RESOLUTION NO. 72R-53
A RESOLUTION 01' THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 1285 .
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
fromENVIRONMENTAL LEISURE CORPORATION, 126 N. Euclid Avenue,
Fullerton, california, as agent for THOMAS P. WALKER, owner,
to establish a 65-unit motel on the followinq described property:
All that real property in the city of Anaheim, County of
Orange, state of California, being that portion of Lot 6
of South P1acentia Tract No. 2 per map thereof, recorded
in Book 5, paqe 42 of Miscellaneous Maps, records of said
County, described as follows:
BEGINNING at the intersection of the centerline of Via Burton
street, as described in the deed to the city of Anaheim
recorded September 3, 1959, in Book 4868, page 525 of Official
Records, with a line which is parallel with and distant
237.00 feet Easterly measured at right angles fram centerline
of State College Boulevard fo~erly Cypress street, shown
as an unnamed street along the Westerly side of said Lot 6;
thence southerly along said parallel line South 00 15' 00"
East 180.00 feet to a line which is parallel with and dis-
tant 180.00 feet southerly measured at right.angles fraa
said centerline of Via Burton Street; thence Easterly along
said last above mentioned parallel line North 890 561 44"
East 31.00 feet to a line which is parallel with and distant
268.00 feet Easterly measured at right angles from said
centerline of state College Boulevard; thence Southerly
along said last above mentioned parallel line South 00 151
00" East 142.95 feet to the Southerly line of the land
conveyed to Cosmo Carassone and Angelo Battag1ieri by deed
recorded March 12, 1927, in Book 21, Page 304 of said
Official Records; thence along said southerly line North
890 57' 11" East 180.81 feet to a line parallel with and
distant Westerly 166.67 feet, measured along said centerline
of Via Burton, from the most Westerly 1ine~ and the
Northerly prolongation thereof, of the land conveyed to
Bert Bledsoe, et al., by deed recorded March 6, 1964, in
Book 6952, page 67 of said Official Records; thence North
00 03' 16" West, 322.00 feet to said centerline of Via
Burton; thence along said centerline of Via Burton, South
890 56' 44' West 212.91 feet to the Point of Beginning.

AND WHEREAS, the City Planning .Commission did-hold a
public he~ring at th~ City Ball in the City ot Anaheim upon .
said application on January 24 " 19 72 , notices of ~
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim-
MUnicipal Code; and
WHEREAS, said Commission, after due inspection, in-
vesti2ation and studies made by itself and in its behalf a~d

WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said conditional
use permit and said appeal was set for public hearing on
February 15 , 19 72 , at the City Hall, ,in the City of
Anaheim, and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anahe~ Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed. use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion in de~ing said conditional use permit be, and the
same is hereby dis~pqroved , and that Conditional Use Permit
No. 12R~ be, ana the same is hereby, granted pe~itting
the establishment of a 65-unit motel on M-l (light industrial)
zoned property subject to the following conditions:

1. That the owner of subject property shall pay to
the City of Anaheim the sum of $2.00 per front foot along Via
Burton street for street lighting purposes.
2. That the sidewalks shall be installed along Via Burton
street as required by the City Engineer and in accordance with
standard plans and specifications on file in the office of the
City Engineer.

5. That fire hydrants shall be installed as required
and determined to be necessary by the Chief of the Fire Depart-
ment.
6. That subject property shall be .served by underqround
utilities.
7. That drainage of subject property shall be disposed of
in a manner satisfactory to the City Engineer.
8~ That Conditions Nos. land 3, above mentioned, shall
be complied with prior to the commencement of the activity
authorized. under this resolution, or prior to the ..time. .that :
the building permit is issued, or wi thin a per.iod of 18-0. day.s
from dat.e hereof, whichever occurs first., or such, furt.her tiJne
as the City Council may grant.
9. That Conditions NO.8. 2, 4, 5, 6 and 7, ab.ove. .IQentmned,
shall be complied with prior to final building and. zoning
inspec.tions.
10. That subject property shall be developed substantially
in accordance with plans and specifications on file" w~th 'the
City of Anaheim marked Exhibit Nos. 1, 2, 3~ 4 (nevts1on No.1)
and 5.
The City Council hereby reserves .the right to revoke
such Conditional Use Permit for good cause of fqilure of said
owner, hi,s heirs, succes.sors or assiqns to camp-ly with .the
Anaheim Municipal Code and regulations and the conditions
herein.
