A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAIIElrl FINDING AND DETERMINING TnAT TITLE
18 OF THE Ai.'lAHElr.1 ~1UNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
~IEREAS, the City Planning Commission of the City
of Anaheim did hold a public hearing in ~c1assification Pro-
ceedings No. 74-7~-42 to consider an amendment to Title 18 of
the Anaheim ~unic1pa1 Code relating to zoning, and to consider
a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff; .
and
MIEREAS, within a period of forty days fo1lowinq said
hearing, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the eviuence
presented at said hearing, and a recomnendation that the proposed
amendment be adopted by the City Council and that a certain zone
or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City council did fix the 5tb~_ day of
August , 19~, and continued to the day or--- ,
19 , as the time, and the City Counc11 Chambers in the City
Hall of the City of Anaheim as the place for a public hearing
upon said proposed amendment to Title 18 of the Anaheim Municipal
Code, and the exclusion of said property, hereinafter described,
fron the zone or zones in which it is now situated and the incor-
poration thereof in the zone or zones hereinafter set forth, and
did give notice thereof in the manner and form provided in said
Title 18 of the Anaheim Municipal Code: and
lflIEREhS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereupon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings and
recommendation; and
l~IEREAS, the City Council does find and determine that
the amendment to Tit1e 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated
and incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:
The Westerly 3.00 acres of those portions of Blocks
24 and 25 of the Golden State Tract, in the City of
Anaheim, County of Orange, State of California, .per
map recorded in book 4, pages 66 and 67 of Miscellaneous
Maps, records .of said Orange County, described as
follows:
Beginning at the intersection of the Southeasterly
line of said Block 24 with a line 184.00 feet South-
easterly from and parallel with that certain course
cited as having a bearing of South 80 25' 46" West and
a length of 1019.70 feet in the centerline of that
certain strip of land, 115.00 feet wide, described as
"Parcel No. E2-105.01" in the deed to the Orange County
Flood Control District, recorded October 11, 1960 in
book 5455, page 535, Official Records; thence Southwest-
erly along said parallel line to the Southeasterly line
of the land described in Parcel 1 in the deed to Holly
Wade Davidson, recorded March 18, 1955 in book 3000,
page 254, Official Records; thence Northeasterly along
said Southeasterly line to the most Easterly corner of
the land described in the deed to Holly Wade Davidson,
recorded April 4, 1968 in book 8563, page 67, Official
Records; thence along the boundary of said land North 300
13' 21" West 177.30 feet and South 740 32' 28" West
45.75 feet to a point in the Southerly line of the land
described in the deed to the State of California,
recorded June 4, 1963 in book 6573, page 167, Official
Records; thence along said Southerly line, South 740 32'
28" West 46.49 feet to the beginning of a tangent curve
concave Northerly having a radius of 471.99 feet; thence
\iesterly along said curve and along said Southe"rly line
to the intersection of said curve with said parallel
line; thence Southwesterly along said parallel line to
the point of beginning.
The Easterly line of said Westerly 3.00 acres to be
parallel with that portion of the Easterly line of the
land described above, having a bearing of North 300 13'
21" West.
be excluded from the "RS-A-43,OOO" RESIDENTIAL/AGRICULTURAL
ZONE, and incorporated in the "RM-1200" RESIDENTIAL/MULTIPLE-
FAMILY ZONE, SUbject to the following conditions:
1. That all engineering requirements of the City
of Anaheim, along Frontera Street, including preparation
of improvement plans and installation of all improvements
such as curbs and gutters, sidewalks, street grading and
paving, drainage facilities, or other appurtenant work shall
be complied w1th as required by the Clty Engineer and In
accordance with standard plans and specifications on file in
the Office of the City Engineer; and that a bond in an amount
and fo'rm satisfactory to the City of Anaheim shall be post"ed
with the City to guarantee the installation of the above-
mentioned requirements.
2. That the owner(s) of subject property shall
pay to the City of Anaheim the sum of 60 cents per front foot

3. That trash storage areas shall be provided. in
accordance with approved plans on file with the Office of the
Director of Public Works.
4. That fire hydrants shall be installed and
charged as required and determined to be necessary by the
Chief of the Fire Department prior to commencement of structural
framing.
5. That the subject property shall be served by
underground utilities.
6. That drainage or the subject property shall be
disposed of in a manner satisfactory to the City Engineer.
7. That in the event the subject property is to
be divided for the purpose of sale, lease or financing, a parcel
map to record the approved division of subject property shall
be submitted to and approved by the City of Anaheim and then
be recorded in the Office of the Orange County Recorder.
8. That the owner(s) or the subject property shall
pay to the City of Anaheim the appropriate park and recreation
in-lieu fees, as determined to be appropriate by the City Council,
said fees to be paid at the time the building permit is issued.
9. That a six (6) foot masonry wall shall be
constructed along the east, south and west property lines, said
wall to be earth-toned and non-typical along the west property
line, as stipulated to by the petitioner.
10. That the subject property shall be developed in
accordance with the minimum requirements of HUD for sound attenua-
tion to achieve a minimum noise level of 65 dbA in the private
recreational-leisure areas of the units adjacent to the freeway
and 45 dbA inside the units (with windows and doors closed), as
stipulated to by the petitioner.
11. That prior to the introduction of an ordinance
rezoning subject property, Conditions Nos. 1, 2 and 7, above-
mentioned, shall be completed. The provisi"ons or rights granted
by this "resolution shall become null and void by action of the
City Council unless said conditions are complied with within one
(1) year from the date hereof, or such further time as the City
Council may grant.
12. .That Conditions Nos. 3, 5, 6, 9 and 10, above-
mentioned, shall be complied with prior to final building and
zoning inspections.
BE IT FURTHER RESOLVED that the Ci"ty' Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 5th day of August, 1975.
