A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 1094
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
Hasker Development Corporation; P. O. Box 2218, Anaheim, Cali-
fornia 92805, agent for Dick H. Ables, 34865 Acacia Street,
Yucaipa, California 92399, owner to establish a walk -up and
drive- through restaurant on the following described property:
That portion of Lot 4, in Block 12 of "Subdivision
of the South half of Section 21, Township 4 South,
Range 10 West, S. B. M." being part of the Fair
view Colony Tract, in the County of Orange, State
of California, as per map recorded in Book 1, page
33 of Miscellaneous Maps, in the Office of the
County Recorder of said County, described as follows:
Beginning at the intersection of the North line
of Lot 4 in said Block 12 extended Westerly with
the center line of Garden Grove Road (now Euclid
Avenue), as shown on said map; thence Easterly
along said Westerly extension and the said North
line of said lot 4, 210 feet; thence South parallel
to the center line of Garden Grove Road,. 162 feet;
thence West parallel to the North line of Lot four,
and its westerly extension, 210 feet to a point in
the center line of said Garden Grove Road; thence
along said center line 162 feet to the point of
beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on March 10, 9 notices of which
said public hearing were day given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim llrnicipah
Code; and.
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. p 9 -51

WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in deAying said Conditional
Use Permit and said appeal was set for public hearing on
April 8 19 69 at the City Hall, in the City
of Anaheim, and notices pct public hearing were duly given
as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hear-
ing, that Conditional Use Permit No. 1094 should be denied.
NOW, THEREFORE BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying Conditional Use Permit No. 1094 be,
and the same is hereby sustained and that the request of
Hasker Development Corporation, P. 0. Box 2218, Anaheim, Cali-
fornia 92805, agent for Dick H. Ables, 34865 Acacia Street,
Yucaipa, California 92399, owner, to establish a walk -up and
drive- through restaurant on the property hereinbefore described
is hereby denied.
THE FOREGOING RESOLUTION is approved and aigned by me
this 8th day of April 19 •9
