RESOLUTION NO. 66R-196
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH SULLY-MILLER CONTRACTING
COMPANY WITH REFERENCE TO OVERTIME WORK. ON
THE KATELLA AVENUE OVERCROSSING OF THE SANTA
ANA FREEWAY.
WHEREAS, the State of California and its Division of
Highways have heretofore entered into a contract with Sully-
Miller Contracting Company to construct certain improvements
of the Katella Avenue overcrossing of the Santa Ana Freeway;
and

WHEREAS, the construction hereinabove mentioned
has necessitated a temporary partial closure of the Katella
Avenue overcrossing, thus providing insufficient lanes avail-
able for the anticipated heavy traffic which the City expects
to occur with the commencement of the 1966 baseball season
on or about April 9, 1966 at Anaheim Stadium; and
WHEREAS, the opening of the Kate1la Avenue over-
crossing roadways to the fullest extent available for traffic,
using normal hours of labor, is not e:stimated to be complete
until some time after April 9, 1966; and
WHEREAS, Katella Avenue is one of the major access
roadways which will serve the traffic generated by Anaheim
Stadium; and .'
WHEREAS, Sully-Miller Contracting Company has indi-
cated that by using overtime hours of work, the Kate1la Avenue
overcrossing roadways can be made more fully available for
traffic by April 9, 1966; and
WHEREAS, Sully Miller Contracting Company has of-
fered to perform such overtime labor; and
WHEREAS, the City Council finds that it would be to
the advantage and in the best interests of the City to pay
for the cost of actual labor attributable to such overtime
work, not to exceed the sum of $10,000.00, in order that the
Kate11a Avenue overcrossing roadways may be fully available
for traffic by April 9, 1966.
NOW THEREFORE BE IT RESOLVED by the City Council
of the City 01 Anaheim t~t an agreement be made and entered
into by and between the City of Anaheim and Sully-Miller
Contracting Company providing in substance as follows:
1. That said Contracting Company shall perform
all overtime work which, in its opinion, is necessary to
have the Kate1la Avenue overcrossing roadways open to
the fullest extent possible for traffic by April 9, 1966.
2. That the City shall pay said Contracting
Company for the cost of actual labor which is attJi-
butable to such overtime work; provided, however,
that such costs shall not exceed $10,000.00.

3. That the City will pay said labor costs within
a reasonable time after presentation of proper billing.
4. That Sully~Miller Contracting Company shall
absorb all other costs attributable to such overtime
work, including, but not limited to, overhead, material
and equipment.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute such agreement
for and on behalf of the City of Anaheim.
