RESOLUTION NO. 75R-383
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2706.
~nlEREAS, after a request for variance by Joseph D.
Huarte, owner, was received, a public hearing before the
Planning Commission of the City of Anaheim was held upon due
and proper notice as a result of which Variance No. 2706 was
granted, in part, covering the following described property:
PARCEL 1: That portion of the Northeast quarter
and the Northwest quarter of Section 7, Township
~ South, Range 9 West, in the Rancho San Juan
Cajon de Santa Ana, in the City of Anaheim, as
per map recorded in book 51, page 10 Miscellaneous
~,1aps, in the office of the County Recorder of said
County, described as follows:
Beginning at the Southwest corner of that certain
property described in Certificate of Title No.
4937, recorded in book 20, page 174, Register of
Titles of Orange County, California, said Southwest
corner being the Northwest corner of that certain
10 foot strip of land described as excepted from
the above mentioned property, and running thence
South along the West line of Section 7, Township
4 South, Range 9 West, San Bernardino Base and
f1er1dlan, 10.00 feet to a line parallel to and
990.00 feet North of the East and West center line
of said Section 7; thence Easterly along said
parallel line, 3502.62 feet, more or less, to an
intersection with the Southwesterly line of the
Golden State Tract; thence Northwesterly, along
said Southwesterly line, to a point which is
distant Southeasterly, measured along said South-
westerly line 558.40 feet from the Westerly corner
of Lot 4, said Golden State Tract, said point
being the Easterly corner of that certain trian-
gular shaped parcel of land described as excepted
from Certificate of Title No. 4936; thence, West
along the Southline of said Triangular parcel
and the Westerly prolongation of said line 267.25
feet, more or less, to an intersection with a line
parallel with and distant 1331.32 feet East of the
West line of said Section 7; thence Southerly
along said parallel line, 1034.50 feet, more or
less, to the Southeast corner of property described
in Certificate of Title No. 4937, said Southeast
corner being Northeast corner of the 10 foot strip
excepted from said property; thence West along the
South line of said property 1331.32 feet to the
Doint of beginning.
EXCEPT all that certain land described as follows:
Beginning at the Southeast corner of that certain
D~onertv described in Certificate of Title No.
10.00 feet strip of land described as excepted
from the above mentioned property; thence South 00
09' 20" West, 10.00 feet to a point in a line
parallel to and 990.00 feet North of the East and
West centerline of Section 7, Township 4 South,
Range 9 West; thence North 890 51' 100 East, along
said parallel line, 2171.29 feet, more or less, to
an intersection with the Southwesterly line of the
Golden State Tract; thence North 610 17' 25" West
along said Southwesterly line, 1555.91 feet, more
or less, to a point in the Southerly line of future
Jackson Street, said point lies in a curve concave
Northeasterly, having a radius of 632.00 feet, a
radial line to said point bears South 190 36' 36"
~1est; thence Northwesterly along said curve, through
a central angle of 00 30' 25", an arc length of
5.59 feet, to a point in a reverse curve concave
Southerly, having a radius of 568.00 feet; thence
Westerly along said curve, through a central angle
of 200 15' 51" an arc length of 200.88 feet; thence
continuing along said South line and the Westerly
prolongation thereof, South 8go 51' 10" West,
612.97 feet, to a point in a line parallel with and
distant 1331.32 feet East of the West line of said
Section 7; thence South 00 09' 20" West, along
s~1d parallel line 774.17 feet to the point of
beginning.
PARCEL 2: That certain parcel of land located
in the County of Orange, State of California,
shown as Parcel 1 in Parcel Map filed in book 11,
page 16, in the office of the County Recorder of
said County.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
pUblic hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the fOllowing
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance
be, and the same 1s hereby, granted, in part, permitting a
56-unit apartment complex with waivers of the fallowing
sections of the Anaheim Municipal Code:
SEC"TION 18.34.066.012 - r.1inimum number of parking spaces
(54 enclosed spaces required; 54
partially enclosed spaces proposed).
That said variance be granted, in part, subject to the follow-
ing conditions:
1. That this variance is granted, in part, subject
to the completion of Reclassification 'No. 74-75-36.
2. That steps shall be taken by the developer to
insure that the noise level generated by the adjacent freeway
traffic shall not exceed 65 dba in the private recreation-
leisure areas of the units adjacent to the freeway and 45 dba
inside the units with the windows and doors close'd, said st'aps
to be indicated on plans sub~tted f~r build~ng permits.
3. That sUbject property shall be develqped substan-
ti:ally 1.n accordance wi th plans and specifications on file wi th
the City of Anaheim marked Exhibits Nos. 1 through 4.
BE IT FU~THER RESOLVED that the City Council hereby
reserves the right'to revoke such :variance permit for good
cause or failure of said owner, his heirs, successors or assigns
to comply with the Anaheim"Municipal Code 'and regulations and
the conditions herein. Said vari~nce is granted, in part, for
the term prescribed by the 'Anaheim Municipal Code unless other-
wise specified herein.
