A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RESOLUTION N0.92R-17 WHICH ESTABLISHED
PERSONNEL RULES FOR MANAGEMENT, CONFIDENTIAL AND
NON-REPRESENTED PART-TIME CLASSIFICATIONS
WHEREAS, the Human Resources Director has recommended in a staff report
dated June 13, 2006, that Resolution No. 92R-17 be amended in the manner hereinafter set
forth, and
WHEREAS, the City Council of the City of Anaheim does find that amending
Resolution No. 92R-17 is in the best interest of the City of Anaheim; and
^ WHEREAS, as a result thereof, the need exists to amend Resolution No. 92R-17
which established Personnel Rules for Management, Confidential and Part-Time Non-
Represented Gassifications.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim
as follows:
That, Section 16.10 of Personnel Rule 16, Vacation, be amended to read as
follows:
"16.10 Any employee in a classification designated as Miscellaneous Management or
Police Safety Management shall have the ability to be compensated for accrued vacation
hours at any time throughout the year, subject to the following provisions:"
2. That, Section 16.11. of Personnel Rule 16, Vacation, be added to read as follows:
"16.11 Management employees in the class cations of Fire Chief, Fire Division Chief, Fire
•^ Marshal, Fire Battalion Chief-40 Hours and Deputy Fire Marshal may request to be
compensated for accrued vacation hours at any time throughout the year subject to the
following provisions:
16.11.1 The employee must have used a minimum of forty (40) hours of vacation during the
preceding twelve (12) months.
16.11.2 The employee's vacation balance cannot drop below eighty (80) hours as a result of
the request.
16.11.3 The Fire Chief or the Chief s designee must approve the respective employee's
request for vacation pay-off. The Fire Chief must obtain approval from the City Manager for
his/her own request.
16.11.4 Employees covered under this Section 16.11 shall not be eligible for provisions stated
under Section 16.10."

3. That, Section 16.11 of Personnel Rule 16, Vacation, be renumbered to Section
16.12.
4. That, Section 16.12 of Personnel Rule 16, Vacation, be renumbered to Section
16.13.
5. That, Section 16.13 of Personnel Rule 16, Vacation, be renumbered to Section
16.14.
6. That, Section 32.9.3 of Personnel Rule 32, Paid Leave Program, be amended to
read as follows:
"32.9.3 An employee may be paid at his regular hourly rate of pay for all or a portion of paid
leave time hours accrued but not used in excess of two hundred forty five (245) hours upon
submission of a written and signed request to the Finance Department, Payroll Office.
~,, Requests submitted during any biweekly pay period shall be paid on the payday for that pay
period. A maximum of four (4) such payments shall be allowed each calendar year. When
requested, such payments may be diverted to the employee's Deferred Compensation
account, within limits established by law.
7. That, a new Section 32.12 of Personnel Rule 32, Paid Leave Program, be amended
to read as follows:
"32.12 In the event an employee's work schedule changes from a forty (40) hour assignment
to a fifty-six hour assignment after June 29, 2007, the employee's Paid Leave account shall be
credited with one (1) hour of Paid Leave for each complete pay period during which the
employee was assigned to the 40 hour assignment; except that there shall be no credit for
time in a forty (40) hour assignment prior to June 29, 2007. Paid Leave credited to an
employee's account pursuant to this Section shall be in addition to any other Paid Leave
entitlement an employee may have under the provisions of Section 32.0.
32.12.1 It is the intent that employees promoted from a 40 hour assignment shall receive
credit for time worked between June 29, 2007 and their date of promotion as described in
Section 32.12 above upon returning to fifty six (56) hour assignment or as described in
Section 32.12.2 below upon their separation from City service.
32.12.12 In the event an employee who is in a forty (40} hour assignment separates from City
service for any reason, the employee shall be credited with additional accrued vacation equal
to the ratio of 40/56 (.7143) hours for each complete pay period during which the employee
was assigned to the 40 hour assignment; except that there shall be no credit for time in the
forty (40) hour assignment prior to June 29, 2007."
8. That, Section 33.12 of Personnel Rule 32, Paid Leave Program be renumbered to
Section 32.13.
"33.1.5 Fire Safety Management employees who have completed five or more years of
continuous full-time Anaheim service and who terminate employment with Anaheim and are
subsequently reinstated within three years of their date of separation shall be credited with
prior service for the purpose of calculating continuous full-time Anaheim service upon
completion of all of the vesting requirements of Section 33.1."

9. That, Section 33.1.5 of Personnel Rule 33, Post Retirement Medical Benefits be
amended to read as follows:
"33.1.5 An employee who has completed twenty (20) consecutive years of service with
ANAHEIM as a certified Firefighter and has prior service as a certified Firefighter with another
California Fire Agency shall receive up to three (3) years of additional service credit for the
purpose of calculating ANAHEIM's contribution towards post-retirement medical benefits. Fire
Safety Management employees who have completed five or more years of continuous full-
time Anaheim service and who terminate employment with Anaheim and are subsequently
reinstated within three years of their date of separation shall be credited with prior service for
the purpose of calculating continuous full-time Anaheim service upon completion of all of the
vesting requirements of Section 33.1."
BE IT FURTHER RESOLVED that the effective date of this Resolution shall be upon
adoption by City Council.
AND, BE IT FURTHER RESOLVED that except as amended herein, Resolution
No. 92R-17 shall remain I full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 13th day of June , 2006, by the following roll call vote:
