A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DECLARING ITS INTENTION TO CONSENT TO
THE AMENDMENT OF CERTAIN DEED RESTRICTIONS PLACED
OF RECORD IN CONNECTION WITH RECLASSIFICATION NO.
61 62 88.
WHEREAS, Raymond G. Spehar and Estelle K. Spehar,
owners of the following described property:
Lot No. 139 in Tract No. 2779, as shown on
a map recorded in Book 92, Pages 35 to 40,
both inclusive of Miscellaneous Maps, Records
of Orange County, California,
did cause to be recorded in the Office of the Orange County Recorder,
in Book 6147, Pages 87, 88 and 89, on June 15, 1962, Document
No. 12381, certain City of Anaheim C 1 Deed Restrictions, in
connection with the rezoning of the above described property
under Reclassification Proceedings No. 61- 62 -88; and
WHEREAS, Condition No. 3 of said C -1 Deed Restrictions
reads as follows:
No building shall be used for residential
purposes on this property unless rezoned.
The C -1 uses of this property shall be
limited to business and professional uses
only."
AND, WHEREAS, the owners of subject property have
requested that the consent of the City of Anaheim be given to
the amendment of said restrictions to permit the operation of
a beauty salon and boutique shop on said property; and
WHEREAS, the City Planning Commission, after having
held a public hearing on said request in the manner and as
prescribed by law, did adopt Resolution No. PC68 -304 recommending
to the City Council that the consent of the City be given to
said amendment; and
WHEREAS, the City Council did set said matter for
public hearing on November 12, 1968, and did hold and conduct
such public hearing and did give all persons interested therein
an opportunity to be heard, and did receive evidence and reports,
and did thereupon consider the recommendation of the City Planning
Commission; and
WHEREAS, the City Council does find that the consent
of the City should be given to the amendment of said deed re-
strictions as requested, at such time as an application for a
conditional use permit is filed by the owners of subject property,
and carried through to a successful completion, to permit the
operation of a beauty salon and boutique shop on said property,
which permit when granted shall contain the conditions herein-
after set forth.

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that it declare, and it does hereby de-
clare, its intention to consent to the amendment of that certain
Declaration of Restrictions executed by Raymond G. Spehar and
Estelle K. Spehar, recorded in Book 6147, Pages 87, 88, and
89, on June 15, 1962, Document No. 12381, Official Records of
Orange County, California, by the amendment of Condition No.
3 thereof to include a beauty salon and boutique shop in the
uses of subject property, at such time as an application for
a conditional use permit is made and carried through to a
successful completion to permit the operation of a beauty salon
and boutique shop on said property, which permit when granted
shall contain the following conditions:
1. That trash storage areas shall be provided in accor-
dance with approved plans on file in the Office of the Director
of Public Works and Superintendent of Streets, prior to final
building and zoning inspections.
2. That all air- conditioning facilities shall be
properly shielded from view, prior to final building and zoning
inspections.
3. That all employees of said proposed businesses shall
park their vehicles on the parking lot provided on the premises.
4. That subject property shall be developed substan-
tially in accordance With plans and specifications on file with
the City of Anaheim,' Exhibit No. 1, Revision No. 1, and
Exhibits Nos. 2 and 3, and colored renderings marked Exhibits
Nos. 1, 2 and 3.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to sign such consent to the
amendment of said restrictions for and on behalf of the City
of Anaheim at such time as said conditional use permit is granted.
THE FOREGOING RESOLUTION is approved and signed by
me this 12th day of November, 1968.
