REQUEST: The applicant requests approval of a conditional use permit for an Automotive-Vehicle Sales, Lease, and Rental facility for a Tesla Dealership and showroom in an existing movie theater building. The applicant also requests approval of a minor conditional use permit to modify existing electronic readerboard signs. RECOMMENDATION: Staff recommends that the Planning Commission find and determine that a Class 1 – Existing Facilities Categorical Exemption under the California Environmental Quality Act (CEQA) (Public Resources Code, Sections 21000-21189.57) as set forth in Sections 15301 and 15300.2 of the State CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3, Sections 15000-15387) is the appropriate environmental documentation for this request; and adopt the attached resolution approving Development Application No. 2022-00073. BACKGROUND: This 5.52 -acre property is developed with an existing movie theater, commercial building, and drive through restaurant. The property is in the "SP 2015-1" Anaheim Canyon Specific Plan, and the General Plan designates the property for General Commercial land uses. Surrounding land uses include a bank, church, and manufacturing use to the west, multi-family residential across Orangethorpe Avenue to the north, a commercial center and bank to the east, and a commercial center across La Palma Avenue to the south. In 1987, the Planning Commission approved Conditional Use Permit No. 2905 to permit a movie theater complex. In 2009, the Planning Commission approved Conditional Use Permit No. 2008-05372 and Variance No. 2009-04796 to permit a 10,000 square foot commercial building on the property with fewer parking spaces than required by the Anaheim Municipal Code (“Code”). In 2013, the Planning Commission approved an amendment to the conditional use permit and variance allowing a 4,875 square foot commercial building and a 3,900 square foot drive-through restaurant. In 2016, the Planning Commission approved the refurbishment of an existing freestanding pylon sign to include a new electronic readerboard display. In 2017, the Planning Commission approved Conditional Use Permit No. 2016-05893 to permit a wall-mounted electronic readerboard sign. Development Application No. 2022-00073 February 27, 2023 Page 2 of 6 PROPOSAL: The applicant proposes to operate an Automotive-Vehicle Sales, Lease, and Rental vice facility for a Tesla dealership in the existing movie theater building. The applicant proposes interior tenant improvements to construct a showroom, customer lounge, a double lane wash bay, designated vehicle drop-off bay, auto repair area, and a warehouse. The site would undergo minimal exterior improvements primarily related to ADA accessibility. Exterior building improvements include enhancements to the façade with modern contemporary materials and colors and new vehicle roll-up doors for the different operational uses within the building. The metal- seamed roof would be painted in a darker color than building walls, and a new squared tower element would be constructed to replace the existing turret and would be painted red. Overall, the massing of the building would remain the same. PROPOSED SOUTH ELEVATION Tesla’s hours of operation for the dealership and the vehicle service department would be between 7:00 am and 7:00 pm, seven days a week. Standard services would include software updates, tire replacements, replacement of bolt on parts, and battery replacements. Tesla would prepare vehicles for the customers including washing and detailing work all by hand. No automated car washing equipment is proposed with Tesla proposing to wash and detail vehicles by hand. Additionally, no auto body paint work or battery repair (repair to damaged batteries) would take place at this location. Much of the parking surrounding the building and the parking structure is intended for employees and customers visiting the dealership to pick up vehicles. There would be no Tesla electrical charging spaces offered to customers or for public use. Access to the property would remain unchanged from La Palma Avenue, and no changes are proposed to the access to the property to the east. The operator anticipates one or two car haulers would arrive to the site per week and three to five daily standard delivery vehicles to drop off shipments of auto parts and other accessory items. These deliveries would be made using the signalized driveway at La Palma Avenue and would be received along the west side of the building. Development Application No. 2022-00073 February 27, 2023 Page 3 of 6 SITE PLAN PROPOSED FREESTANDING SIGN MODIFICATIONS The applicant proposes aesthetic improvements to two existing electronic readerboard signs. The first is a freestanding sign located at the La Palma Avenue signalized vehicle entry, and the second is a wall mounted sign located on the south wall of the building. Improvements to the freestanding sign would provide for a new Tesla channel letter illuminated sign and the removal of side neon elements. The existing LED screen would remain. Proposed improvements to the wall mounted readerboard sign are comparable to the proposed modifications to the freestanding sign, with the removal of neon accents and an LED screen display attached to the building wall. Development Application No. 2022-00073 February 27, 2023 Page 4 of 6 FINDINGS AND ANALYSIS: Conditional Use Permit/Minor Conditional Use Permit: Before the Planning Commission may approve a conditional use permit or a minor conditional use permit, it must make a finding of fact that the evidence presented shows that all of the following conditions exist: 1) That the proposed use is properly one for which a minor conditional use permit or a conditional use permit is authorized by this code; 2) That the proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located; 3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety; 4) That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 5) That the granting of the minor conditional use permit or conditional use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim. Conditional Use Permit: The Code permits “Automotive-Vehicle Sales, Lease, and Rental Facility” uses in the Anaheim Canyon Specific Plan subject to approval of a conditional use permit. The proposed request would not adversely affect the adjoining land uses or development of the area as the dealership operation is structured in an appointment-based type of service, with minimal daily visits arriving without appointments. The size and shape of the property is adequate to accommodate the proposed use, and the property would provide more parking spaces than are required. Conditions of approval are included in the draft resolution to ensure that the Automotive- Vehicle Sales, Lease, and Rental Facility use will be properly maintained and operated. The granting of the conditional use permit for the use under the conditions imposed would not be detrimental to the health and safety of the citizens of the City of Anaheim. Minor Conditional Use Permit: The Code permits electronic readerboard signs for automotive dealerships subject to the approval of a minor conditional use permit. The site must be at least three acres in size with the auto dealership as the major tenant. The property is 5.52 acres, and Tesla would be the major tenant of the site. This request for a minor conditional use permit would allow for the continued use of the readerboard signs for the automotive dealership. The signs would remain in their current locations adjacent to the La Palma Avenue driveway and on the south elevation of the proposed dealership. Staff believes that, since the readerboard signs are existing and would not be enlarged or modified beyond aesthetic alterations, the signs would not adversely affect the adjoining land uses and would not be detrimental to the health and safety of the citizens of the City of Anaheim. Parking Requirements: The site is developed with surface parking throughout and a multi-level parking structure located at the rear of the property. The Code requires 281 parking spaces for the Tesla dealership and the two restaurant buildings. The applicant proposes 519 parking spaces Development Application No. 2022-00073 February 27, 2023 Page 5 of 6 provided throughout the property including 261 surface spaces, 171 parking structure spaces, and 87 parking spaces located on the adjacent site to the east that are accessible through a reciprocal parking agreement. Environmental Impact Analysis: Staff recommends that the Planning Commission find that the effects of the proposed project are Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1 (Existing Facilities). The Class 1 exemption consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of the use beyond that existing at the time of this determination. The request includes interior improvements to the existing movie theater with minimal exterior improvements and staff does not anticipate that these would result in a significant impact on the environment. Trip generation from the proposed project is less than the previously operating multi-plex movie theater. Additionally, the readerboard signs are existing and would not be enlarged or modified beyond aesthetic alterations, would not adversely affect the adjoining land uses, are not anticipated to cause any detriment to the health and safety of the particular area, and would not impose an undue burden upon the roadways. Therefore, staff has determined that this would be a negligible expansion of the use. Pursuant to Section 15300.2 (c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project would be categorically exempt from the provisions of CEQA. Comments Received: Staff received two public comments on this item included as Attachment 5. One comment is an email from an owner of the Imperial Promenade shopping center which is the adjacent property to the east of the subject property. In this email, the Imperial Promenade property owner describes a private easement and maintenance agreement between the two properties, and asserts that the proposed Automotive-Vehicle Sales, Lease, and Rental use is not permitted under that private agreement. Staff has reviewed the application and determined that the project meets the development standards of the Code and is consistent with the General Plan; therefore, staff recommends approval of the proposed project. CONCLUSION: Staff believes that the Automotive-Vehicle Sales, Lease, and Rental facility at the project site would be compatible with the existing commercial uses in the surrounding area. Additionally, the proposed modifications to the existing electronic readerboard signs for the dealership use would enhance the experience of the patrons of the center in a manner that is compatible with the surrounding uses. The proposed use would be consistent with the zoning and General Plan land use designation for the property, and the project is designed and conditioned to ensure that the Automotive-Vehicle Sales, Lease, and Rental facility would not impact surrounding properties. Based on the analysis included in this report and the findings in the draft resolution, staff recommends that the Planning Commission approve this request. PC2023-*** A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN AUTOMOTIVE-VEHICLE SALES, LEASE, AND RENTAL FACILITY AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH (DEV2022-00073) (5635 East La Palma Avenue) WHEREAS, the Planning Commission of the City of Anaheim (the "Planning Commission") did receive a verified petition to approve a conditional use permit for an Automotive-Vehicle Sales, Lease, and Rental facility (the “Proposed Project”) in conjunction with approval of a minor conditional use permit to modify an existing electronic readerboard signs , on certain real property located at 5635 East La Palma Avenue in the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit A attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS, the Property is approximately 5.52 acres in area and is currently developed with a movie theater building, parking structure, and two restaurant buildings, one of which has a drive-through. The property is located in the “SP2015-1” Anaheim Canyon Specific Plan in Development Area 5 (DA5) and the General Plan designates the property for General Commercial land uses. The development standards and regulations of Chapter 18.120 (Anaheim Canyon Specific Plan) of the Anaheim Municipal Code (the “Code”) apply to the Proposed Project; and WHEREAS, Automotive–Vehicle Sales, Lease & Rental uses require a conditional use permit subject to the approval by the Planning Commission pursuant to Subsection .040 of Section 18.120.040 (Uses); and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on February 27, 2023, at 5:00 p.m., with notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against the Proposed Project and to investigate and make findings and recommendation in connection therewith; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's CEQA Procedures, the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds that the effects of the Proposed Project are Categorically Exempt from the requirements to prepare additional environmental documentation - 2 - PC2023-*** per CEQA Guidelines, Section 15301– Existing Facilities. The Proposed Project includes interior improvements to the existing movie theater with minimal exterior improvements and staff does not anticipate that these would result in a significant impact on the environment. Trip generation from the Proposed Project is less than the previously-operating movie theater. Therefore, staff has determined that this would be a negligible expansion of the use. Pursuant to Section 15300.2 (c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project would be categorically exempt from the provisions of CEQA; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for a conditional use permit, does find and determine the following facts: 1. The Proposed Project is properly one for which a conditional use permit is authorized as an allowable use within the Anaheim Canyon Specific Plan under subsection .040 of Section 18.120.040 (Uses) of Chapter 18.120 (Anaheim Canyon Specific Plan) of the Code, subject to a conditional use permit for an Automotive-Vehicle Sales, Lease, and Rental facility. 2. The Proposed Project, as conditioned herein, would not adversely affect the adjoining land uses, or the growth and development of the area because the project would be consistent in use and would operate similarly to the adjacent commercial uses in the area as there are automotive dealerships located to the west of the subject site. The proposed improvements on the Property are consistent with the required on-site improvements in the Anaheim Canyon Specific Plan, with adequate vehicle and service access from the public right-of-way. 3. The size and shape of the site are adequate to allow the full operation of the Proposed Project in a manner not detrimental to either the particular area or to the health and safety of the public because the commercial site can accommodate the required parking, vehicle access, and circulation without creating detrimental effects on adjacent properties. The required parking and demand for the proposed use is less than the required and provided parking from the previous movie theater, and the Proposed Project would result in a surplus of available parking for all the uses on the property. 4. The traffic generated by the Proposed Project would not impose an undue burden upon the streets and highways, as they are designed and improved to carry the anticipated traffic generated by the Proposed Project. Additionally, the site will not exceed the anticipated volumes of traffic or daily trips, as the City Traffic Engineering Department has confirmed the findings through the review of a project-specific Trip Generation Memo and Vehicle Miles Traveled (VMT) Screening Evaluation. 5. The granting of the conditional use permit would not be detrimental to the health and safety of the citizens of the City of Anaheim because the Proposed Project would be compatible with the commercial uses in the surrounding area, subject to compliance with the conditions contained herein; and - 3 - PC2023-*** WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that negate the findings made in this Resolution. This Planning Commission expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, this Planning Commission does hereby approve the conditional use permit, contingent upon and subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the Property for which the conditional use permit is applicable in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition, (ii) the modification complies with the Code, and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. BE IT FURTHER RESOLVED, that any amendment, modification, or revocation of this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit Approval) and 18.60.200 (Revocation or Modification of Permits) of the Code. BE IT FURTHER RESOLVED, that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED, that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation, or requirement. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of February 27, 2023. CONDITIONS OF APPROVAL RESPONSIBLE DEPARTMENT PRIOR TO GRADING PERMIT ISSUANCE 1 The Applicant/Owner/Developer shall submit a set of improvement plans for Public Utilities Water Engineering review and approval in determining the conditions necessary for providing water service to the project. Public Utilities, Water Engineering PRIOR TO BUILDING PERMIT ISSUANCE 2 Any utility connections or work performed within the public right-of-way shall require a Right of Way Construction Permit from the Public Works Department. Public Works Department, Development Services 3 Any proposed on-site landscaping shall comply with the City of Anaheim’s adopted Landscape Water Efficiency Guidelines. This ordinance is in compliance with the State of California Model Water Efficient Landscape Ordinance (AV 1881). Public Works Department, Development Services 4 A private water system with separate water service for fire protection and domestic water shall be provided and shown on plans submitted to the Water Engineering Division of the Anaheim Public Utilities Department. Public Utilities, Water Engineering 5 All backflow equipment shall be located above ground outside of the street setback area in a manner fully screened from all public streets and alleys. Any backflow assemblies currently installed in a vault will have to be brought up to current standards. Any other large water system equipment shall be installed to the satisfaction of the Water Engineering Division outside of the street setback area in a manner fully screened from all public streets and alleys. Said information shall be specifically shown on plans and approved by Water Engineering and Cross Connection Control Inspector. Public Utilities, Water Engineering 6 All requests for new water services, backflow equipment, or fire lines, as well as any modifications, relocations, or abandonments of existing water services, backflow equipment, and fire lines, shall be coordinated and permitted through Water Engineering Division of the Anaheim Public Utilities Department. Public Utilities, Water Engineering 7 All existing water services and fire services shall conform to current Water Services Standards Specifications. The Owner/Developer shall be responsible for the costs to upgrade or to abandon any water service or fire line. 8 The Owner/Developer shall submit to the Public Utilities Department Water Engineering Division an estimate of the maximum fire flow rate and maximum day and peak hour water demands for the project. This information will be used to determine the adequacy of the existing water system to provide the estimated water demands. Any off-site water system improvements required to serve the project shall be done in accordance with Rule No. 15A.1 of the Water Utility Rates, Rules, and Regulations. Public Utilities, Water Engineering 9 All grading and excavation activities shall be carried out in accordance with the site’s Soil Management Plan and a note to this effect shall be included on the applicable construction plans. Planning and Building Department, Planning Services Division PRIOR TO FINAL BUILDING AND ZONING INSPECTIONS 10 Any proposed public improvements or utility connections shall be constructed by the developer, inspected and accepted by Construction Services prior to final building and zoning inspection. Fire Department 15 Any lockable pedestrian and/or vehicular access gates shall be equipped with “knox box” devices as required by the Fire Department. Fire Department PC2023-*** NO. CONDITIONS OF APPROVAL RESPONSIBLE DEPARTMENT 16 That ongoing during project operations, vehicle deliveries including loading and unloading shall be performed on site. Delivery vehicles shall not block any part of the public right of way or existing access to Imperial Promenade, the shopping center located east of the project. Public Works Department, Traffic Engineering 17 That ongoing during project operations, public streets or parking lots shall not be used for outdoor storage, storage of trailers or non-motorized vehicles, automobile washing or detailing, automobiles repair maintenance, storage of inoperable vehicles. Public Works Department, Traffic Engineering 18 Building plans shall show conformance with the current version of Engineering Standard Detail 115 pertaining to driveway design, sight distance visibility for signs, landscaping, and fence/wall locations and pertaining to commercial driveway radii, subject to the approval of the City Engineer. Public Works Department, Traffic Engineering 19 Building plans shall show conformance with the current version of Engineering Standard Detail 473 pertaining to driveway spacing and distance from public ROW to nearest parking space, subject to the approval of the City Engineer. Subject property shall thereupon be developed and maintained in conformance with said plans. Public Works Department, Traffic Engineering 20 Building plans shall show conformance with the current version of Engineering Standard Detail 470 pertaining to parking standards. The subject property shall thereupon be developed and maintained in conformance with said plans. Public Works Department, Traffic Engineering 21 Building plans shall indicate any required utility vehicle hammerhead turn around areas, and that said hammerhead turn areas shall conform to the current version of Engineering Standard Detail 476. Public Works Department, Traffic Engineering 22 The Owner shall be responsible for restoring any special surface improvements, other than asphalt paving, within any right-of- way, public utility easement or City easement area including but not limited to colored concrete, bricks, pavers, stamped concrete, walls, decorative hardscape or landscaping that becomes damaged during any excavation, repair or replacement of City owned water facilities. Provisions for maintenance of all said special surface improvements shall be included in the recorded Master CC&Rs for the project and the City easement deeds. Public Utilities, Water Engineering 23 The following minimum horizontal clearances shall be maintained between proposed water main and other facilities: • 10-feet minimum separation (outside wall-to-outside wall) from sanitary sewer mains and laterals Public Utilities, Water Engineering PC2023-*** NO. CONDITIONS OF APPROVAL RESPONSIBLE DEPARTMENT • 5-feet minimum separation from all other utilities, including storm drains, gas, and electric • 6-feet minimum separation from curb face • 10-feet minimum separation from structures, footings, and trees. The following minimum clearances shall be provided around all new and existing public water facilities (e.g., water mains, fire hydrants, service laterals, meters, meter boxes, backflow devices, etc.): • 10 feet from structures, footings, walls, stormwater BMPs, power poles, street lights, and trees. • 5 feet from driveways, BCR/ECR of curb returns, and all other utilities (e.g., storm drain, gas, electric, etc.) or above ground facilities. 24 No public water mains or laterals allowed under parking stalls or parking lots. Public Utilities, Water Engineering 25 Ongoing during project operations, loading and unloading of vehicles shall be performed on-site. Delivery vehicles shall not block any part of the public right of way or interior drive aisles. The size and shape of the site are adequate to allow the full operation of the Proposed Project in a manner not detrimental to either the particular area nor to the health and safety of the public because the electronic readerboards are existing and have been in operation since 2016. The proposed modifications to the signs are considered aesthetic in nature and the signable area for advertisement will not increase. 4. The granting of the minor conditional use permit will not generate additional traffic and would not impose an undue burden upon the streets and highways, as they are designed and improved to carry the anticipated traffic generated by the Proposed Project. Additionally, the site will not exceed the anticipated volumes of traffic or daily trips, as the City Traffic Engineering - 3 - PC2023-*** Department has confirmed the findings through the review of a project-specific Trip Generation Memo and Vehicle Miles Traveled (VMT) Screening Evaluation. 5. The granting of the minor conditional use permit would not be detrimental to the health and safety of the citizens of the City of Anaheim because the Proposed Project would be compatible with the commercial uses in the surrounding area, subject to compliance with the conditions contained herein; and WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that negate the findings made in this Resolution. The proposed use will be approximately 49,883 sqft. including 49,060 sqft. of ground floor area and approximately 823 sqft. of mezzanine space to be used as a showroom, vehicle preparation, vehicle delivery, service, and ancillary office space. The proposed project will reuse the existing multi-level parking garage of approximately 21,047 sqft. on the same parcel for EV storage, customer parking, and employee parking. The project intends to reuse the two (2) existing electronic reader board signs – one located on the freestanding monument sign at the La Palma Ave. entry and the other is an existing wall sign. The existing total parking provided is 523 stalls; including 265 surface parking, 171 garage parking, 38 reciprocal parking allowed on the adjacent center, and 49 reciprocal parking with the adjacent bank. The reciprocal parking stalls are depicted on the updated site plan, as a first-come, first-serve basis for the existing movie theater patron and will carry over for the future Tesla use upon update to the existing CC&Rs. However, even without these reciprocal parking stalls, the Tesla site is still overparked. The total number of parking provided with the project for the entire parcel will be 519 stalls including the reciprocal stalls including the loss of 4 surface parking stalls will be removed for the incorporation of roll-up doors for vehicular access to the building. The number of parking spaces in the parking structure will remain unchanged and of the 171 stalls in the parking structure – approx. 70 stalls will be utilized for employee parking, 50 stalls will be utilized for new vehicles storage for delivery, and the remaining will be used for a mix of vehicles to be serviced and customer parking overflow. Of the 68-surface parking within the Tesla project proximity – approx. 41 stalls will be utilized for service intake and vehicles to be picked up by customers, approx. 20 stalls will be utilized for customers sales, the remaining will be used for overflow of customer parking or vehicles to be serviced. Electric Vehicles are notably different than gas powered vehicles as there is not exhaust system, no fuel tanks, no liquid fuel usage, no new or used motor oil, no engine noise, and no emissions like hydrocarbon and carbon monoxide that are emitted from an automobile powered by an internal combustion engine. The location will be an addition to other existing Tesla locations throughout Orange County (i.e., Buena Park, Santa Ana, Costa Mesa, Irvine, and Lake Forest) adding to the growing market. Customers will be able to view the showroom, complete test drives, explore our vehicles out of this location during store hours, and take delivery of vehicles. Sales hours are anticipated to be Monday thru Sat between 10am to 7pm and Sunday between 11am to 6pm. It is anticipated that this location will provide employment for approximately 60 total full-time employees for both the showroom and servicing use. Service hours are anticipated on Monday thru Sunday between 7am to 7pm. Standard servicing and repair of our electric vehicles will be performed here including software updates, tire replacement, tire balancing, replacement of bolt on parts (i.e., window regulators, door handles, suspension components, bumpers) etc. Battery replacement will take place on an as needed basis since not every vehicle that comes in will require battery replacement. A battery testing/diagnosis will be made to ensure that replacement of battery is necessary. The facility will retain an average of 10-15 batteries available per day in inventory with daily shipment from warehouse location, as needed. Tire replacement will also be performed on an as needed basis, with old tires removed and stored/disposed daily. Tesla will prepare vehicles, including wash and detailing work, no automated equipment is proposed for the vehicle wipe-down area. Approximately 3-5 daily standard delivery trucks will also be dropping off shipments of auto-parts, batteries, etc. Both car hauler and equipment/parts delivery will access the site via La Palma Ave., enter the site starting on the easterly (front) side of the building, circle around the north side of the building and stop at the westerly (back) side of the building where they will park at the designated delivery zone, and exit similar to how they’ve entered. Vehicle drop-off queue will not spill out into any active drive aisle nor impede La Palma Ave. right-of-way since un/loading is occurring at the back of the building. Hauled vehicles and equipment/parts delivered will then enter through the roll-up doors on the westerly side of the building, night time/off-hour drops are recommended by Tesla. Several standard tow trucks can also drop off a customer’s vehicle on a daily basis when damaged vehicles cannot be safely driven to this location. Tow will deliver the vehicle to the front of the building. A service technician will contact the customer to confirm the vehicle has been dropped off before getting the vehicle into the building via the roll-up door or park the vehicle in the parking garage until it is to be serviced. Otherwise, a customer can drop off their vehicle for service via appointment themselves at the facility. Customers who do not have an appointment can park their car or pull into the service drop off door and check in with a service advisor. I hope this council makes an CEQA exception (California Environmental Quality Act) for this project and all projects moving forward. I’m opposed to CEQA morally on the grounds that it puts the environment above the protection individual rights. This type of policy is antagonistic to human flourishing as it is individual rights which allows us to freely alter a naturally unsafe environment into something safe for humans. For example, the construction of homes for shelter, building dams for electric power, collecting rain for drinking water, building roads to transport supplies, mining rare metals for computer chips, or even in this particular case, building car dealerships to sell cars so we can travel to visit loved ones far away, etc etc. This policy also creates a Vetocracy where anyone can simply veto a project without any proof of environmental damage and now the burden of proof falls on the business owner to show that the business isnt breaking any CEQA laws. For example, anyone can veto development by claiming that a business would harm a kangeroo rat without any proof the species even lives on that land. The private land owner, in a sense, is treated guilty until proven innocent. Ironically, CEQA may even hurt the environment it’s striving to protect. CEQA puts a strain on the economy yet it’s an undisputed fact that wealthier nations have cleaner environments. As citizens become richer they can begin to buy land for the purpose of preserving wildlife and they can afford cleaner forms of energy. Consider the vast amount of pollution in America during the 1800s Industrial Revolution or China today; black coal ash literally covers entire cities. As we became richer we can start affording the technology to burn coal more efficiently and collect the ash. Another example is how America has more trees today than it did 100 years ago.
