2005-207RESOLUTION NO. 2005 - 201 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING GENERAL PLAN AMENDMENT N0. 2004-00420, PERTAINING TO THE LAND USE ELEMENT AND CIRCULATION ELEMENT (GPA TRACKING N0.2005-00432) WHEREAS, on May 25, 2004, the City Council, by its Resolution No. 2004-95, adopted a comprehensive update to the General Plan for the City of Anaheim; and WHEREAS, the Anaheim City Planning Commission has duly initiated General Plan Amendment No. 2004-00420, Zoning Code Amendment No. 2004-00036, Amendment to The Platinum Triangle Master Land Use Plan (Misc. Case No. 2004-00089}, Amendment to The Platinum Triangle Standardized Development Agreement (Misc. Case No. 2005-00114), and Miscellaneous Case No. 2005-001 ] 5 to rescind in-part Resolution No. 2004-180 and Reclassification No. 2004-00134, pertaining to The Platinum Triangle; and WHEREAS, pursuant to Chapter l 8.68 of the Anaheim Municipal Code, provisions of the General Plan may be amended whenever the public necessity and convenience and the general welfare require such amendment when adopted by a resolution of the City Council in the manner prescribed by law; and WHEREAS, on August 22, 2005, the Anaheim City Planning Commission did hold a public hearing to consider a General Plan Amendment, designated as General Plan Amendment No.2004-00420, notice of said hearing having been duly given as required by law and in accordance with the provisions of Chapter l 8.60, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, the General Plan Amendment No. 2004-00420 proposes to amend the Land Use and Circulation Elements of the General Plan, as follows: 1. Land Use Element. (a) Amend "Figure LU-4" of the Land Use Element of the General Plan to re-designate a 3.21-acre property, shown as the darker shaded area on the attached map marked as Exhibit "A" and incorporated herein by this reference, located at the southeast corner of Orangewood Avenue and Rampart Street and further identified as 2400 East Orangewood Avenue ("North Net Fire Training Center") from the Office-High to the Mixed-Use land use designation. (b) Amend the Land Use Plan Map, Table LU-4, of the Land Use Element of the General Plan (relating to General Plan Density Provisions for Specific Areas of the City) to provide for an additional 325 dwelling units and up to 210,100 square feet of additional commercial square footage in The Platinum Triangle Mixed-Use land use designation, as follows: "TABLE LU-4: GENERAL PLAN DENSITY PROVISIONS FOR SPECIFIC AREAS OF THE CITY Location General Plan Land Use Designations Permitted Density The Mountain Low Medium Hillside Density Residential 485 Parr Area (Up to 6 dulac) Low Medium Density Residential 2,015 (Up to 16 dulac) (Up to 2,500 dwelling units) Area "A" (Parcel Map Low-Medium Density Residential Up to 140 dwelling units 94-205) The Disneyland Commercial Recreation See Note No. 1 on next page. Resort Specific Plan (SP 92-1 j Area The Anaheim Commercial Recreation See Note No. 2 on next page. Resort0 Specific Plan (SP 92-2) Area Hotel Circle Commercial Recreation The Hotel Circle Specific Plan allows for Specific Plan a master planned hotel project including (SP 93-1) Area up to 969 hotel rooms and integrated guest oriented amenities including full-service restaurants, conference roomlbanquet facilities, pool and spa areas, tour buslshuttle facilities, and pedestrian promenades and plaza areas with comprehensive landscaping. The Platinum Mixed-Use Up to 9,500 dwelling units at densities up Triangle Area to 100 dwelling units per acre; up to 3,265,000 s.f. of office development at maximum FAR of 2.00; and, up to 2,254,400 s.f. of commercial development at a maximum FAR of 0.40. Office-High and Office-Law Up to 1,735,000 s.f. of office development at a maximum FAR of 2.0 for properties designated Office-High and a maximum FAR of 0.50 for properties designated Office-Low." 2 2 Circulation Element. (a) Amend the Planned Roadway Network Map, Figure C-l, of the Circulation Element of the General Plan to re-designate a portion of Cerritos Avenue between State College Boulevard and Douglass Road from a Primary Arterial Highway to a Secondary Arterial Highway designation, consistent with the Orange County Master Plan of Arterial Highways and respective lane conEgurations. (b) Amend the Planned Roadway Network Map, Figure C-1, of the Circulation Element of the General Plan to provide for Gene Autry Way between Betmor Lane and State College Boulevard to be up to l 15 feet in width. This segment of Gene Autry Way is designated as a Primary Arterial Highway with a current typical width of up to 106 feet. WHEREAS, at said public hearing, the Anaheim City Planning Commission did adopt its Resolution No. PC2005-120 containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that General Plan Amendment No. 2004-00420 be adopted by the City Council; and WHEREAS, the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use and Circulation Elements of the General Plan to re-designate a 3.21-acre property from the Office-High to the Mixed-Use land use designation, to increase the number of dwelling units and the square footage of commercial development in The Platinum Triangle, and re- designate and provide for the widening of certain street segments; and did recommend, by its resolution, that the City Council, based on its independent review of the Initial Study prepared in connection with the proposed General Plan Amendment No. 2004-00420, and the requirements of California Environmental Quality Act ("CEQA"),including Section 21166 of the California Public Resources Code and Section 15162 of the CEQA Guidelines, and unless additional or contrary information is received during the public meeting, find and determine that FSEIR No. 332, including the Statement of Findings of Fact and Statement of Overriding Considerations and Updated and Modified Mitigation Monitoring Program No. 106A for The Platinum Triangle, as revised to add new mitigation measure MM 5.10-7, are adequate to serve as the required environmental documentation for the proposed Amendment and satisfy all the requirements of CEQA; and that no further environmental documentation need be prepared for the proposed General Plan Amendment; and WHEREAS, upon receipt of said Resolution No. PC2005-120, summary of evidence, report of findings and recommendations of the Anaheim City Planning Commission, the City Council did fix the 27th day of September, 2005, as the time, and the City Council Chamber in the Civic Center as the place for a public hearing on said proposed General Plan Amendment No. 2004- (10420 and did give notice thereof in the manner and as provided by law; and 3 EXHIBIT A MIXED-USE ACRES 3.2 MIXED-USE 1 1 V Q y~ =i, 0 %/ ~~ WHEREAS, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and did consider the recommendations of the Anaheim City Planning Commission; and WHEREAS, the City Council does find and determine that General Plan Amendment No.2004-00420, as described above, should be approved, and that the evidence presented shows that all of the conditions exist as set forth in Subsection .030 of Section l $.6$.050 of the Anaheim Municipal Code; and WHEREAS, pursuant to the provisions of the California Environmental Quality Act ("CEQA"j, the City Council, as lead agency for the General Plan Amendment, by its resolution, did find and determine, based upon its independent review and consideration of an Initial Study conducted pursuant to CEQA for General Plan Amendment No.2004-00420, and the requirements of CEQA, including Section 21166 of the California Public Resources Code and Section 15162 of the CEQA Guidelines, and the evidence received at the public hearing, that FSEIR No. 332, including the Statement of Findings of Fact and Statement of Overriding Considerations and Updated and Modified Mitigation Monitoring Program No. 106A for The Platinum Triangle, as revised to add new mitigation measure MM 5.10-7, are adequate to serve as the required environmental documentation for said amendment and satisfy all of the requirements of CEQA, and that nn further environmental documentation need be prepared for this General Plan Amendment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Amendment No. 2004-00420 to the General Plan be, and the same is hereby, approved.
