RESOLUTION NO. 75R-481
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2724.
WHEREAS, after a request for variance by Brigham Young
University, owner; Matreyek Homes, Inc., agent, was received, a
public hearing before the Planning Commission of the City of
Anaheim was held upon due and proper notice as a result of which
Variance No. 2724 was granted, covering the following described
property:
Those portions of the Southeast quarter of the
Southwest quarter of Section 5, Township 4 South,
Range 10 \vest J in the Rancho Los Coyotes, .as shown
on a map recorded in book 51, page 10, Miscel-
laneous Maps, records of Orange County, California,
described as follows:

46 to 48 inclusive, Miscellaneous Maps, records of
said Orange County, said point of beginning also
being a point in the Southerly line of the land

WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance
be, and the same 1s hereby, granted to construct 'a 224.-1ot,
212-unit, multiple-family, residential development with
waivers of the fOllowing sections of the Anaheim Municipal
Code:
SECTION 18.01.130 -
Requirement that all lots front
on a public street. (188 lots
do not have frontage of a public
street)
SECTION l8.32.o63.023-Minimum side yard setback. (5
feet required; 0 feet proposed.)
That said variance be granted subject to the following conditions:
1. That this Var1ance 15 granted subject to the
completion of Reclassification No. 73-74-36.
2. That the residential lot lines, except those
abutting a common lot, shall be a minimum of three (3) feet from
the proposed attached residential structures, as stipulated to by
the petitioner.
3. That automatic garage door openers shall be
