69R-162WHEREAS, the City Council did heretofore, to wit,
on January 21, 1969, adopt Resolution No. 69R -44 in Reclassi-
fication Proceedings No. 68 -69 -56 finding and determining
that the property and area therein described should be changed
from A -1, AGRICULTURAL DISTRICT ZONING to C -1, GENERAL COMMER-
CIAL ZONE, subject to certain conditions set forth in said
resolution; and
WHEREAS, Conditions Nos. 1 and 3 of said resolution
read as follows:
"1. (a) That all engineering requirements of the City
of Anaheim along Bali Road, including preparation
of improvement plans and installation of all improve-
ments, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or other
appurtenant work shall be complied with as required
by the City Engineer and in accordance with standard
plans and specifications on file in the Office
of the City Engineer; and (b) that a bond in an
amount and form satisfactory to the City of Anaheim
shall be posted with the City to guarantee the
installation of said engineering requirements.
That a parcel map to record the approved division
of subject property shall be submitted to the City
of Anaheim for approval, and then recorded in the
Office of the Orange County Recorder."
AND WHEREAS, the City Council finds that Condition
No. 1 of said Resolution No. 69R -44 should be amended to permit
all engineering requirements of the City of Anaheim along
Ball Road to be complied with prior to final building inspection;
and that Condition No. 3 of said resolution should be amended
to permit the recordation of a parcel map prior to the issuance
of building permits; and
WHEREAS, the City Council does further find that
an ordinance has never been adopted directing said change
of zones and completing said reclassification proceedings.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 69R -44 in Reclassification
Proceedings No. 68 -69 -56 be, and the same is hereby amended
by amending Conditions Nos. 1 and 3 thereof to read as follows:
"1. That all engineering requirements of the City of
Anaheim along Ball Road, including preparation
of improvement plans and installation of all improve-
ments, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or other
appurtenant work shall be complied with as required
by the City Engineer, and in accordance with standard
plans and specifications on file in the office
of the City Engineer, prior to final building inspection.
