RESOLUTION NO. 72R-64
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2324 IN PART.
liHEREAS, after a request for variance by LAWRENCE A.
MUCKENTHALER,owner; PANAMINT CONSTRUCTION CO., IRa,: agent, was
received, a public hearing before the Planning Commission of the
City of Anaheim was held upon due and proper notice as a re~ult
of which Variance No. 2324 was denied, covering the following
described property:
That portion of the South half of the Southwest
quarter of the Northwest quarter of Section 9
Township 4 South, Range 10 West in the Rancho
San Juan Cajon de Santa Ana, city of Anaheim,
County of Orange, State of California, as per
map recorded in book 51 page 10 of Miscellaneous
Maps, in the office of the County Recorder of
said County, described as follows:
Beginning at the Southeast corner of said South
half; thence West along the South line of said
South half to the Southeast corner of the land
described in the Deed to H. Leroy Hall et ux.,
recorded March 13, 1930 in Book 360 page 385 of
Official Records; thence North along the East line
of said land of Hall and along the East line of
Parcel 1 of the land described in the Deed to Floyd
M. Hatfield et ux., recorded April 25,1935 in Book
745 page 446, of Official Records, to the North line
of said South half; thence East along said North
line to the northeast corner of said South half;
thence South along the East line of said South half
to the Point of Beginning.
EXCEPT the North 230.00 feet thereof.
ALSO EXCEPT that portion thereof description in a
Deed to Lawrence A. Muckenthaler, Jr., et. al.,
recorded December 31, 1968 in Book 8834, ~age 117 of
Official Records.
WHEP~ASi thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as
a result thereof the city Council does hereby make the following
findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in

NOW, THEREFORE, BE I'll RESOLVED by the city Council of
the city of Anaheim that a conditional zoning variance be and the
same is hereby granted, in part, pe~ittin9 establishment of a
three-story, 182-unit apartment complex on the property herein-
be.fore described with waivers of the following sections of the
Anaheim Municipal Code.
SECTION 18.28.050(11)
Maximum building height (two stories
pe~itted; three stories proposed)
Maximum wall heiqht in the front
setback (6 feet proposed; 42 inches
permitted)
SECTION l8.28.0S0(S-A)
That said variance be granted, in part, subject to the. following
conditions:
1. That this variance is grant.ed subject to the "
completion of Reclassification No. 71-72-27, now pending.
2. That subject property shall be developed. substan-
tially in accordance with plans and specifications on file with
the city of Anahe~ marked Exhibits Nos. 1, 2 and 3, provided,
however, that sufficient dwelling units shall be del.e.ted from
the development in order that a minimum of 1,200 square "feet of
land is provided for each remaining unit.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit .for good cause
or failure of said owner, his heirs, successors or assigns to
comply with the Anaheim Municipal Code and regulations and the
conditions herein. Said variance is granted for the term pre-
scribed by the Anaheim Municipal Code unless otherwise specified
herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 22nd day of February, 1972.
