RESOLUTION
A RESOLUTION OF THE
OF ANAHEIM GRANTING
NO. 69R -343
CITY COUNCIL OF THE CITY
VARIANCE NO. 2049.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from Robert
F. Walden, agent for Ann Prentice, Berniece Meier and Fred Meier
owners of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
All that certain land situated in the State of California,
County of Orange, City of Anaheim, described as follows:
Parcel 1: The North 7 acres of the Southwest quarter of
the Northwest quarter of the Southeast quarter of Section
12, Township 4 South, Range 10 West, in the Rancho San
Juan Cajon de Santa Ana as shown on a Map recorded in Book
51, page 10 of Miscellaneous Maps, records of Orange
County, California.
Parcel 2: That portion of the Northwest quarter of the
Southeast quarter of Section 12, Township 4 South, Range
10 West, in the Rancho San Juan Cajon de Santa Ana, as
shown on a Map recorded in Book 51, page 10 of Miscel-
laneous Maps, records of Orange County, California, des-
cribed as commencing at the Southwest corner of the
North half of the Northwest quarter of the Southeast
quarter of said Section 12; thence East 681.75 feet;
thence North 78° 45' West along the center line of
Anaheim and Olive Road, 60 feet wide, a distance of 695
feet; thence South 135.3 feet to the point of beginning.
EXCEPTING from said Parcels 1 and 2 those portions thereof
lying Northerly and Northeasterly of the Southerly and
Southwesterly lines of the land described in Final Order
of Condemnation to the State of California, filed Septem-
ber 1, 1964 and recorded in Book 7203, page 704 of Official
Records of said County.

ALSO EXCEPTING from said Parcels 1 and 2 those portions
thereof described as follows:
Beginning at the Southwesterly corner of the land described
in Final Order of Condemnation to the State of California,
filed September 1, 1964 and recorded in Book 7203, page 704
of Official Records of said County; thence Southerly along
the Westerly line of said Southeast quarter, 124.00 feet;
thence Easterly, at right angles to said Westerly line,
171.00 feet; thence Northeasterly in a direct line, 132.00
feet to a point in the Southwesterly line of the land des-
cribed in said Final Order of Condemnation, said Southwesterly
line cited as "South 68° 41' 38" East 141.88 feet said point
being distant Southeasterly thereon, 67.00 feet from the
Northwesterly terminus thereof; thence Northwesterly, along
said Southwesterly line 67.00 feet; thence continuing
Northwesterly, Southwesterly and Westerly along said
Southwesterly line to the point of beginning.
AND WHEREAS, the. City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on June 2, 1969, notice of which said public hearing
was duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC69 -131, denying
Variance No. 2049; and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting the
action of the City Planning Commission in denying said variance,
and said appeal was set for public hearing on June 17, 1969,
at 1:30 o'clock P.M. at the City Hall in the City of Anaheim, and
notice of such public hearing was duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim Muni-
cipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary fbr the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting the establishment of a
94 -unit apartment complex on the property hereinbefore described
with waivers of the following Anaheim Municipal Code requirements
or limitations, subject to the conditions hereinafter set forth:
1. Minimum setback for accessory buildings,
Section 18.28.050(6 -c);
2. Minimum distance between buildings, Section
18.28.050(7-a);
3. Maximum number of main buildings on a site,
Section 18.32.020(1);

4. Minimum number of covered parking stalls,
Section 18.28.050(10 -a); and
5. Maximum distance of living units from a
standard street, Section 18.28.050(9 -b).
That this variance is granted subject to the following conditions:
1. That this variance is granted subject to the com-
pletion of Reclassification No. 68- 69 -65.
2. That subject property shall be developed substan-
tially in accordance with plans and specifications
on file with the City of Anaheim, marked Exhibits
Nos. 1 and 2, Revision No. 1.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners,
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 17th day of June, 1969.
