3360ORDINANCE NO. '336-0 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING SECTIONS 18.08.605, 18.64.020(l)(e), 18.13.020.0.3, 18.18.025(1), 18.20.015(1), 18.24.015(l), 18.26.040(1), 18.28.040(1) AND AMENDING SECTIONS 18.04.162, 18.28.020(1); AND ADDING NEW SECTIONS 18.08.605, 18.13.020.C.3, 18.18.025(l), 18.20.015(l) 18.24.015(1), 18.26.040(1) AND 18.28.020(l)(e) PERTAINING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the following Sections, or Subsections be, and the same are hereby repealed: 18.08.605, ,18.64.020(1)(e), 18.13.020.C.3, 18.18.025(l), 18.20.015(l), 18.24.015(l), 18.26.040(l), and 18.28.040(l). SECTION 2. That the following Sections of the Anaheim Municipal Code be, and they are amended to read as follows: "18.04.162 Conversion of Existing Structures. Any person, firm, partnership, corporation, association or other entity proposing to convert an existing multiple -family structure to a condominium or community apartment shall first apply for and obtain from the Zoning Division of the Develop- ment Services Department a Condominium Conver- sion Permit. Such permit shall be issued only after it has been determined that the existing structure conforms to the site development standards for R.P.U.D.'s as provided in Chapter 18.31 (RM -4000 Zone) of the Anaheim Municipal Code, except as may otherwise be permitted by variance in accordance with the procedures and findings as prescribed therefor, ,and in compliance with the Uniform Building Code, as adopted by the City of Anaheim. 18.28.020(l) Permitted Buildings, Structures and Uses. Subject to the provisions of this zone, the following buildincas,,structures,.and uses, either singly or in combination, are permitted;" SECTION 3. That the following Sections or Subsections of the Anaheim Municipal Code be added to read as follows: "18.08.605 Planned Unit Development (P.U.D.1 A large scale development of a parcel or of a combination of related parcels to be developed by a single owner or group of owners acting jointly, involv- ing a related group of uses, planned as an entity and having a predominant developmental feature which serves to unify or organize develop- ment and is, therefore, ,susceptible to development and regulation as one unified land unit rather than as a mere aggregation of individual buildings and structures located on separate lots. In the case of Residential Planned Unit Developments (R.P.U.D.'s), such definition shall include cluster subdivisions, townhouses, rowhouses, condominiums, community apartments, stock cooperatives and all large scale develop- ments of attached or semi -attached one -family dwellings. 18.13.020.0.3 Residential Planned Unit Developments (R.P.U.D.'s SECTION 4. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter indepen- dent of the elimination herefrom of any such portion as may be declared invalid. -2 subject to the site development standards of Chapter 18.31 RM -4000 Zone, excepting that dwell- ing unit densities shall not exceed the limitations prescribed in this zone. 18.18.025(1) Residential Planned Unit Developments (R.P.U.D.'s) subject to the site development standards of Chapter 18.31 RM -4000 Zone, excepting that dwell- ing unit densities shall not exceed the limitations prescribed in this zone. 18.20.015(1) Residential Planned Unit Developments (R.P.U.D.'s) subject to the site development standards of Chapter 18.31 RM -400.0 Zone, excepting that dwell- ing unit densities shall not exceed the limitations prescribed in this zone. 18.24.015(1) Residential Planned Unit Developments (R.P.U.D.'s) subject to the site development standards of Chapter 18.31 RM -4000 Zone, excepting that dwell- ina unit densities shall not exceed the limitations prescribed in this zone. 18.26.040(1) Residential Planned Unit Developments (R.P.U.D.'s) subject to the site development standards of Chapter 18.31 RM -4000 Zone, excepting that dwell- ing unit densities shall not exceed the limitations prescribed in this zone. 18.28.020(l)(e) Residential Planned Unit Developments (R.P.U.D.'s) subject to all -restrictions and regulations of Chapter 18.31 RM -4000 Zone." SECTION 4. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter indepen- dent of the elimination herefrom of any such portion as may be declared invalid. -2 SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir— culated in said City, and thirty (3.0) days from and after its final passage it shall take effect and be in full force.
