Attachment 7 - Administrative Adjustment Justification Letter9830 Irvine Center Drive Irvine, CA 92618 (949) 916-3800 November 21, 2023 Nick Taylor, AICP Associate Planner Planning and Building Department City of Anaheim 200 South Anaheim Boulevard │ Suite 162 Anaheim, CA 92805 SUBJECT: DEV2023-00033 Anaheim Nolin II Tentative Tract 19286 Administrative Adjustment Letter of Justification – Landscape Setback Dear Mr. Taylor: On behalf of Toffoli Investments, LLC, we formally submit this letter of justification for administrative adjustment necessary for the proposed Project, being 44 residential condominiums, generally located at the southwest corner of West Lincoln Avenue and Laxore Street. The proposed project lies within the Beach Blvd Specific Plan which envisions quality redevelopment of existing dilapidated and underutilized land uses throughout the Beach Blvd. Corridor. It was previously approved as mixed-use residential as part of DEV2020-00278 TTM 19022 The project will require administrative adjustment for encroachment of private drives/courts into required 10-ft landscape setback at side interior property lines. The proposed encroachment to provide 4-ft back-up space per City of Anaheim Std projects into the setback by less than 20% for Lincoln Ave and 10% for Embassy Ave coordinated with City Planning Dept. personnel. We’ve found that: 1.The adjustment is consistent with the purposes and intent of the Zoning Code. All structures are outside landscape setback. Required back-up space for garage parking access encroaches only approximately 15% of the setback for Lincoln Ave to the north and 10% for Embassy Ave alley to the south. 2.The same or similar result cannot be achieved by using provisions in the Zoning Code that do not require the adjustment. Back-up space for garage parking access would be sub-standard as a result. 3.The adjustment will not produce a result that is out of character or detrimental to the neighborhood. Project frontage along (3) public street frontages of W Lincoln Ave, ATTACHMENT NO. 7 Laxore St, and Embassy Ave have been closely coordinated with City staff to provide desirable landscaping and screening treatments at encroachment locations.
