SUBJECT: DEV2023-00033 Anaheim Nolin II Tentative Tract 19286
Conditional Use Permit (CUP) Letter of Justification – Townhomes
Dear Mr. Taylor:
On behalf of Toffoli Investments, LLC, we formally submit this letter of justification for conditional
use permit necessary for the proposed Project, being 44 residential condominiums, generally
located at the southwest corner of West Lincoln Avenue and Laxore Street.
The proposed project lies within the Beach Blvd Specific Plan which envisions quality
redevelopment of existing dilapidated and underutilized land uses throughout the Beach Blvd.
Corridor. It was previously approved as mixed-use residential as part of DEV2020-00278 TTM
19022.
An Affordable Housing component is proposed with this development. A total of 10% of the for-
sale townhomes will be sold Moderate buyers. The applicant will enter into a density bonus
housing agreement with the City to ensure compliance with the Density Bonus Ordinance.
The project will require a conditional use permit to permit the single-use residential for that certain
real property generally located at the southwest corner of West Lincoln Avenue and Laxore
Street, and commonly referred to 2952 and 2960 West Lincoln Avenue in the City of Anaheim,
County of Orange, State of California.
Additionally, the project will require administrative adjustment for encroachment of private
drives/courts into required 10-ft landscape setback at side interior property lines. The proposed
encroachment to provide 4-ft back-up space per City of Anaheim Std projects into the setback by
only 1’-1½“, less than 20% coordinated with City Planning Dept. personnel.
The proposed use will not adversely affect the adjoining land uses or growth and development of
the area in which it is located. The size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the particular area
or to health or safety. Traffic generated by the proposed use will not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area. Lastly,

granting of the conditional use permit under the conditions imposed, if any, will not be detrimental
to the health and safety of the citizens of Anaheim.
