A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 489
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from HERMAN H. BRUNS, 1102 South Los Angeles Street, Anaheim, and
JAMES L. BERNIER and DAVID A. KOHL, 2631 West Olympic Boulevard,
Los Angeles 6, California, to construct a multiple family planned
residential development with carports, and permitting a waiver of
the minimum space between structures requirement on the following
described property situated in the City of Anaheim, County of
Orange, State of California, to wit:
A portion of Lot A, Tract No. 2757, as shown on a Map re-
corded in Book 108, pages 28 and 29 of Miscellaneous Maps,
records of Orange County, California; and a portion of Lot
25 of Anaheim Extension, as shown on a Map of Survey by
William Hamel, a copy of which is shown in Book 3, pages
162 to 164 inclusive of "Los Angeles County Maps" in the
office of the County Recorder of Orange County, California;
described as follows:
Beginning at the intersection of the Westerly line of said
Lot 25 with the Westerly prolongation of the Northerly line
of said Lot A; thence North 74 28' 11" East along the
Northerly line of said Lot A a distance of 1047.89 feet;
thence South 15 28' 09" East 1.00 foot; thence North 74
28' 11" East 98.65 feet to the Westerly line of land des-
cribed in a deed to the Southern Pacific Railway Company,
recorded May 15, 1899, in Book 40, page 388 of Deeds; thence
South 15 28' 09" East 185.16 feet along said Westerly line
to the Southerly line of land described in a deed to Herman
Henry Bruns and wife, recorded November 18, 1935, in Book
792, page 12 of Official Records; thence South 74 28' 11"
West 1148.34 feet along said Southerly line to a line that
is parallel with the Westerly line of said Lot 25 and extends
Southerly from the point of beginning; thence North 15 31'
49" West 185.16 feet tolhe point of beginning.
EXCEPTING THEREFROM: The Westerly 330.00 feet thereof.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on October 14 1963 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies mode by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 936 Series
1963 -64 granting Conditional Use Permit No. 489, upon
the conditions set forth in said resolution and
WHEREAS, thereafter, within twenty -two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in granting said Condi-
tional Use Permit and did thereupon fix the 19th day of
November 19 °63 as the time and the M uncil Chamber
in the City Hall oTthe City of Anaheim as the place for a
public hearing upon said Conditional Use Permit, and notices
of such public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and develop
ment of the area in which it is proposed to be
located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting said Conditional Use Permit be, and
the same is hereby sustained and that Conditional Use
Permit No. 489 be, and the same is hereby, granted
permitting the construction of a multiple family planned
residential development, with carports, and a waiver of the
minimum space between structures requirement on the property
hereinbefore described, subject to the following conditions:
1. That sidewalks shall be constructed along
Clifton Street, as required by phe City Engi-
neer and in accordance with standard plans
and specifications on file in the Office of
the City Engineer, prior to final building
inspection.
2. That the owners of subject property shall pay
to the City of Anaheim the sum of $25.00 per
dwelling unit, to be used for park and recrea-
tion purposes, said amount to be paid at the
time the building permit is issued.
That trash storage areas shall be provided in
accordance with approved plans on file in the
Office of the Director of Public Works and
Superintendent of Streets prior to final build-
ing inspection.
4. That subject property shall be developed sub-
stantially in accordance with plans and specifi-
cations on file with the City of Anaheim, marked
"Exhibits No. 1 through No. 10."
5. That the rear and side walls of the proposed car-
ports shall be finished with exterior building
materials; that enclosed storage cabinets, with
a minimum capacity of 100 cubic feet, shall be
provided; that adequate bumper guards shall be
provided to protect the interior walls of the
carports; and that all of said items shall be
completed prior to final building inspection.
6. That a 6 -foot masonry wall shall be constructed
along the south, west and east property lines,
prior to final building inspection.
7. That tree wells shall be provided at approximately
40 -foot intervals in the Clifton Avenue parkway
abutting subject property; that plans for said
tree wells and the plantings therein shall be sub-
mitted to and approved by the Superintendent of
Parkway Maintenance; and that said tree wells shall
be planted with trees prior to final building
inspection.
8. That this Conditional Use Permit is granted subject
to the completion of Reclassification Proceedings
No. 63- 64 -47.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 19th day of November, 1963.
