RESOLUTION NO. 75R-3AR
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAIIEI11 FINDING AND DETERMINING TnAT TITLE
18 OF TIlE ANAHEIl.1 MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
MIEREAS, the City Planning Commission of the City
of Anaheim did hold a public hearing in ~c1assification Pro-
ceedings No. 74-7~-40 to consider an amendment to Title 18 of
the Anaheim Munic~pal Code relating to zoning, and to consider
a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff; .
and
MIEREAS, within a period of forty days following said
hearinq, the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that a certain zone
or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 22nd day of
July , 19 75, and continued to the day of ,
19 , as the time, and the City Counc11 Chambers in the C1ty
Harr-Qf the City of Anaheim as the place for a public hearing
upon said proposed amendment to Title 18 of the Anaheim Municipal
Code, and the exclusion of said property, hereinafter described,
fron the zone or zones in which it is now situated and the incor-
poration thereof in the zone or zones hereinafter set forth, and
did give notice thereof in the manner and form provided in said
Title 18 of the Anaheim Municipal Code; and
lfliEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereupon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings and
recommendation; and
t*IEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be e~cluded from the zone or zones in which it is now situated
and .incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

Range 9 West, in the Rancho Santiago de Santa
Ana, being also a portion of the land allotted
to Paula Peralta de Dominguez, as described in
the final decree of partition of the Rancho
,Santiago de Santa Ana, which was entered
September 12, 1868 in Book "B", page 410 ot
Judgments of the District Court of the 17th
Judicial District in and for Los Angeles .County,
California, described as follows:
Parcell as shown on a Map filed in Book 57,
pages 6 and 7 of Parcel Maps, records of Orange
County, California.
be excluded from "RS-A-43,OOO" (SC) RESIDENTIAL/AGRICULTURAL,
SCENIC CORRIDOR OVERLAY ZONE, and incorporated in "CO" (SCl
COMMERCIAL, OFFICE AND PROFESSIONAL, SCENIC CORRIDOR OVERLAY
ZONE, subject to the fOllowing conditions:
1. That trash storage areas shall be prOVided in
accordance with approved plans on file with the .Office of
the Director of Public Works.
2. That fire hydrants shall be installed and
charged as required and determined to be necessary by the
Chief of' the Fire Department prior to commencement of struc.tur-
al framing.
3. That subject property shall be .served by under-
ground utilities.
4. That drainage of said property shall b~ disposed
of in a manner satisfactory to the City Engineer. Ir~ in the
preparation of the site, sufficient grading is required to
necessitate a grading permit, no work on grading will be permitted
between October 15th and April 15th unless all required off-site
drainage facilities have been installed and are operative.
Positive assurance shall be provided the City that such drainage
facilities will be completed prior to October 15th. Necessary
right-or-way for off-site drainage facilities shall be dedicated
to the City, or the City Council shall have initiated condemna-
tion proceedings therefor (the costs of which shall be borne by
the developer) prior to commencement of grading operations. The
required drainage facilities shall be of a size and type suffi-
cient to carry runoff waters originating from higher properties
through said property to ultimate disposal as approved by the City
Engineer. Said drainage facilities shall be the first item of .
construction and shall be completed and be functional throughout
the tract and from the downstream boundary of the property to the
ultimate point of disposal prior to the issuance of any final
building inspections or occupancy permits. Drainage district
reimbursement agreements may be made available to the developers
of said property upon their request.
5. That grading, excavation, and all other
construction activities shall be conducted in such a manner so
as to minimize the pOSSibility of any silt originating from

6. That appropriate water asses.sment fees, as
determined by the Director of Public Utilities., shall be paid
to the City of Anaheim prior to the issuance of a building
permit.
7. That street lighting facilities along Nohl
Ranch Road shall be installed as required by the Director of
Public Utilities, and in accordance with stand~rQ plans, and
snecifications on file in the Office, of the .Direc"tor of ,Public
Utilities and that a bond in an amount and form sat1srac~ory
to the City of Anaheim shall be posted with .th~ .City to
guacrantee the.. installation: of th~ above-:ment~on~d requirements.
8., That sub.Ject property .shall be cieveiope~u
sup~~~nt~ally iri accordance with plans and,~peciric~~ion~ on
file with the City qf Anahe1.m marked Exhibits NC?f? 1 and 2;
provided, however, that the proposed structures shall be
constructed with ~pan~sh tl1e:roofs, ~s stlp~lated to by the
petitioner, and .that no left turns shall be allowed into the
proposed employee parking lot ~off Noql Ra.t'\ch ~'Road unles's a
left-turn pocket to facilitate left turns shall be provided. in
accordance with a design appr~ved by ,the qity Engin~~r.
9. Prior to the introduction of an ordinance
rezoning sUbject property, Condition LNo. 7, above-mentioned,
shall be co;mpleted.. The provision.s ,or right.s granted by
this reso'lution shall b.ecome null and. void by action of the
City Council unless said.conditlons are compi1eq w~~~'~*yh1n
one year from the date hereof, or such further time as' the
City Council may grant.
10.' That Conditions Nos. 1, 3, 4, 5 and- 8, above-
mentioned, shall be complied with prior to final building
and zoning inspections.
l~. That ~he construction of the block wall along
the northerly property. line is not necessary or desirable d:ue
to conditions of topography.
BE IT FURTHER RESOLVED that the .City. Attorney be, and
he is hereby authorized and directed to prepare. and submit to
the City Council an ordinance amending Title .18,",or the Anaheim
Municipal Code to accomplish the objects herein round and
determined to be necessary and proper.
