RESOLUTION NO. 69R -285
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2073
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
Jack Stovail'as Agent for Al Stovall, dba Cosmic Age Motel, Lessee
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
That portion of Lots 1 and 2 and that one acre school
lot of the Walnut Colony Tract, in the City of Anaheim,
County of Orange, State of California, as per map filed
in Book 1 page 14 of record of surveys, in the Office
of the County Recorder of said county, described as
follows:
Beginning at the intersection of the center line of
Katella Ave., and the center line of West Street as
shown on the Map of Tract No. 3290 as per map recorded
in Book 101 pages 43 and 44 of miscellaneous maps, in
the office of the County Recorder of said county, said
intersection also being the northeast corner of Section
28, Township 4 South, range 10 west in the Rancho San
Juan Cajon de Santa Ana as per map recorded in Book 51
Page 10 of Miscellaneous Maps, in the Office of the
County Recorder of said county; thence along said center
line. of Katella Ave., south 89° 25' 22 west 338.00 feet;
thence parallel with said center line of West Street south
0° 48' 38" East 60.00 feet to the true point of beginning;
thence continuing along said line parallel with said
center line of West Street to and along the easterly line
of said Tract No. 3290 south 0° 48' 38" east 599.98 feet
to the southerly line of said lot 2, being also the northerly
line of Tract No. 3204 as per map recorded in Book 97 pages 1
to 4 inclusive of miscellaneous maps, in the office of the
county recorder of said county; thence along said southerly
line north 89° 25' 53" east 293.00 feet to a line parallel
with and distant westerly 45.00 feet, measured at right
angles, from said center line of West Street; thence along
said parallel line north 0° 48' 38" west 288.85 feet; thence
south 89° 11' 22" west 80.00 feet; thence parallel with
said center line of West Street north 0° 48' 38" west 311.50
feet to a line parallel with said center line of Katella
Ave., and which passes through the true point of beginning;
thence along said parallel line south 89° 25' 22" A 213.00
feet to the true point of beginning.

office of the county recorder of said county; thence along
said center line of West Street south 0° 48' 38" east 660.03
feet to the easterly prolongation of the southerly line
of said Lot 2, said southerly line being also the northerly
line of Tract No. 3204 as per map recorded in Book 97 pages
1 to 4 inclusive of miscellaneous maps, in the Office of the
County Recorder of said county; thence along said prolonga-
tion and said southerly line south 89° 25' 53" west 45.00
feet to a line parallel with and distant westerly 45.00 feet,
measured at right angles, from said center line of West
Street; thence along said parallel line north 0° 48' 38"
west 288.85 feet to the true point of beginning; thence
south 89° 11' 22" west 80.00 feet; thence north 0° 48' 38"
west 311.50 feet to a line parallel with and distant
southerly 60.00 feet, measured at right angles, from said
center line of Katella Ave., thence along said parallel
line north 89° 25' 22" east 55.10 feet to the beginning of
a tangent curve concave southwesterly having a radius of
25.00 feet, said curve being tangent at its southerly
terminus with said first mentioned parallel line; thence
southeasterly along said curve through a central angle of
89° 46' 00" an arc distance of 39.17 feet to said parallel
line; thence along said parallel line south 0 48' 38"
east 286.28 feet to the true point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on April 21, 1969 notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC 69 -83
denying Variance No. 2073; and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting the
action of the City Planning Commission denying said variance
and said appeal was set for public hearing on May 20, 1969, at
1 :30 o'clock P.M. at the City Hall in the City of Anaheim,
and notice of such public hearing was duly given as required
by law and the provisions of Title 18, Chapter 18.76 of the
Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted to permit the construction of a
free- standing sign, not to exceed a maximum height of 45 feet,
with waiver of the following Anaheim Municipal Code Section,
subject to the conditions hereinafter set forth:

1. That adequate clearance of existing electrical lines
shall be provided as required by the Electrical Division,
Department of Public Utilities, and the State of
California G.O. 95.,
2. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. 1 and 2.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said lessee,
his successors or assigns, to comply with the Anaheim Municipal
Code and regulations and conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 20th day of May, 1969.
