99-092RESOLUTION N0. 99R- 92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM SETTING FORTH LOCAL CONDITIONS JUSTIFYING AMENDMENTS TO THE 1998 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE INCORPORATING THE 1997 EDITIONS OF THE UNIFORM BUILDING, MECHANICAL AND PLUMBING CODES, THE 1996 EDITION OF THE NATIONAL ELECTRICAL CODE AND JUSTIFYING AMENDMENTS TO THE 1997 EDITIONS OF THE UNIFORM SWIMMING POOL, SPA, AND HOT TUB, AND SOLAR ENERGY CODES (UNIFORM CODES). WHEREAS, Section 17958.5 of the Health and Safety Code permits the City to make changes or modifications in the Uniform Codes as such changes or modifications are reasonably necessary because of local conditions; and WHEREAS, Section 17958.7 of the Health and Safety Code requires the City Council to make express findings of the necessity for changes or modifications in the Uniform Codes prior to adopting such changes or modifications; and WHEREAS, the Building Official of the City of Anaheim has recommended that the Uniform Codes be adopted by the City with certain changes or modifications which are necessary to meet local climatic, geographical or topographical conditions. NOW THEREFORE, BE IT RESOLVED, that the modifications and changes recommended by the Chief Building Official are hereby found to be necessary on account of local conditions as follows: SECTION A) Uniform Buildinc Code - 1997 Edition. 1. Subsection 15.02.060.010 of the Anaheim Municipal Code: This amendment is necessary to clarify operational practices. Because of climatic conditions, consisting of dry and warmer conditions that allow construction to proceed year round, projects can be on-going for extended periods creating unsafe and unsightly conditions. Code. 2. Subsection 15.02.060.020 of the Anaheim Municipal The City of Anaheim is located in an area subject to a climatic condition of high winds and low humidity. This combination of events creates an environment, which is conducive to rapidly spreading fires. Control of such fires requires rapid response. Obstacles generated by a strong wind, such as fallen trees, street lights and utility poles, and the requirement to climb 75 feet vertically up flights of stairs will greatly impact the response time to reach an incident scene. Additionally Table 16-G identifies a significant increase in the amount of wind force at 60 feet above the ground. Use of aerial type fire fighting apparatus above this height would place rescue personnel at increased risk of injury. b. The City of Anaheim is located in the middle of the seismically active area identified as Seismic Zone 4. The viability of the public water system would be questionable at best after a major seismic event. This would leave tall buildings vulnerable to uncontrolled fires due to a lack of available water and an inability to pump sufficient quantities of any available water to floors above the 55 foot level. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create obstacles similar to those indicated under the high wind section above. With the probability of strong aftershocks there exists a need to provide increased protection for anyone on upper floors. 3. Subsections 15.02.060.030, 15.02.060.040, 15.02.060.050, and 15.02.060.060 of the Anaheim Municipal Code. a. The entire City of Anaheim is located in an area which is subject to periodic wind conditions of extremely high velocity; the City is also subject to seasonal high temperatures and dry atmospheric conditions which often occur during times of high-velocity winds. b. The water supply within the City of Anaheim makes extensive use of automatic fire sprinklers feasible, as the area is favored with many sources of high-quality water, including spring, well, reservoir, and municipal water companies. c. The climatic conditions described above are further accentuated by the topographical features of the hill and canyon area on the easterly portion of the city, south of the Riverside (SR-91) Freeway and east of the Costa Mesa (SR-55) Freeway portions of which have been designated either as a "special-protection area" or a very high fire hazard severity zone. The "special-protection area" and very high fire hazard severity zone are especially susceptible to fires which may spread quickly from one 2 structure to another due to lack of fire-protection devices, shrub/brush clearance requirements, and other fire- protection requirements needed to provide reasonable levels of fire safety. d. In order to correct existing conditions and prevent future conditions that are detrimental to the public health and safety and that may result in serious injury, it is reasonably necessary for the City of Anaheim to require these local amendments to the 1997 Uniform Building Code, when adopted, as the most reasonable means to protect the health, safety and welfare of the public. Failure to apply these provisions would result in conditions injurious or detrimental to the public health and safety. The application of these provisions is reasonably necessary to correct or avoid injurious or detrimental conditions. 4. Subsections 15.02.070 and 15.02.080 of the Anaheim Municipal Code. This amendment is necessary to provide additional fire protection for Class I construction due to local climatic conditions of high velocity winds and high temperatures which create a high degree of fire danger not experienced generally throughout the State. 5. Subsection 15.02.060.090 of the Anaheim Municipal Code. This amendment requires roof coverings to be noncombustible or fire retardant and Class A in all areas of the City of Anaheim located East of the Coast Mesa Freeway (SR-55) and south of the Riverside Freeway (SR-91). This amendment is necessary because the City of Anaheim is geographically located in an area which is subject to periodic extremely high velocity wind conditions. Said condition is further accentuated by the topographical features of the hill and canyon areas in the easterly portion of the City. The City of Anaheim is subject to seasonal high temperatures and dry atmospheric conditions which often occur during times of high winds as hereinabove described. Due to the climatic, geographical and topographical conditions hereinabove described, the City of Anaheim is susceptible to fires of particular danger during periods of high winds when fires tend to spread across roofs where such roofs are not of noncombustible or fire-retardant constructions. 6. Subsection 15.02.060.110 of the Anaheim Municipal Code. 3 . _._ . .._T, ____. __ __.. _ __. ~. This amendment requires a vapor barrier beneath a concrete floor slab in Group I and R, Division I and 3 occupancies and is necessary because of local expansive and sandy soil conditions which contain a significant amount of moisture because of the close proximity of the Santa Ana River. The minimum thickness of concrete floor slabs supported directly on the ground shall not be less that 3'-~ inches (89 mm). A minimum of 6 Mil approved vapor barrier membrane shall be placed under slab floors supported directly on the ground in Group I and R, Division 1 and 3 occupancies because Anaheim is located above an aquifer that is often just below the surface grade. In addition, the area is subject to potential severe rain storms during the winter months. Combining these two water resources with the water retention capacity of the area's expansive soil produces a condition wherein the moisture content of the soil is sufficient to increase the moisture content of concrete in contact with the soil. Concrete, which is used as part of a building structure, has the potential to transfer the moisture to the surface causing structural deterioration unless a moisture barrier is provided. 7. Subsection 15.02.060.130, 15.02.060.140, 15.02.060.150 and 15.02.060.160 of the Anaheim Municipal Code. Because of local climatic conditions, consisting of dry and warmer conditions that promote greater outdoor activity, the need for additional swimming pool barriers and definitions are required. SECTION B. National Electrical Code - 1996 Edition 1. Subsection 15.02.070 of the Anaheim Municipal Code. Due to prevailing conditions, conductors normally used to carry current shall be of copper or of aluminum unless otherwise provided in this Chapter. Where the conductor material is not specified within this Chapter, the material and the sizes given in the National Electrical Code shall apply to copper conductors. Where other materials are used, the size shall be changed accordingly. Aluminum conductors of No. 6 or smaller used for branch circuits shall require continuous inspection by an independent testing agency approved by the Building Official for proper torquing of connections at their termination point. Aluminum expands and shrinks at a much higher rate than other metals. This condition becomes critical for smaller sizes of aluminum conductors, which may break down at termination points in a 4 .. _.T...._.. seismic event, causing a fire. Anaheim is located in an active seismic area (Seismic Zone 4). The continuous inspection requirement will ensure that the installation of the aluminum conductor is inspected and installed correctly to the required torquing by the manufacturer. 2. Subsection 15.02.070.010 of the Anaheim Municipal Code. Aluminum expands and shrinks at a much higher rate than other metals. This condition becomes critical for smaller sizes of aluminum conductors, which may break down at termination points in a seismic event causing a fire. Orange County is located in an active seismic area (Seismic Zone 4). The continuous inspection requirement will ensure proper installation. SECTION C. Uniform Mechanical Code - 1997 ICBO Edition Subsection 15.02.080 of the Anaheim Municipal Code. This amendment is necessary to clarify operational practices. Because of climatic conditions, consisting of dry and warmer conditions, projects can be on-going for extended periods creating unsafe and unsightly conditions. SECTION D. Uniform Plumbing Code - 1997 IAPMO Edition. 1. Subsection 15.02.090 of the Anaheim Municipal Code. This amendment is necessary to clarify operational practices. Because of climatic conditions, consisting of . dry and warmer conditions, projects can be on-going for extended periods creating unsafe and unsightly conditions. 2. Subsection 15.02.090.010 and 15.02.090.020 of the Anaheim Municipal Code. This amendment is necessary since some soils in the City of Anaheim may possess corrosive properties. These corrosive properties can reduce the expected usable life of metallic gas systems when utilized in contact with this corrosive soil. SECTION E. Uniform Swimming Pool, Spa and Hot Tub Code - 1997 Edition. 1. Subsection 15.02.100 and 15.02.100.010 of the 5 .__... _„T".__. Anaheim Municipal Code. This amendment is necessary to clarify operational practices. Because of climatic conditions, consisting of dry and warmer conditions, projects can be on-going for extended periods creating unsafe and unsightly conditions. Code. 2. Subsection 15.02.100.020 of the Anaheim Municipal Because of local climatic conditions, consisting of dry and warmer conditions that promote greater outdoor activity, the need for additional swimming pool barriers and definitions are required. SECTION F. Uniform Solar Energy Code Subsection 15.02.110 of the Anaheim Municipal Code. This amendment is necessary to clarify operational practice. Because of local climatic conditions, consisting of dry and warmer conditions, projects can be on-going for extended periods creating unsafe and unsightly conditions. BE IT FURTHER RESOLVED as to all of the Uniform Model Codes that making the Uniform Model Codes, as adopted with local amendments, applicable throughout all areas of the City of Anaheim, including those areas governed by development agreements, is reasonably necessary to correct existing conditions and prevent future conditions that are detrimental to the public health and safety and may result in serious injury. In addition, of all the means reasonably known to the City which could feasibly correct or avoid the injurious or detrimental conditions, amending these codes is the most reasonable means to protect the health, safety and welfare of the public. Failure to apply these Uniform Codes, with the proposed amendments, within areas governed by development agreements would result in a condition injurious or detrimental to the public health and safety. Consequently, these provisions of the Uniform Model Codes, as adopted by reference by the City Council, with amendments thereto, shall apply to all areas of the City of Anaheim which may be the subject of development agreements which became effective prior to the date of adoption of the Ordinance amending the Uniform Model Codes, and which development(s) contain(s) any provision to the contrary.
