Background
•Approved by Governor on September 22, 2022
•Effective on January 1, 2023
•State Legislature found that the imposition of mandatory parking minimums:
•Can increase the cost of housing
•Limits the number of available units
•Leads to an oversupply of parking spaces
•Increases greenhouse gas emissions

Assembly Bill (AB) 2097
•Prohibits a public agency from imposing any minimum automobile parking
requirement on any residential, commercial, or other development project that is
located within 1/2 mile of public transit, as defined in Section 21155 of the Public
Resources Code

Assembly Bill (AB) 2097
•“Public transit” refers to a “Major transit stop” and means a site containing any of the
following:
1.An existing rail or bus rapid transit station.
2.A ferry terminal served by either a bus or rail transit service.
3.The intersection of two or more major bus routes with a frequency of service
interval of 15 minutes or less during the morning and afternoon peak
commute periods.
•Also includes major transit stops included in the applicable Regional
Transportation Plan
•Does not apply to hotels, motels, bed and breakfasts, or other transient lodging,
except that AB 2097 will apply if all or a portion of such use is a Housing
Development Project that is a Residential Hotel

•AB 2097 does not apply if the City finds within 30 days of the receipt of a
completed application that not imposing or enforcing parking requirements would
have a substantially negative impact on:
1.The City’s ability to meet its RHNA;
2.The City’s ability to meet special housing needs for the elderly or persons with disability; or
3.Existing residential or commercial parking within one-half mile of a housing development
project
•Exemption cannot be used if:
1.The project dedicates 20% minimum to very low, low or moderate income persons, students,
the elderly, or persons with disabilities;
2.Project has fewer than 20 units; or
3.If the project is subject to parking reductions based on any other applicable law
