A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 70-71-58 to consider an amendment to

Title 18 of the Anahe1m Mun~cipal Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the pro-
posed amendment be adopted by the City Council and that a
certain zone or zones be changed as hereinafter set forth: and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of ~!hCity
Planning Commission the City Council did fix the day
of July, 19 71 as the time, and the City Council
Chambers in theC'ity Hair..of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said
property, hereinafter described, from the zone or zones in
which it is now situated and the incorporation thereof in the
zone or zones hereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the.
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for. said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings and recommendation; and
WHEREAS, the City Coui.cil does find and determine
that the amendment to Title 18 of the Anaheim MuniCipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in whiCh it is now
situated and incorporated in the zone or zones as hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following

PARCEL l: That portion of Lots 2 and 3 of the Joseph
Fiscus Subdivision, as shown on a map recorded in book
8 page 73 of Miscellaneous Maps, records of Orange
County, California, described as follows: Beginning
at a point on the southerly line of said Lot 2, distant
South 890 54' 30[1 East 1178.88 feet from the sout.hwest
corner of said Lot 2; thence llorth 60 48' 30" West
327.17 feet parallel with the westerly line of the State
Highway, 100.00 feet wide, as said highway existed on
April 29, 1930 to the northerly line of said Lot 2;
thence South 890 54' 30n East to the northeast corner
of said Lot 2; thence southerly to the southeast corner
of said Lot 2; thence North 890 54' 3011 West to the
point of beginning.
PARCEL 2: That portion of the northwest quarter of the
southwest quarter of the northwest quarter of Section 23,
Township 4 South, Range 10 West, S.B.B. & M., described
as follows: Beginning at the northeast corner of Lot 2
of the Joseph Fiscus Suhdivision, as shown on a map
recorded in book 8 page 73 of Miscellaneous Mqps, records
of Orange County, California; thence easterly along the
prolongation of the northerly line of said Lot 2 to its
intersection with the westerly line of the State Highway
100 feet wide, as said Highway existed on April 29, 1930;
thence southeasterly along the westerly line of said
State Highway to its intersection with the Easterly
prolongation of the center line of Midway Drive, as shown
on said map of the Joseph Fiscus Subdivision; thence
westerly along said prolongation to its intersection
with the southerly prolongation of the easterly line of
said Lot 2 of the Joseph Fiscus Subdivision; thence
northerly along said prolongation and alo~g the easterly
line of Lots 2 and 3 of said Joseph Fiscus Subdivision
to the point of beginning.
be excluded from R-A, AGRICULTUPAL ZONE, and incorporated in
C-I, GENEPAL COMMERCIAL ZONE, u~on the following conditions:
I. That the owners of subject property shall deed
to the City of Anaheim a strip of land 53 feet
in width from tIle center line of the street along
Anaheim Boulevard, and 32 feet in width from the
centerline of Midway Drive and curb return radius
at the intersection of the two property lines, for
street widening purposes.
2. That all engineering requirements of the city of
Anaheim along Midway Drive, including preparation
of improvement plans and installation of all improve-
ments, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or other
appurtenant work shall be complied with as required
by the City Engineer and in accordance with standard
plans and specifications on file in the office of
the City Engineer; that street lighting facilities
along I"lid'to]ay Drive and Analieim Boulevard shall be

That the sidewalks and driveways shall be installed
along Anaheim Boulevard as required by the City
Engi~eer and in accordance with standard plans
and specifications on file in the office of the city
Engineer.

4. That the owners of subject property shall pay to the
City of Anaheim the sum of 15~ per front foot along
Midway Drive and Anaheim Boulevard for tree planting
purposes.
5. Tnat trash storage areas shall be provided in accord-
ance with approved plans on file with the office of
the Director of Public Works.
6. That dense landscaping shall be provided along the
west property line adjacent to the existing chain
link fence to adequately shield the commercial use
from the existing school; plans for said landscaping
shall be submitted to the Development Services
Department for approval.
7. That all air conditioning facilities shall he
properly shielded from vie\"l, and the sound buffered
from adjacent properties.
8. That subject property shall J:e" served by under-
ground utilities.
9. That existing driveways shall be modified or
eliminated to conform with existing City of Anaheim
driveway standards.
10. Prior to the introduction of an ordinan~e rezoning
subject property, Conditions Nos. 1, 2, a9d 4, above
mentioned, shall be completed. The provisions or
rights granted by this resolution shall become null
and void by action of the City Council unless said
conditions are com~)lied \'lith within 180 days from the
date hereof or such further time as the City Council
may grant.
11. That Conditions Nos. 3, 5, 6, 7, 8 ~nd 9, above
mentioned, shall be complied with prior to final
building and zoning inspections.
BE IT FURTHER RESOLVED that the city Attorney be, and
he is hereby authorized and directed to prepare a~d submit to
the City Council an ordinance amending Title 18 of the Anaheim
I1unicipal Code to accomplish the objects nerein found and
dete~ined to be necessary and proper.
