69R-342WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly pissed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a time and place for the holding of a public hearing
thereon in the manner and as prescribed in Title 18 of the
Anaheim Municipal Code, and after having duly held and conducted
such public hearing to consider said proposed change of zone
or zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty (40) days following
the hearing thereon, the Planning Commission did duly announce
by formal resolution its findings of facts and declare its
opinions and reasons for recommending denial of said proposed
change in the boundaries of the zone or zones hereinafter
mentioned and described; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
P1 nning Commission, the City Council did fix the 17th d of
e 19 69 as the time, and the City Council Cham-
bers in the City Hall in the City of Anaheim as the place for a
public he ring upon said proposed amendment to Title 18 of the
Anaheim Municipal Code, and the exclusion of said property, here
in =fter described, from the zone in which it is now situated and
the incorporation thereof in the zones hereinafter set forth; and
did give notice thereof in the manner and form as provided in
said Title 18 of s -id Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at said public
hearing before the P1 ginning Commission, its report of findings
and recommendations; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated;
nd incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that =11 of the property
and area situated in the City of Anaheim, County of Orange, State
of California, described as followse

All that certain land situated in the State of Cali
fornia, County of Orange, City of Anaheim, described
as follows;
That portion of the Northwest quarter of the Southeast
quarter of Section 12, Township 4 South, Range 10 West,
in the Rancho San Juan Cajon de Santa Ana, as shown on
a Map recorded in Book 51, page 10 of Miscellaneous Maps,
records of Orange County, California.
Beginning at the Southwesterly corner of the land des
cribed in Final Order of Condemnation to the State of
California, filed September 1, 1964 and recorded in
Book 7203, page 704 of Official Records of said County;
thence Southerly along the Westerly line of said South-
east quarter, 124.00 feet; thence Easterly at right
angles to said Westerly line, 171.00 feet; thence North-
easterly in a direct line 132.00 feet, to a point in the
Southwesterly line of the land described in said Final
Order of Condemnation, said Southwesterly line cited as
"South 68° 41' 38 East 141.88 feet said point being
distant Southeasterly thereon 67.00 feet from the
Northwesterly terminus thereof; thence Northwesterly

Juan Cajon de Santa Ana as shown on a Map recorded in Book
51, page 10 of Miscellaneous Maps, records of Orange
County, California.
Parcel 2 That portion of the Northwest quarter of the
Southeast quarter of Section 12, Township 4 South, Range
10 West, in the Rancho San Juan Cajon de Santa. Ana, as
shown on a Map recorded in Book 51, page 10 of Miscel-
laneous Maps, records of Orange County, California, des-
cribed as commencing at the Southwest corner of the
North half of the Northwest quarter of the Southeast
quarter of said Section 12; thence East 681.75 feet;
thence North 78° 45' West along the center line of
Anaheim and Olive Road, 60 feet wide, a distance of 695
feet; thence South 135.3 feet to the point of beginning.

C -1, GENERAL COMMERICAL ZONE as to the aforementioned Portion A;
and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE as to
the aforementioned Portion B, upon the following conditions:
1. That the owners of subject property shall deed
to the City of Anaheim a strip of land 45 feet
in width from the ultimate alignment centerline
of Sunkist Street in accordance with. Plan No.
M.M.90 for street widening purposes.
2. That street improvement plans shall be prepared
and all engineering requirements of the City of
Anaheim, along Lincoln Avenue and Sunkist Street,
such as curbs and gutters, sidewalks, street grading
and paving, drainage facilities, or other appurtenant
work shall be complied with as required by the
City Engineer and in accordance with standard
plans and specifications on file in the Office
of the City Engineer; and that a bond in an amount
and form satisfactory to the City of Anaheim shall
be posted with the City to guarantee the installation
of said engineering requirements.
3. That the owners of subject property shall install
street lighting along Lincoln Avenue and Sunkist
Street as required by the Director of Public
Utilities and in accordance with standard plans
and specifications on file in the Office of the
Director of Public Utilities; and that a bond
in an amount and form satisfactory to the City
of Anaheim shall be posted with the City to guarantee
the installation of said street lighting.
4. That the owners of subject property shall pay
to the City of Anaheim the sum of 15 per front
foot along Lincoln Avenue and Sunkist Street,
for tree planting purposes.
5. That a Parcel Map to record the approved division
of subject property be submitted to the City of
Anaheim for approval and then be recorded in the
Office of the Orange County Recorder.

6. That trash storage areas shall be provided in
accordance with approved plans on file in the
Office of the Director of Public Works.
7. That fire hydrants shall be installed as required
and determined to be necessary by the Chief of
the Fire Department.
8. That any air conditioning facilities proposed
shall be properly shielded from view, and the
sound shall be buffered from adjacent residential
homes.
9. That a 6 -foot masonary wall shall be constructed
along the south and east property lines of Portion
A, and along the south, east and northeasterly
property line of Portion B.
10. That the alignment of subject property's northeasterly
property line adjacent to the. Orange Freeway shall
be approved by the State Division of Highways.
11. That ordinances reclassifying the property shall
be adopted as each parcel is ready to comply with
conditions pertaining to such parcel; PROVIDED,
HOWEVER, that the word "parcel" shall mean presently
existing parcels of record and any parcel or parcels
approved by the City Council for a lot split.
12. That the owners of subject property shall pay
to the City of Anaheim the sum of $75.00 per
dwelling unit, to be used for park and recreation
purposes, said amount to be paid at the time the
building permit is issued.
13. That Conditions Nos. 1, 2, 3, and 4, above mentioned
shall be complied with within a period of 180
days from date hereof, or such further time as
the City. Council may grant.
14. That Conditions Nos. 5, 6, 7, 8, 9, and 10 above-
mentioned, shall be complied with prior to final
building and zoning inspections.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an ordinance amending Title 18 of the
Anaheim Municipal Code to accomplish the objects herein found
and determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
