A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2072.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from M. Mason
Bishop, as the authorized agent for Forest Lawn Cemetery Associa-
tion, owner of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as
follows:
Those portions of the North half of the Southwest
quarter of Section 12, Township 4 South, Range 10
West, in the Rancho San Juan Cajon de Santa Ana,
in the City of Anaheim, as shown on a map recorded
in book 51, page 10 of Miscellaneous Maps, records
of Orange County, California, described as follows:
PARCEL A: That portion of the Northwest quarter of
said Southwest quarter bounded Northerly by the
centerline of the Anaheim -Olive Road, now Lincoln
Avenue, as shown on said Map, and bounded Southerly
by the Northerly lines of Tract No. 3288, as shown
on a map, recorded in book 104, pages 14 and 15 of
Miscellaneous Maps, and Tract No. 1782 as shown on
a map, recorded in book 110, pages 25 and 26 of
Miscellaneous Maps, records of said Orange County.
EXCEPTING THEREFROM that portion described as follows:
Beginning at a point in the centerline of said Lincoln
Ave. South 78° 52' 26" East 102.50 feet, along said
centerline, from the West line of said Section 12;
thence South 0° 24' 19" West 134.85 feet; thence
South 78° 52' 26" East parallel with said centerline
100.00 feet; thence North 0° 24' 19" East 7.96 feet
to the Southwest corner of the land described in
the deed to Ross Realty Co., recorded June 2, 1965
in book 7540, page 730 of Official Records; thence
along the boundary of said last mentioned land the
following courses and distances; South 78° 52' 26"
East 54.66 feet to the Southeast corner of said land;
thence North 0 11' 45" East, parallel with the West
line of said Section 12, 126.92 feet to said center-
line; thence North 78° 52' 26" West, along said center-
line; 154.66 feet to the point of beginning.
PARCEL B: Those portions of the Northeast quarter
of said Southwest quarter shown as Parcels 1 and 2
on a map, recorded in book 8, page 3 of Parcel Maps,
records of said Orange County.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on April 7, 1969, notice of which said public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC69 -72,
denying Variance No. 2072; and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting the
action of the City Planning Commission in denying said variance,
and said appeal was set for public hearing on May 20, 1969, at
1:30 o'clock P.M. at the City Halpin the City of Anaheim, and
notice of such public hearing was duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted to establish two free standing signs
with waivers of the following Anaheim Municipal Code Sections:
Lincoln Avenue frontage free standing sign
1. Section 18.62.090(B-1) Required distance of a free-
standing sign from a roof sign.
(300 feet required; 235 feet
from Michaels Market roof sign
proposed).
2. Section 18.62.090(B -2) Maximum height of a free standing
sign within 300 feet of a residen-
tial structure. (25 feet per-
mitted; 38 feet proposed).
3. Section 18.62.090(B -4) Maximum area of a free standing
sign. (350 square feet permitted;
458 square feet proposed).
State College Boulevard frontage free standing sign
4. Section 18.62.090(B -1) Required distance of a free- stand-
ing sign from a roof sign. (300
feet required; 285 feet from
Thriftimart roof sign proposed).

5. Section 18.62.090(B -2) Maximum height of a free standing
sign within 300 feet of a residen-
tial structure. (25 feet per-
mitted; 38 feet proposed).
6. Section 18.62.090(B -4) Maximum area of a free- standing
sign,. (350 square feet permitted;
458 square feet proposed).
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 20th day of May, 1969.
