1975-413 .~ RESOLUTION NO. 75R-4l3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2711. ~ WHEREAS, after a request for variance by Arden D. Strand, owner, was received, a public hearing before the Planning Commission of the City of Anaheim was'held upon due and proper notice as a result of which Variance No. 2711 was granted in whole, covering the following described property: The Westerly 3.00 acres of those portions of Blocks 24 and 25 of the Golden State Tract, in th'e' City of Anaheim, County of Orange, State of California, per map recorded in book 4, pages 66 and 67 of Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the intersection of the Southeasterly line of said Block 24" with a line 184.00. feet South- easterly from and parallel with that certain course cited as having a bearing of South 80 25' 46" West and a length of 1019.70 feet in the centerline of that certain strip of land, 115.00 feet wide, described as "Parcel No. E2-105.01" in the deed to the Orange County Flood Control District, recorded October 11, 1960 in book 5455, page 535, Official Records; the.nee Southwest- erly along said parallel line to the Southeasterly line of the land described in Parcel 1 in the deed to Holly Wade Davidson, recorded March 18, 1955 in book 3000, page 254, Official Records; thence 'Northeasterly along said Southeasterly line to the most Easterly corner of the land described in the deed to Holly Wade Davidson, recorded April 4, 1968 in book 8563, page 67, Official Records; thence along the boundary of said land North 300 13' 21" West 177.30 feet and South 740 32' 28" West 45.75 feet to a point in the Southerly line of the land described in the deed to the State of California, recorded June 4, 1963 in book 6573, page 167, Official Records; thence along said Southerly line, South 740 32' 28" West 46.49 feet to the beginning of a tangent curve concave Northerly having a radius of 471.99 feet; thence Westerly along said curve and along said Southerly line to the intersection of said curve' with said parallel line; thence Southwesterly along said parallel line to the point of beginning. The Easterly line of said Westerly 3.00 acres to be para11e1 w~th that port~on of the Easterly line of the land described above, having a bearing of North 300 13' 21 n vlest. WHEREAS, thereafter, within the time prescribed by law an interested. party orthe City Council on its own motion caused. "the review of sa"ld Planning Commiss'ion action at a public hearing noticed and held as presc'ribed by law and as a result thereof the City.Counci1 does hereby make the following findings: ...- ~ 1. That there are special circumstances applicable 'to the property, includi~g size, ah'ape, topography, location or surroundipgs, which "do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by, other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim~ that a conditional zoning variance be, and the same is hereby, granted, permitting the construc- tion of an 86-unit apartment complex on the aforedescribed property with waivers of the fOllowing sections or the Anaheim Municipal Code: S"ECTION 18. 34.062'.012 - Maximum Building height within 150 feet of an agricultural zone (I-story permitted; 2 stories proposed). SE"GTION "18. 34.0'62" .,032 - Minimum floor area (700 square feet required; 12 units with floor areas of 550 square feet proposed) . S"EC'TION 18. 3"4.065. '011 - Minimum distance between buildings (26 feet required; 10 feet and 17 fe~t proposed). that this variance be granted, SUbject to the following conditions: 1. That this Variance is granted SUbject to" the completion of Reclassification No. 74-75-42. 2. That the interior walls of the proposed carports shall be stuccoed, that enclosed storage cabinets shall be provided along the rear wall of each "carport, and that adequate bumper guards shall be provided to protect the interior walls of the proposed carports from damage. That the subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 through 7; provided, however, that a six (6) foot masonry wall shall be constructed alo~g the east, south and west property lines, ,said wall to be earth-toned~ and non-typical along the west property line~ as stipUlated to by the petitioner. 4. That the SUbject property shall be developed in accordance with the HUD minimum requirements for sound attenua- tion to achieve a minimum noise level of 65 dbA in th'e private recreational-leisure areas of the units adjacent to the freeway and 45 dbA inside the units (with doors and windows .closed), as stipulated to by the petitioner. 5. That Conditions Nos. 2, 3, and 4, above-mentioned~ shall be complied with prior to the commencement of the "activity authorized under this resolution, or prior to th.e" t"ime that the building permit is issued~ or within a period of one (1) year from date hereof, whichever occurs first, or such further time as the Planning Commission and/or City Council" may grant. 6. That Conditions Nos. 2~ 3~ and 4~ above-mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that "the City. Council hereb.y reserves the right to revoke such variance permit tor good cause or tailure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulati"ons and the conditions herein. Said variance ~s granted for the term prescribed by the Anaheim Municipal Code unles's. otherwise speci- fied herein.
