AN ORDINANCE OF THE CITY OF ANAHEIM
RENEWING, WITH MODIFICATIONS, ORDINANCE
NO. 6528 APPROVING THE ANAHEIM POLICE
DEPARTMENT'S MILITARY EQUIPMENT USE
POLICY PURSUANT TO CALIFORNIA
GOVERNMENT CODE SECTION 7071
WHEREAS, the mission of the Anaheim Police Department (Department) is to provide the
highest quality police services to the community it serves; and
WHEREAS, the Department values transparency and public input, and welcomes open
dialogue about its practices and operations; and
WHEREAS, the Department desires to promote and ensure public safety, civil rights, and
officer; and
WHEREAS, the Department responds to a wide variety of critical incidents, instances of
civil unrest, and life and death situations, and operates in numerous unpredictable, dynamic
environments; and
WHEREAS, a variety of equipment options is needed for safe and effective resolution of
those situations; and
WHEREAS, each situation is evaluated by incident commanders or supervisors who, based
on circumstances and Department directives, determine which equipment should be used; and
WHEREAS, the Department's diverse catalogue of military equipment, as defined in state
law, and associated training gives police officers the confidence and capability to de-escalate
volatile situations, enhance the safety of the public and officers, and bring critical incidents to a
safe resolution; and
WHEREAS, from time to time, the Department may be asked to assist or need to be assisted
by other law enforcement agencies, which may include use of military equipment, as defined in
state law; and
WHEREAS, partnerships with other law enforcement agencies are an integral part of
maintaining the continuity of public safety within the region; and
WHEREAS, Assembly Bill 481 ("AB 481"), codified as California Government Code
Sections 7070-7072, became effective on January 1, 2022; and
WHEREAS, AB 481 defines military equipment in Government Code Section 7070(c) to
include a wide range of equipment as described in the Department's Military Equipment Use
Policy; and
WHEREAS, Government Code Section 7071 requires the Department to obtain the
approval of the City Council, by an ordinance adopting a Military Equipment Use Policy, prior to
requesting military equipment from the federal government, seeking funds for military equipment,
including grants and donations, acquiring military equipment, collaborating with another law
enforcement agency in the use of military equipment in Anaheim, using any new or existing
military equipment in a manner not previously approved by the Council, or entering into an
agreement for funding, receipt, acquisition, use of, or collaboration in the use of military
equipment; and
WHEREAS, the City Council adopted an ordinance (Ordinance No. 6528) approving the
Department's Military Equipment Use Policy (then numbered as Policy 706) on May 24, 2022,
after determining that the Policy complied with state law and that the Department's use of military
equipment was warranted and necessary; and
WHEREAS, the Department is required to submit an annual report detailing its use of
Military Equipment, and, based on the information in that report, the City Council must decide, on
an annual basis, whether to renew the ordinance approving the Military Equipment Use Policy; and
WHEREAS, in order to promote public safety, civil rights, and officer safety, the
Department desires to continue using, seeking funding for, acquiring, and collaborating when
necessary with other law enforcement agencies, in the use of, the military equipment described in
the Military Equipment Use Policy; and
WHEREAS, the Council has examined the Department's Military Equipment Use Policy
(now numbered as Policy 705, Attachment 1 hereto) and finds that the Police Department has
submitted all information required by Government Code Section 7070(d), enabling the Council to
make the findings set forth below; and
WHEREAS, pursuant to Government Code Section 7071(d), the Council finds that the
military equipment described in the Policy is necessary because there is no reasonable alternative
that can achieve the same objectives of officer and civilian safety; and
WHEREAS, pursuant to Government Code Section 7071(d), the Council further finds that
the Policy will safeguard the public's welfare, safety, civil rights, and civil liberties; and
WHEREAS, pursuant to Government Code Section 7071(d), the Council also finds that
continued use of existing military equipment and purchase of military equipment described in the
Policy is reasonably cost effective compared to available alternatives that can achieve the same
objectives of officer and civilian safety; and
WHEREAS, pursuant to Government Code Section 7071(d), the Council additionally fmds
that the Department will ensure the continued and future use of existing military equipment
described in the Policy will comply with the Policy; and
WHEREAS, based on all of the above, the City Council desires to renew the ordinance
approving the Department's Military Equipment Use Policy, the current version of which has been
updated to reflect the amounts and type of military equipment currently in the Department's
possession and renumbered as Policy 705.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Ordinance No. 6528, approving the Police Department's Military Equipment Use Policy is
hereby renewed as set forth herein, with the current version of the Policy (Attachment 1 hereto)
reflecting modifications that update the amount and type of military equipment currently in the
Department's possession.
SECTION 2.
By renewing the Military Equipment Use Policy, the Council approves seeking funds for
military equipment described in the Policy, including grants and donations, acquiring military
equipment described in the Policy, collaborating as needed with other law enforcement agencies in
the deployment or use of military equipment in Anaheim, using new or existing military equipment
as described in the Policy, and soliciting or entering into an agreement for funds, acquisition, use
of, or collaboration for use of military equipment described in the Policy.
SECTION 3.
This ordinance was renewed at a duly -noticed public meeting held at least thirty (30) days
after the proposed Military Equipment Use Policy was submitted to the City Council and posted on
the Anaheim Police Department's website. Approval of the Military Equipment Use Policy is not
intended to and shall not supersede existing processes to seek approval for the appropriation and
expenditure of specific funds through the annual budget process, or existing processes for the
approval and execution of contracts, donations, and grants.
SECTION 4.
The Council shall review this ordinance annually and vote whether to renew the ordinance,
consistent with the requirements of state law.
SECTION 5.
The City Clerk shall certify to the passage of this ordinance and shall cause the same to be
printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of
general circulation, published and circulated in the City of Anaheim.
SECTION 6.
This ordinance shall take effect and be in force thirty (30) days from and after it is adopted
by the City Council.

705.1 PURPOSE AND SCOPE
The purpose of this policy is to provide guidelines for the approval, acquisition, and reporting
requirements of military equipment (Government Code § 7070; Government Code § 7071;
Government Code § 7072).
705.1.1 DEFINITIONS
Definitions related to this policy include (Government Code § 7070):
Governing body — The elected or appointed body that oversees the Department.
Military equipment — Includes but is not limited to the following:
• Unmanned, remotely piloted, powered aerial or ground vehicles.
• Mine -resistant ambush -protected (MRAP) vehicles or armored personnel carriers.
• High mobility multipurpose wheeled vehicles (HMMWV), two -and -one -half -ton trucks,
five -ton trucks, or wheeled vehicles that have a breaching or entry apparatus attached.
• Tracked armored vehicles that provide ballistic protection to their occupants.
• Command and control vehicles that are either built or modified to facilitate the
operational control and direction of public safety units.
• Weaponized aircraft, vessels, or vehicles of any kind.
• Battering rams, slugs, and breaching apparatuses that are explosive in nature. This
does not include a handheld, one -person ram.
• Firearms and ammunition of .50 caliber or greater, excluding standard -issue shotguns
and standard -issue shotgun ammunition.
• Specialized firearms and ammunition of less than .50 caliber, including firearms and
accessories identified as assault weapons in Penal Code § 30510 and Penal Code §
30515, with the exception of standard -issue service weapons and ammunition.
• Any firearm or firearm accessory that is designed to launch explosive projectiles.
• Noise -flash diversionary devices and explosive breaching tools.
• Munitions containing tear gas or OC, excluding standard, service -issued handheld
pepper spray.
• TASER® Shockwave, microwave weapons, water cannons, and long-range acoustic
devices (LRADs).
• Kinetic energy weapons and munitions, including specialty impact munition (SIM)
weapons.
• Any other equipment as determined by a governing body or a state agency to require
additional oversight.

705.2 POLICY
It is the policy of the Anaheim Police Department that members of this department comply with
provisions of Government Code § 7071 with respect to military equipment.
705.3 PHILOSOPHY
The acquisition of military equipment and its deployment in our communities may impact the
public's safety and welfare. The public has a right to know about any funding, acquisition, or use of
military equipment by local government officials, as well as a right to participate in any government
agency's decision to fund, acquire, or use such equipment. Decisions regarding whether and how
military equipment is funded, acquired, or used should be given strong consideration to the public's
welfare, safety, civil rights, and civil liberties and should be based on meaningful public input.
705.4 MILITARY EQUIPMENT USE CONSIDERATIONS
1. The military equipment acquired and authorized by the Department is:
(a) Necessary because there is no reasonable alternative that can achieve the same
objective of officer and civilian safety.
(b) Reasonably cost-effective compared to available alternatives that can achieve the
same objective of officer and civilian safety.
2. Military Equipment shall only be used by a Department employee only after applicable training,
including any course required by the Commission on Peace Officer Standards and Training, has
been completed unless exigent circumstances arise.
705.5 MILITARY EQUIPMENT REPORTING CONSIDERATIONS
1. The Department shall submit an annual military equipment report to the City Council that
addresses each type of military equipment possessed by the Department.
2. The Department shall also make each annual military equipment report publicly available on its
internet website for as long as the military equipment is available for use.
3. The annual military equipment report shall, at a minimum, include the following information for
the immediately preceding calendar year for each type of military equipment:
(a) A summary of how the military equipment was used and the purpose of its use.
(b) A summary of any complaints or concerns received concerning the military equipment.
(c) The results of any internal audits, any information about violations of the military
equipment use policy, and any actions taken in response.
(d) The total annual cost for each type of military equipment, including acquisition,
personnel, training, transportation, maintenance, storage, upgrade, and other ongoing
costs, and from what source funds will be provided for the military equipment in the
calendar year following submission of the annual military equipment report.
(e) The quantity possessed for each type of military equipment.

(f) If the Department intends to acquire additional military equipment in the next year, the
quantity sought for each type of military equipment.
(g) Within 30 days of submitting and publicly releasing an annual military equipment
report, Anaheim Police Department shall hold at least one well -publicized and
conveniently located community engagement meeting, at which the general public
may discuss and ask questions regarding the annual military equipment report and
Anaheim Police Department's funding, acquisition, or use of military equipment. This
shall occur as a part of the Anaheim Police Department's presentation to the governing
body.
705.6 CATALOGING OF MILITARY USE EQUIPMENT
All military use equipment kept and maintained by the Department shall be cataloged in a way
that addresses each of the following requirements:
1. The manufacturer's description of the equipment.
2. The capabilities of the equipment.
3. The purposes and authorized uses for which the Department proposes to use the equipment.
4. The expected lifespan of the equipment.
5. The fiscal impact of the equipment, both initially and for ongoing maintenance.
6. The quantity of the equipment, whether maintained or sought.
Funding
The Department shall seek council approval for military equipment, including, but not limited to,
applying for a grant, soliciting or accepting private, local, state or federal funds, in -kind donations,
or other donations or transfers.
705.7 MECHANISMS TO ENSURE COMPLIANCE; PROCEDURES FOR COMPLAINTS OR
CONCERNS
The Department will ensure that all Department members comply with this policy. The Department
will conduct an annual audit with the assistance of the Professional Standards Unit. The Chief
of Police or designee will be notified of any policy violation(s), and, if needed, the violation(s) will
be referred to the Internal Affairs Division. All instances of non-compliance will be reported to the
City Council via the annual military equipment report.
Any members of the public can register a question or concern regarding military equipment used
by contacting the Anaheim Police Department. Any member of the public can submit a complaint
to any member of the Department and in any form (i.e. in -person, telephone, email, Department
or City webpage, etc.). Once the complaint is received, it should be routed to the Internal Affairs
Division in accordance with Anaheim Police Department Policy 1010 (Personnel Complaints).

705.8 MILITARY EQUIPMENT COORDINATOR
The Chief of Police should designate a member of this department to act as the military equipment
coordinator. The responsibilities of the military equipment coordinator include but are not limited to:
(a) Acting as liaison to the governing body for matters related to the requirements of this
policy.
(b) Identifying department equipment that qualifies as military equipment in the current
possession of the Department, or the equipment the Department intends to acquire
that requires approval by the governing body.
(c) Conducting an inventory of all military equipment at least annually.
(d) Collaborating with any allied agency that may use military equipment within the
jurisdiction of Anaheim Police Department (Government Code § 7071).
(e) Preparing for, scheduling, and coordinating the annual community engagement
meeting to include:
1. Publicizing the details of the meeting.
2. Preparing for public questions regarding the department's funding, acquisition,
and use of equipment.
(f) Preparing the annual military equipment report for submission to the Chief of Police
and ensuring that the report is made available on the department website (Government
Code § 7072).
(g) Establishing the procedure for a person to register a complaint or concern, or how that
person may submit a question about the use of a type of military equipment, and how
the Department will respond in a timely manner.
705.9 MILITARY EQUIPMENT INVENTORY
The following constitutes a list of qualifying equipment for the Department:
1. Unmanned, Remotely Piloted, Powered Aerial or Ground Vehicles:
(a) DJI Mavic Pro: The DJI Mavic Pro is a small, unmanned aerial system (UAS) that is
piloted remotely. The DJI Mavic Pro uses a stabilized camera to capture 4K videos
and 12-megapixel photos. Maximum flight speed of 40 MPH and a maximum flight
time of 27 minutes.
1. Quantity:1
2. Lifespan: 3-5 years
3. Cost: $1,000 each, Annual Maintenance: $0 (UAS no longer in production).
4. Purpose: To be deployed when its view would assist officers or incident
commanders with the following situations, which include but are not limited
to: Major collision investigations, search for missing persons,natural disaster
management, crime scene photography, Special Weapons and Tactics (SWAT)
Team deployments, tactical or other public safety and life preservation missions,
or in response to specific requests from local, state or federal fire authorities for
fire response and/or prevention.

5. Authorized Use: Only assigned operators who have completed the required
training shall be permitted to operate the above -listed UAS equipment during
approved missions.
6. Training: All department UAS operators will obtain their Remote Pilot
Certification (Part 107) from the Federal Aviation Administration. UAS Operators
will be required to pass the National Institute of Standards and Technology
(NIST) Basic Proficiency Evaluation for Remote Pilots yearly. Each operator
must attend 10-hour quarterly department training and complete monthly training
flights.
7. Legal and Procedural Rules: The Department will only deploy the UAS for
official law enforcement purposes and in a manner that respects the privacy of
our community, pursuant to State and Federal law, and the Unmanned Aerial
System (UAS) Operations Policy.
(b) DJI Mavic 2 Enterprise -Dual: The DJI Mavic 2 Enterprise Dual is a small unmanned
aerial system (UAS) that is piloted remotely. The Mavic 2 Enterprise Dual features a
fully stabilized 3-axis gimbal camera with a FLIR longwave infrared thermal camera
and a visual camera, providing both infrared and visible light imaging simultaneously.
The infrared thermal camera records 640 x 480 video, and the visual camera captures
4K video and 12-megapixel photos. Maximum flight speed of 44.7 MPH and a
maximum flight time of 31 minutes.

2. Lifespan: 3-5 years
3. Cost: $3,350 each, Annual Maintenance: $250, Software license: $2,000 each
per year (UAS no longer in production).
4. Purpose: To be deployed when its view would assist officers or incident
commanders with the following situations, which include but are not limited
to: Major collision investigations, search for missing persons, natural disaster
management, crime scene photography, Special Weapons and Tactics (SWAT)
Team deployments, tactical or other public safety and life preservation missions,
or in response to specific requests from local, state or federal fire authorities for
fire response and/or prevention
5. Authorized Use: Only assigned operators who have completed the required
training shall be permitted to operate the above -listed UAS equipment during
approved missions.
6. Training: All department UAS operators will obtain their Remote Pilot
Certification (Part 107) from the Federal Aviation Administration. UAS Operators
will be required to pass the National Institute of Standards and Technology
(NIST) Basic Proficiency Evaluation for Remote Pilots yearly. Each operator
must attend 10-hour quarterly department training and complete monthly training
flights.
7. Legal and Procedural Rules: The Department will only deploy the UAS for
official law enforcement purposes and in a manner that respects the privacy of

System (UAS) Operations Policy.
(c) DJI- Mavic 2 Enterprise -Zoom: The DJI Mavic 2 Enterprise Zoom is a small unmanned
aerial system (UAS) that is piloted remotely. The Mavic 2 Enterprise Zoom features
a fully stabilized 3-axis gimbal camera that shoots 4K video, 12-megapixel photos,
supports 2 times optical zoom, 24 - 48 mm lens, and supports filters. Maximum flight
speed of 44.7 MPH and a maximum flight time of 31 minutes.
1. Quantity:3
2. Lifespan: 3-5 years
3. Cost: $2,495 each, Annual Maintenance: $250, Software license: $2,000 each
per year (UAS no longer in production).
4. Purpose: To be deployed when its view would assist officers or incident
commanders with the following situations, which include but are not limited
to: Major collision investigations, search for missing persons, natural disaster
management, crime scene photography, Special Weapons and Tactics (SWAT)
Team deployments, tactical or other public safety and life preservation missions,
or in response to specific requests from local, state or federal fire authorities for
fire response and/or prevention.
5. Authorized Use: Only assigned operators who have completed the required
training shall be permitted to operate the above -listed UAS equipment during
approved missions.
6. Training: All department UAS operators will obtain their Remote Pilot
Certification (Part 107) from the Federal Aviation Administration. UAS Operators
will be required to pass the National Institute of Standards and Technology
(NIST) Basic Proficiency Evaluation for Remote Pilots yearly. Each operator
must attend 10-hour quarterly department training and complete monthly training
flights.
7. Legal and Procedural Rules: The Department will only deploy the UAS for
official law enforcement purposes and in a manner that respects the privacy of
our community, pursuant to State and Federal law, and the Unmanned Aerial
System (UAS) Operations Policy.
(d) DJI- Mavic 2 Enterprise -Advanced: The Mavic 2 Enterprise Advanced features a fully
stabilized 3-axis gimbal camera with a thermal camera and visual camera. Mavic
2 Enterprise Advanced offers infrared and visible light imaging simultaneously. The
infrared camera records 640x512 video, and the visual camera captures 4K videos
and 48-megapixel photos. The aircraft supports up to 32x digital zoom. Maximum
flight speed of 44.7 MPH and a maximum flight time of 31 minutes.

3. Cost: $6,500 each, Annual Maintenance: $250, Software license: $2,000 each
per year.

Certification (Part 107) from the Federal Aviation Administration. UAS Operators
will be required to pass the National Institute of Standards and Technology
(NIST) Basic Proficiency Evaluation for Remote Pilots yearly. Each operator
must attend 10-hour quarterly department training and complete monthly training
flights.
7. Legal and Procedural Rules: The Department will only deploy the UAS for
official law enforcement purposes and in a manner that respects the privacy of
our community, pursuant to State and Federal law, and the Unmanned Aerial
System (UAS) Operations Policy
(e) The DJI Matrice 300: The DJI Matrice 300 is an unmanned aerial system (UAS) that
is piloted remotely. The Matrice 300 is equipped with a Zenmuse H2OT gimbal, a
wide-angle camera, and a longwave infrared thermal camera, which can provide both
infrared and visual imaging simultaneously. The infrared camera records 640 x 512
video, and the visual camera captures 4K videos and 20-megapixel photos. The
aircraft supports up to 23 times hybrid optical zoom with a maximum zoom of 200
times. Maximum flight speed of 51.4 MPH and a maximum flight time of 55 minutes

Team deployments, tactical or other public safety and life preservation missions,
or in response to specific requests from local, state or federal fire authorities for
fire response and/or prevention.

training shall be permitted to operate the above -listed UAS equipment during
approved missions.

System (UAS) Operations Policy.
(f) The DJI Matrice 30T: The DJI Matrice 30T (M30T) is an unmanned aerial system
(UAS) that is piloted remotely. The DJI M30T is a weatherproof drone that fits in
a backpack. It integrates multiple high-performance sensors into one single camera
payload, is controlled with the DJI RC Plus Remote and runs on upgraded DJI Pilot
2 software, which significantly improves the flight experience. The powerful M30T
offers the endurance and capability necessary for rugged professional use -cases.
Additionally, its size makes it ideal for easy transportation and fast setup. The UAS also
includes a 40mm 640x512 30fps thermal imaging camera with measurement accuracy
of ±2°C or ±2%. The M30T model integrates a 48-megapixel 1/2" CMOS sensor -
zoom camera with 5X-16X optical and 200X digital zoom, a 12-megapixel wide-angle
camera, 8K photo, 4K/30 fps video resolution, and a laser rangefinder which can give
the precise coordinates of objects up to 1,200 meters away.

official law enforcement purposes and in a manner that respects the privacy of
our community, pursuant to State and Federal law, and the Unmanned Aerial
System (UAS) Operations Policy.
(g) Brinc Lemur 2: The Brinc LEMUR 2 is an advanced commercial -grade unmanned
aerial system (UAS) specifically designed for interior use. This Brinc LEMUR 2
is a battery powered, remotely operated device. The controller facilitates two-way
conversation between first responders and people they need to help through a set of
two ultra -sensitive microphones and a small lightweight loudspeaker. The controller
allows operators to control the UAS and view live feed from UAS -mounted cameras.
Flight time of approximately 30 minutes per battery, depending on weather and flight
conditions. Furthermore, the Brinc LEMUR 2 is equipped with a 4k digital camera
with thermal capability for better viewing and range overall but also in low light

pillow that is filled with No. 9 lead shot that weighs about 51 grams. It is fired from a

3. Cost: $302, Annual Maintenance: $0
4. Purpose: This launching cup is designed to launch the CTS indoor baffled
5203b chemical munition. This launching system affords officers more protection
as it may be deployed from a position of safety and cover.
5. Authorized Use: Tear gas canisters deployed from the Combined Systems
LC5 Launch Cup may be used against barricaded suspects or for crowd
management based on the circumstances. Only the Watch Commander,
Incident Commander, or Tactical Commander may authorize the delivery and
use of chemical agents, and only after evaluating all conditions known at the time
and determining that such force reasonably appears justified and necessary.
6. Training: Combined Systems LC5 Launching Cups are deployed by police
officers who have successfully graduated from a California POST -certified police
academy. Additionally, those officers have been assigned to the department's
SWAT team and have received formalized training in their use.
7. Legal and Procedural Rules: The Department will only utilize the Combined
Systems LC5 Launching Cups for official law enforcement purposes and
pursuant to State and Federal law and applicable Department policy.
Ij) Simmunition FX Marking Cartridges: The FX marking cartridges are patented reduced -
energy, non -lethal cartridges that leave a detergent -based, water-soluble color -
marking compound. The visible impacts allow accurate assessment of simulated
lethality. The cartridges feature tactical accuracy up to 25 feet (7.6 meters).

cartridges: 3,000 (approximate).

munition (SIM) weapons for official law enforcement purposes and pursuant to
State and Federal law and applicable Department policy.
(k) Ultimate Training Munitions (UTM) Ammunition: Accurate and reliable marking
projectile for Force -on -Force or Force -on -Target training, and used as a safe prelude
or alternative to 'Live -Fire' target or CQB training.

705.10 MAINTENANCE OF MILITARY USE SUPPLY LEVELS
When stocks of military equipment have reached low levels or have been exhausted, the
Department may order up to 10% of stock in a calendar year without city council approval
to maintain essential availability for the Department's needs. Anaheim Police Department is
authorized to acquire additional stock items listed here from other law enforcement agencies of
Cal OES in the event of an emergency when approved by the Chief of Police or designee.
705.11 APPROVAL
The Chief of Police or the authorized designee shall obtain approval from the governing body by
way of an ordinance adopting the military equipment policy. As part of the approval process, the
Chief of Police or the authorized designee shall ensure the proposed military equipment policy is
submitted to the governing body and is available on the department website at least 30 days prior
to any public hearing concerning the military equipment at issue (Government Code § 7071). The
military equipment policy must be approved by the governing body prior to engaging in any of the
following (Government Code § 7071):
(a) Requesting military equipment made available pursuant to 10 USC § 2576a.
(b) Seeking funds for military equipment, including but not limited to applying for a grant,
soliciting or accepting private, local, state, or federal funds, in -kind donations, or other
donations or transfers.
(c) Acquiring military equipment either permanently ortemporarily, including by borrowing
or leasing.
(d) Collaborating with another law enforcement agency in the deployment or other use of
military equipment within the jurisdiction of this department.

(e) Using any new or existing military equipment for a purpose, in a manner, or by a person
not previously approved by the governing body.
(f) Soliciting or responding to a proposal for, or entering into an agreement with, any other
person or entity to seek funds for, apply to receive, acquire, use, or collaborate in the
use of military equipment.
(g) Acquiring military equipment through any means not provided above.
705.12 COORDINATION WITH OTHER JURISDICTIONS
The Anaheim Police Department works closely with local, county, state, and federal partners. In
exigent circumstances, and with the approval of the Chief of Police or their designee, military
equipment may be deployed from outside entities to promote the safety and security of community
members. If the Police Department acquires, borrows, or uses military equipment in exigent
circumstances, it will provide written notification of the acquisition or use to the City Council within
30 days following the commencement of such exigent circumstance unless such information is
confidential or privileged under local, state or federal law.
705.13 ANNUAL REPORT
Upon approval of a military equipment policy, the Chief of Police or the authorized designee should
submit a military equipment report to the governing body for each type of military equipment
approved within one year of approval, and annually thereafter for as long as the military equipment
is available for use (Government Code § 7072).
The Chief of Police or the authorized designee should also make each annual military equipment
report publicly available on the department website for as long as the military equipment is
available for use. The report shall include all information required by Government Code § 7072
for the preceding calendar year for each type of military equipment in department inventory.
705.14 COMMUNITY ENGAGEMENT
Within 30 days of submitting and publicly releasing the annual report, the Department shall hold
at least one well -publicized and conveniently located community engagement meeting, at which
the Department should discuss the report and respond to public questions regarding the funding,
acquisition, or use of military equipment.
