RESOLUTION NO. 72R-25 A RESOLUTION OF THE CITY CQUNCIL OF THE CITY OF ANAHEIM FINALLY ACCEPTING THE COMPLETION AND THE FURNISHING OF ALL LABOR, SERVICES AN.D EQUIPMENT NECESSARY TO COMPLETE THE CUTTING AND REMOVAL OF ALL RANK GROWTH AND WEEDS AND. REMOVAL OF RUBBI.5H, REFUSE AND DIRT. UPON ANY PARCEL OR PARCELS OF REAL PROPERTY. OR ANY PUBLIC .STREET IN .THE CITY OF ANAHEIM, ACCO.UNT NO. 323-297. WHEREAS, the City Council of t.he Ci'ty of Anaheim did cause to be published in a newspaper of qeneral circulation,- printed, published and circulated in the Ci~y of Anaheim, to wit: The Anaheim BUlletin, on April 15th and April 22nd, 1971, a notice invi'ting sealed proposals for furnishing the following: All labor and equipment to cut and remove all rank growth and weeds and remove rubbish, .refuse and dirt upon any parcel or parcels of real property or any public street in the Ci.'ty of Anaheim, as directed by th.e Chief of the Fire Depar~ent, Account No. 323-297. which said notice specified ~hat sealed proposals would be received up. until 2:00 o'clock P.M. on the 29th -day of April, 1971, and WHEREAS, on April 29, 1971, at 2:.00 -o'clock P.M. 'the City Clerk and the Director of Public Works .and Chief. of the Fire Depar~ent of the City of AnAheim did open said sealed proposals received up to that time for the furnishing of all labor and equipment to cut and remove said rank growth and weeds and remove rubbish, re.fuse and dirt, in public in ~he City Council Chamber in the City Hall, Anaheim, California, and the Director of Public Works and Super.intendent of St.reets did tabulate 'the result of said sealed proposals and did make a report .to the City Council at i'ts next reqular meeting; and WHEREAS, the City Council of the City of Anaheim did, at .its next regular meeting he.ld on the .4th day of May, 19"11, at the hour of 1:30 o'clock P.M. consider the sealed proposals submitted for furniShing the labor and materials and performinq the work hereinabove more particularly described and set forth, and did thereupon find and dete~ine that the sealed proposal submitted by HAROLD WATTS, 8910 Amestoy, Northridge, California, was the lowest responsible proposal submitted for the furnishing of all labor and equipment to cut and remove said rank growth and weeds and remove rubbish, refuse and dirt, as specified in the noti.ce inviting sealed proposals, and thereupon accepted said bid and did award a contract to said HAROLD WATTS for furnishinq all labor and equipment to cut and remove said rank growth and weeds and remove rubbish, refuse and dirt, which said contract was duly made and entered into on the 13th day of May, 1971:- and WHEREAS, said HAROLD WATTS has furnished all labor. .,,-. . WHEREAS, the City Council finds that "said coni:rac~r has canpleted said work her.einabove more particularly, des~cr1bed in a.ccordance with the provisions of the contract. and l:he contract. documents., and that notice of canpletion sho.uld' be ..filed and payment of the balance due said cont~actor authorized in accord- ance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the. .City .Council of the City of Anaheim that all labor, services ~d equipment, and the performance of all work necessary to complete, in a good and workmanlike manner, in strict accordance with the .contract and contract documents, the cutting and removal of said rank growth and weeds and removal of rubbish, refuse and dirt hereinabove referred to, in the City of Anaheim, by said contractor, be,' and t.he same are hereby accepted, subject, nevertheles.s., to all the te~s, conditions and provisions of said cont.ract. and can- tr.act documents, and that th.e balance due said contractor for said work be paid to him thirty-five (35) days after final .accept- ance and the filinq of notice of completion of said work, except- ing only such sum or sums as may lawfully be withheld in accord- ance with the provisions of said contract and contract documents. That acceptance by the contractor of said payment shall operate and shall be a release to the City of Anaheim, its officers,. agents and employees from all claims and liabilities due the contractor for anything done or furnished or withheld or for anything relating to the work or any act or neglect of the City, its officers, agents and employees, excepting only claims against th.e City for any amounts withheld by the City at "the time of such payment. AND BE IT FURTHER RESOLVED that the Mayo.r and "the City Clerk of the City of ADahetm be, and they are .hereby authorized to execute and file a noti.ce of completion of said work as required by law.
