales of beer and wine for on-premises
consumption within an existing restaurant in an existing commercial center proposed for certain
real property situated in the City of Anaheim, County of Orange, State of California, shown on
Exhibit “A”, attached hereto and incorporated herein by this reference.
WHEREAS, this property is developed with commercial building located in the
Commercial General (CG) zone and the Anaheim General Plan designates the property for Low
Medium Density Residential land uses; and
WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on April 26, 2010, at 3:30 p.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed
conditional use permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Planning Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing with respect to the request for a conditional use permit, does find and
determine the following facts:

2. The request to permit the sales of beer and wine for on-premises consumption
within an existing restaurant would not adversely affect the surrounding land uses and the growth
and development of the area in which it is proposed to be located because the property is
currently developed with a commercial shopping center and the proposed use is compatible with
the surrounding area.

3. The size and shape of the site is adequate to allow the full development of the
proposed use in a manner not detrimental to the particular area nor to the health, safety and
general welfare of the public because the property is currently improved with a commercial
center with no proposed expansion.
4. The traffic generated by permitting the sales of beer and wine for on-premises
consumption within an existing restaurant would not impose an undue burden upon the streets
and highways designed and improved to carry the traffic in the area because the number of
vehicles entering and exiting the site are consistent with existing restaurant and permitted
businesses within the commercial center.
5. The granting of the conditional use permit under the conditions imposed will not
be detrimental to the health and safety of the citizens of the City of Anaheim.
6. The granting of the conditional use permit under the conditions imposed will not
be detrimental to the health and safety of the citizens of the City of Anaheim and will provide a
land use that is compatible with the surrounding area.
WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Class 1 ((Existing Facilities) as defined in the State CEQA Guidelines, and is
therefore, exempt from the requirement to prepare additional environmental documentation.
NOW THEREFORE BE IT RESOLVED that the Anaheim City Planning

Commission does hereby approve Conditional Use Permit No. 2010-05487 subject to the
conditions of approval described in Exhibit “B” attached hereto and incorporated by this
reference which are hereby found to be a necessary prerequisite to the proposed use of the
subject property in order to preserve the health, safety and general welfare of the citizens of the
City of Anah eim. Extensions for further time to complete conditions of approval may be granted
in accordance with Section 18.60.170 of the Anaheim Municipal Code.

WHEREAS, on March 5, 2007, the Anaheim City Planning Commission, by its
Resolution No. PC2007-15, did approve Conditional Use Permit No. 2006-05137 to permit an
outdoor storage yard for a drilling contractor including accessory repair with fewer parking
spaces than permitted by code and variance from the code requirement to provide an 8-foot high
block wall adjacent to residential property; and
WHEREAS, this property is developed with a legal non-conforming single family
residence and modular trailer. The property is located in the Northeast Area Specific Plan No.
94-1, Development Area 1 zone and the Anaheim General Plan Land Use Element designates the
property for Industrial land uses; and
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for amendments to Conditional Use Permit No. 2006-05137 to permit an outdoor storage
facility in order to amend certain conditions of approval and to delete specific conditions
approval pertaining construction of a warehouse/office building on the site for certain real
property situated in the City of Anaheim, County of Orange, State of California, as particularly
shown on Exhibit “A”, attached hereto and incorporated herein by this reference (hereinafter
referred to as “Conditional Use Permit No. 2006-05137A”); and
WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on April 26, 2010, at 3:30 p.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed
conditional use permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Planning Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing with respect to the request for a conditional use permit, does find and
determine the following facts:
1. The request to permit an outdoor storage facility is properly one for which a
conditional use permit is authorized under Code Section Nos. 18.120.050.050.0515 (Conditional
Uses and Structures) and 18.38.200 (Outdoor Storage) of the Anaheim Municipal Code.

2. The operation of the outdoor storage facility will not adversely affect the
adjoining land uses or the growth and development of the area in which it is proposed to be
located as the outdoor storage area is adjacent to industrial uses and site screened from view
from the public right-of-way. Further, this use is less intensive to the area because it does not
include construction activity for a permanent building on the site.
3. The size and shape of the site for the use is adequate to allow the full development
of the proposed use in a manner not detrimental to the particular area or to the health and safety
because outdoor storage has been established on this site for many years and further the outdoor
storage facility and activities would be screened from view from the public right-of-way.
4. The traffic generated by the proposed use will not impose an undue burden upon
the streets and highways designed and improved to carry the traffic in the area because the
parking demand for this use is the same as a general industrial use permitted in the industrial
zone.
5. The granting of the conditional use permit will not be detrimental to the health
and safety of the citizens of the City of Anaheim because no physical improvements are
proposed and outdoor storage, as proposed, will not have a negative environmental impact.
WHEREAS, the Anaheim Planning Commission has reviewed the proposal and
does hereby find that a previously-approved Negative Declaration in connection with
Conditional Use Permit No. 2006-05137 is adequate to serve as the required environmental
documentation in connection with this request.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby approve Conditional Use Permit No. 2006-05137A.
BE IT FURTHER RESOLVED that the Anaheim Planning Commission does
hereby amend, in their entirety, the conditions of approval adopted in connection with Planning
Commission Resolution No. PC2007-15, approving Conditional Use Permit No. 2006-05137, to
read as stated in Exhibit “B” attached hereto and incorporated herein by this reference, which
conditions are hereby found to be a necessary prerequisite to the proposed use of the subject
property in order to preserve the health, safety and general welfare of the citizens of the City of
Anaheim. Extensions for further time to complete conditions of approval may be granted in
accordance with Section 18.60.170 of the Anaheim Municipal Code. Timing for compliance
with conditions of approval may be amended by the Planning Director upon a showing of good
cause provided (i) equivalent timing is established that satisfies the original intent and purpose of
the condition (s), (ii) the modification complies with the Anaheim Municipal Code and (iii) the
applicant has demonstrated significant progress toward establishment of the use or approved
development.
BE IT FURTHER RESOLVED that this permit is approved without limitations
on the hours of operation or the duration of the use. Amendments, modifications and revocations
of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit
Approval) and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Anaheim
Municipal Code.

PROPOSAL:
The applicant requests approval to construct a 174-unit residential project
consisting of 62 detached residences and 112 attached residences. The site is comprised of two
parcels that are separated by Melrose Street (a public street).
Parcel J would contain 62 detached residences and a private park for the residents. These
residences would be on individual lots, averaging 2,811 square feet, and would have zero lot-
lines, meaning the exterior wall on one side of the house would be located at a side property line.
These units would have no common walls and each unit would have exclusive use yards and
contain a 2-car garage with vehicular access from a private alley.
Parcel K is comprised of eight, 2-story auto court buildings. These buildings would wrap around
an internal auto court with garage access, and the front doors to most of the units would be
oriented outward towards streets or paseos. Each building would have 16 units. Please refer to
the attached project summary chart (Attachment No. 5) to the staff report for project details.
ANALYSIS:
Following is staff’s analysis and recommendations on the requested project.
Revised Tentative Tract Map: With respect to Parcel J, the revised tentative tract map
indicates a 70-lot subdivision, consisting of 62 residential lots (one for each home) and 8 lettered
lots (park and alleys), to allow for the future construction of 62 detached single-family
residential units. With respect to Parcel K, the map indicates a 12-lot subdivision, consisting of
8 residential lots (one lot for each building) and 4 lettered lots (park and alleys), to allow for the
future construction of 112 condominium units. The proposed subdivision, including its design
and improvements, is consistent with the low medium density residential land use designation of
the Anaheim General Plan; therefore, staff supports the tentative tract map request.
Density Bonus: The property is zoned RM-3, which permits a density of up to 18 dwelling units
per gross acre or 171 units for this property. The applicant proposes 174 condominium units at a
density of 18.3 dwelling units per gross acre. The applicant applied for a density bonus to permit
a higher density than allowed in the RM-3 zone. The applicant will enter into an Affordable
Housing Agreement with the Anaheim Housing Authority which would require a minimum of
10% of the units (18 units) to be affordable to low income households.
Section 65915 of the State Government Code requires cities to allow certain development
incentives, including density bonuses and reduced parking requirements, for housing
developments that provide housing for very-low, low, and moderate income households. The
Anaheim Zoning Code is consistent with and implements these State requirements. A project
with a minimum of 10% of units affordable to low income households would qualify for a 20%
density bonus, allowing up to 205 units on this property. The proposed 174 unit affordable
residential project is well within the maximum density allowed by these density bonus
provisions.
The 2006-2014 Housing Element identifies the project site as a Housing Opportunity Site having
a density range between 18 and 36 units per acre. Based on this density, the Housing Element

WHEREAS, this property is currently vacant and is located in the RM-3 (Multiple
Family Residential) zone. The Anaheim General Plan designates this property for Residential
Low-Medium land uses; and
WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on April 26, 2010, at 3:30 p.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60 “Procedures”, to hear and consider evidence for and against said
proposed conditional use permit and to investigate and make findings and recommendations in
connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports offered at said
hearing, does find and determine the following facts:
1. The proposed residential project is properly one for which a conditional use
permit is authorized under Code Section 18.06.160.
2. The proposed residential project will not adversely affect the adjoining land uses,
or the growth and development of the area in which it is proposed to be located. The proposed
use and density is consistent with the contiguous condominium project to the south, which was
constructed at a density of 24 to 27 dwelling units per acre (Portion A - 24 du/ac; Portion B - 27
du/ac).
3. The size and shape of the site proposed for the residential project is adequate to
allow the full development of the proposed use in a manner not detrimental to either the
particular area or health and safety because there will be adequate parking, recreational areas,
privacy, and landscaping to accommodate the proposed density.
4. The traffic generated by the proposed residential project use will not impose an
undue burden upon the streets and highways designed and improved to carry the traffic in the

area because the project has been designed to accommodate the required on and off site parking,
vehicular circulation, and trash collection.
5. The applicant applied for a density bonus to permit a higher density than allowed
in the RM-3 zone. This zone permits a density of up to 18 dwelling units per gross acre or 171
units for this property. A project with a minimum of 10% of units affordable to low income
households would qualify for a 20% density bonus, allowing up to 205 units on this property.
The applicant proposes 174 semi-attached single-family condominium dwelling units at a density
of 18.3 dwelling units per gross acre. The applicant is required to enter into an Affordable
Housing Agreement with the Anaheim Housing Authority which requires a minimum of 10% of
the units (18 units) to be affordable to low income households. The proposed 174 unit affordable
residential project complies with the density bonus requirements set forth in Section
18.52.040.060 of the Code.
6. The applicant applied for a density bonus application requesting a parking
incentive pursuant to State Law. A total of 336 on-site parking spaces and 102 off-site parking
spaces along the new public streets, for a total of 438 spaces, are proposed within the
subdivision. State Law requires parking incentives to be granted for projects that provide a
minimum of ten percent of the project as affordable units. Eighteen units within the
development (10 percent of this project) would be affordable for families of low income;
therefore, the project would qualify for the parking reduction permitted by State Law. A total of
359 spaces are required for this project under this State Law provision, resulting in 23 spaces less
than required by Code. However, since an additional 102 off-site spaces will be provided within
the project area, the overall amount of parking provided will be sufficient to accommodate this
residential project.
7. As authorized under Code Section 18.06.160, the applicant requests a
modification to RM-3 zone development standards pertaining to maximum coverage, minimum
front setbacks, and building to building setbacks. These modifications can be justified since the
amount of recreational space exceeds Code requirements (60,900 s.f. required; 118,052 s.f.
proposed), the buildings are well articulated, and the facades are embellished with attractive
façade treatments such as decorative front porches.
WHEREAS, the Anaheim City Planning Commission has reviewed the proposal
and does hereby find that the Negative Declaration in connection with Conditional Use Permit
No. 2009-05485 is adequate to serve as the required environmental documentation in connection
with this request.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission, for
the reasons hereinabove stated does hereby approve Conditional Use Permit No. 2010-05485 to
construct a 174 unit affordable residential project with a deviation in zoning development
standards on property located at 410 – 418 East Santa Ana Street as requested by the applicant.
BE IT FURTHER RESOLVED, that amendments, modifications and revocations
of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit
Approval) and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Anaheim
Municipal Code.

BE IT FURTHER RESOLVED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of
any court of competent jurisdiction, then this Resolution, and any approvals herein contained,
shall be deemed null and void.
BE IT FURTHER RESOLVED that timing for compliance with conditions of
approval may be amended by the Planning Director upon a showing of good cause provided (i)
equivalent timing is established that satisfies the original intent and purpose of the condition(s),
(ii) the modification complies with the Anaheim Municipal Code and (iii) the applicant has
demonstrated significant progress toward establishment of the use or approved development.
BE IT FURTHER RESOLVED that approval of this application constitutes
approval of the proposed request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal regulations. Approval does not
include any action or findings as to compliance or approval of the request regarding any other
applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all
charges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice. Failure to pay all charges shall result in the revocation of the
approval of this application.

approve Tentative Tract Map 17333 to establish a 57-lot attached single family residential
subdivision, consisting of 43 residential lots and 14 lettered lots (park and alleys), to allow for
the future construction of 182 condominium units, for that certain real property situated in the
City of Anaheim, County of Orange, State of California, as more particularly described in
Exhibit “A” attached hereto and incorporated herein by this reference; and
WHEREAS, this property is currently vacant and is located in the RM-3 (Multiple

County of Orange, State of California, as more particularly described in Exhibit “A” attached

WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on April 26, 2010, at 3:30 p.m. notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
