Dear Planning Commission:
On behalf of UNITE HERE Local 11 (“Local 11”), this office respectfully provides the
following comments1 to the City of Anaheim (“City”) regarding the proposed demolition of an
existing vacant two-story commercial building and construction of a 5-story, 65-foot high 120-room
hotel and a 1,200 square foot (“sf”) drive-through Starbucks restaurant including two 4-story
“Puzzle Lift” enclosed parking structures (3 stories above ground, 1 below) (“Project”) located on
a 1.57-acre site at the above referenced address (APN Nos. 234-161-04 & 234-161-26) (“Site”).
In furtherance of the Project, Pacific Resort Group, Inc. (“Applicant”) is seeking various
project approvals under the Anaheim Municipal Code (“AMC” or “Code”), including: (a) “Rezone”
the Site from Industrial (I) to General Commercial (C-G); (b) Conditional Use Permit (“CUP”) to
permit a hotel with a detached drive-through fast-food restaurant; and (c) a CUP to allow for a
greater Floor Area Ratio (“FAR”) than permitted by the Code (0.98 proposed, 0.50 permitted)
(collectively “Entitlements”). Additionally, for the California Environmental Quality Act (“CEQA”),2
the City is considering the Mitigated Negative Declaration dated October 2023 (“MND”).3
After a review of the relevant documents, Local 11 is concerned with various aspects of the
Project. In short, the MND’s analysis of air quality impacts during construction suffers from various
flaws, such as inaccuracies concerning timeline assumptions, the proximity of sensitive receptors,
and appropriate significance thresholds. Nor does the MND account for the potential of overlapping
construction between “Phase 1” (Starbucks drive-through) and “Phase 2” (hotel component), or
the amount of excavated material likely necessary to build the two Puzzle Lift structures.
Additionally, there is substantial evidence that the Site contains hazardous material that should be
subject to a Phase I Environmental Site Assessment (“ESA”) before, not after, the Project Approvals
are granted. Furthermore, the Project should be required to maximize solar panels on all structures,
incorporate feasible mitigation to shield construction noise for the multi-family residences north of
the Site (roughly 75 feet away from the excavation for the Puzzle Lifts), and commit to a robust
hotel-specific rideshare program and food/plastic recycling program that will reduce waste and

vehicle miles traveled (“VMT”) caused by the Project’s hotel component – issues very important to
Local 11.
Collectively, these failings may conceal potentially significant Project impacts and may allow
for the avoidance of needed additional mitigation measures. All fundamental assumptions, project
design features, and mitigation measures should be incorporated into the Mitigation Monitoring
Reporting Program (“MMRP”).
Local 11 has a significant interest in the Project. It represents more than 25,000 workers
employed in hotels, restaurants, airports, sports arenas, and convention centers throughout
Southern California and Phoenix—including thousands of members who live and/or work in
Anaheim. Local 11 wants to ensure responsible and sustainable development that reduces adverse
impacts on its members and the nearby communities that they serve.
Because a more comprehensive EIR was not prepared, the Project is subject to the less
deferential ‘fair argument’ standard, which requires a lead agency to prepare an EIR whenever
substantial evidence in the record supports a fair argument that a project may have a significant
effect on the environment. (See e.g., Laurel Heights Improvement Ass'n v. Regents of the Univ. of Cal.
(1993) 6 Cal.4th 1112, 1123; No Oil, Inc. v. City of Los Angeles (1974) 13 Cal.3d 68, 75; Pub. Res.
Code §§ 21100, 21151.) Under this standard, an MND may be used only where there is "clearly no
significant effect on the environment would occur, and [] there is no substantial evidence in light of
the whole record before the public agency that the project, as revised, may have a significant impact
on the environment." (Pub. Res. Code § 21064.5 [emphasis added]; see also CEQA Guidelines §§
15070(b), 15369.5.)
For these reasons (and those discussed herein), Local 11 respectfully asks the City to stay
action on the Entitlements and MND (collectively “Project Approvals”) until the various concerns
are addressed in a CEQA-compliant recirculated CEQA review that incorporates additional
mitigation to the Project, made enforceable via MMRP.
I. SPECIFIC PROJECT/MND ISSUES
A. AIR QUALITY IMPACTS FROM CONSTRUCTION MAY BE SIGNIFICANT
The MND claims localized air impacts from construction emissions would not exceed
applicable thresholds under the South Coast Air Quality Management District (“SCAQMD”) localized
significance threshold (“LST”) methodology. (MND, pp. 5-16, 5-22.) As shown in MND Table 6 (see
Fig. 1 below [highlighted yellow]), the MND uses linearly interpolated SCAQMD thresholds
(between 25- and 50-meter thresholds), based on the assumption that the “closest off-site sensitive
receptors to the Project Site are residential uses located approximately 130 feet to the north of the
Project boundary.” (MND, p. 5-21.) These threshold emissions are then compared to the purported
maximum daily on-site emissions for various pollutants. (Fig. 1 [highlighted green].) This
conclusion is likely incorrect for several reasons.

1. Purported Maximum Emissions Are Unclear
The MND reports maximum emissions in whole numbers (see Fig. 1 above [green]),
referencing the CalEEMod worksheets as the source. However, CEQA reviews typically report these
emissions to the hundredths place (i.e., two digits after decimal) and during each phase of
construction. (See Figs. 2 – 3 [Examples from other City CEQA Reviews].)

Because the MND fails to identify maximum emissions in the hundredths and during each
phase, it is unclear what emissions numbers in the CalEEMod worksheets (located in Appendix A)
are being cited as the source. This is problematic because the closest numbers corresponding to the
emissions cited in the MND (see Fig. 1 above [green]) are emissions reported for 2023 in Table 2.2
of the CalEEMod worksheet (see Fig. 4 below [green]), which are much less than the emissions
reported for 2024 (see Fig. 4 below [yellow]). If the maximum daily emissions are those in yellow,
then at a minimum, the Project’s emissions for particulate matter less than 10 and 2.5 microns
(“PM10” and “PM2.5”, respectively) would exceed the SCAQMD thresholds cited in the MND (i.e., 9
and 4, respectively). (See Fig. 1 above [yellow].)

2. SCAQMD Thresholds Should Be Lower Because the Distance from Sensitive
Receptors Is Less than 40 Meters
As mentioned above, the MND utilizes interpolated SCAQMD thresholds based on the
assumption that the closest sensitive receptor (i.e., multi-family residence) (MND, pp. 2-1, 5-4) is
130 feet (i.e., 40 meters) to the north of the Project boundary. (MND, p. 5-21; see Fig. 1 above
[yellow].) However, the MND inconsistently reports the distance between the Project Site and this
sensitive receptor. (See e.g., MND, p. 5-4 [110 feet], pp. 5-68 – 5-69 [125 feet], p. 5-21 [130 feet].)
According to Google Maps (see Fig. 5 below), the distance between the Project Site (i.e., northern
boundary) and the multi-family (southern property boundary) is roughly 75 feet (i.e., 22.86
meters), which corresponds to the distance used in the MND’s noise calculations contained within
Appendix H (see Fig. 6 below).

According to SCAQMD, projects with boundaries closer than 25 meters to the nearest
receptor “should use the LSTs for receptors located at 25 meters.”6 Hence, the correct threshold for
PM10 and PM2.5 is 4 and 3 lbs/day (respectively) (see Fig. 7 below)—not 9 and 4 as used in the
MND (see Fig. 1 above [yellow]). Hence, it appears that even the Project’s currently reported
maximum emissions would exceed applicable thresholds and require mitigation. A “fair argument"
of air quality impacts likely exists here.

3. Anticipated Start of Construction Is Likely Inaccurate
The MND states that the construction of the Project will occur
in two phases (MND, p. 3-2), including (i) Phase 1 demolition
of the existing 10,530-sf building and construction of the
Starbucks drive-through and associated parking over an
approximately 6-month period (id., see also Exh. 9 [demo
plan]); and (ii) Phase 2 includes additional demolition,
excavation, and construction of the parking puzzle lift and
hotel structure over an approximately 18-month period. (See
Fig. 8 right.)
This suggests a sequential construction timeline (i.e.,
Phase 1 followed by Phase 2) with no concurrent construction
(e.g., components of Phase 1 and Phase 2 overlapping). But it
is unclear if this accurate. The MND’s emissions modeling
worksheets (i.e., CalEEMod) in Appendix A rely on various
user-inputted data related to construction. (See Fig. 9 below.)

The MND assumes Phase 1 demolition to begin “shortly after Project Approval” (MND, p. 3-
2), which is reflected in the MND’s emissions modeling worksheets (i.e., CalEEMod) in Appendix A.
(See Fig. 10 below [highlights indicating Phase 1 construction activities].) However, the October 1,
2023 start date of construction cannot now be accurate, and construction is not likely to start until
2024 based on the current December Planning Commission and other potential hearings if the
Project is appealed to the City Council. A delay in Phase 1 construction may also affect the start and
finish of Phase 2 Construction. (See Fig. 10 below [unhighlighted indicating Phase 2 construction
activities].)

4. Emission Modeling Assumes No Construction During Summer
As shown in Figure 10 above, the CalEEMod modeling assumes no construction during the
summer (3/16/24 – 10/10/24). However, this could be inaccurate in the event of a delayed start of
Phase 1 (which is likely, as discussed above) or if the property owner unilaterally decides otherwise
(which is possible, absent an explicit condition of approval). This is problematic because CalEEMod
has a new feature that reports maximum daily emissions separately for the summer (April -
September) and winter (October – March) based on the start and end dates of individual
construction phases, and “only those emissions generated by those construction phases ….”8

Furthermore, the delay between Phase 1 (building Starbucks drive-through) and Phase 2 (building
hotel) suggests that the Starbucks will be operational prior to the hotel. According to the California
Air Pollution Control Officers Association (“CAPCOA”) (overseers of CalEEMod), the MND should
have run the model multiple times to “address multiple operational phases with emissions-generating
activities expected to change across years ….”9
5. Overlapping Construction Needs to be Correctly Identified and Analyzed
As previously mentioned, the MND describes sequential construction (i.e., Phase 1 followed
by Phase 2), with no overlapping construction of either (i) the phases (i.e., Phase 1 and Phase 2) or
(ii) components of individual phases (i.e., demolition, site preparation, grading/excavation, building
construction, paving, architectural coating). (MND, p. 3-2.) However, as shown in Figure 10 above,
the CalEEMod modeling shows Phase 1 paving (3/3/24 – 3/6/24), Phase 1 architectural coating
(2/28/24 – 3/16/24), and Phase 2 paving (3/7/24 – 3/22/24) would overlap. Not only is
overlapping construction phases/components not discussed in the MND, but this phasing seems
inaccurate given Phase 2 paving would typically occur after—not before—Phase 2 demolition, site
preparation, grading and excavation, building construction (currently estimated for 10/7/24 –
12/27/24). (See figure above.) Overlapping construction needs to be accurately described and
assessed so that maximum daily emissions are accurately accounted for.10
6. Excavated Material from Puzzle Lift Seems Unaccounted For
The MND vaguely mentions that the Project will include the export of material. (MND, p. 5-
16.) However, no discussion is given regarding the anticipated number of cubic yards of exported
material. The CalEEMod modeling shows various amounts of material to be imported and exported
during the various phases of construction, with Phase 1 and Phase 2 grading/excavation
anticipated to include only 50 and 90 cubic yards (“cy”) of exported material, respectively. (See
APP-A, pp. 51-52.)
The totals appear to be underestimated and potentially missing the excavated material for
the two Puzzle Lift structures (see Fig. 11 below), including the 30-car structure along the Site’s
northern boundary (highlighted red) and a 44-car lift along the northwestern boundary
(highlighted blue). According to the MND, these structures total 3,310 sf of building area (MND, p.
3-1), and include one-story of below-grade parking approximately nine (9) feet down. (See Fig. 12
below.) Hence, excavation for just the two Puzzle Lifts likely would be roughly 1103 cy of exported
material,11 which is well beyond the 50 and 90 cy cited in the CalEEMod worksheets.

7. No Discussion of Cumulative Impacts Related to Overlapping Construction of a
Nearby Project
As shown in Figure 13 below (taken from the City’s GIS database), the Project Site (in red) is
across the street from the corner property at 1200 S. Anaheim Blvd. (in purple), which is the
location of a recently approved 249-unit multi‐family structure with a 5,500-sf restaurant
development. (APP-I, PDF p. 173.12) There, the City anticipated that multi-family development
would include a 22-month construction period starting in March 2023 (if not longer).13 However,
construction had not begun as of April 2023 based on Google images. (See Figure 14 below.) This is
relevant because overlapping construction can have compound effects.

In sum, the issues mentioned above need to be resolved because they affect the MND’s air
quality impact analysis. There likely is a “fair argument” of air quality impacts during construction.
All assumptions should be included as a project design feature in the Project’s MMRP, as well as any
mitigation measures that may be necessary to reduce impacts to less than significant.15 The City
should consider project-level mitigation recommended by the Southern California Association of
Governments (“SCAG”), the California Air Resources Board (“CARB”), SCAQMD, and CAPCOA,16
including but not limited to requiring Tier 4 Final construction equipment for all off-road
construction equipment.

B. ENVIRONMENTAL HAZARDS NEED MORE ANALYSIS
The potential existence of toxic contamination on a project site is a significant impact
requiring CEQA review. (City of Maywood v. Los Angeles Unified School Dist. (2012) 208 Cal.App.4th
362 36.) Here, the MND claims that “The site is not known or anticipated to have been
contaminated with hazardous materials” and that no nearby sites “pose a hazard to the Project
Site.” (MND, pp. 5-53 – 5-54.) However, this conclusion is not based on a Phase I Environmental Site
Assessment (“ESA”)—like other City CEQA reviews17--but instead based on a general
Environmental Data Resources Inc. (“EDR”) radius search of relevant databases (results included in
Appendix E of the MND). Upon review of the 900+ page Appendix E, there is ample evidence that
likely suggests potentially hazardous conditions which would warrant further investigation. For
your convenience, relevant and annotated excerpts of the EDR search (APP-E, PDF pp. 1-2, 5, 15, 31,
37-46) are attached hereto as “Exhibit A,” and referenced below.
1. Project Site contains seven sites registered on relevant databases
The MND states that 23 registered sites are located within ¼ mile of the Project Site. (MND,
p. 5-53; see also Fig. 15 below [⅛ and ¼ mile radius map].) This includes a seven-site cluster within
the 1.57-acre Project Site boundaries. (Id., see also Fig. 16 [highlighted in red].)

of activities and reporting requirements involving potentially hazardous materials.

The above search results, including the March 2011 incident where material stored in a
barrel had overflowed (MND, p. 5-53), is the type of evidence that shows why “there may be
reasons to investigate further[,]” as clearly noted by the EDR Report. (See Figure 18 below.)

2. Site Appears to Have Been Long Used for Heavy-Duty/Vehicle Storage
The MND does not provide any history of the Site and merely states that it is used as surface
parking/vehicle storage space. (MND, p. 2-1.) However, based on Google Street images, it appears
that the Site was formerly used as a water/motorsports craft dealer that closed down between
February 2009 and May 2011. (See Figs. 19 & 20 below.)

Since its closing, it appears that the site has been used for parking and storage of heavy-duty
vehicles, trailers, and other vehicles. (See Figs. 21-24 below). It is possible that this storage could
have also led to long-term spills and unauthorized releases of contamination that warrant further
investigation.

C. MISCELLANEOUS MATTERS CONCERNING MND ADEQUACY
1. More Details About Solar Panels And Battery Storage Are Needed
The MND claims the Project would comply with various energy and building code
regulations, such as Title 24, Cal. Green Codes, solar requirements, and others. (MND, pp. 5-33 –
34.) While the hotel structure seems to include a “solar area” (id., Exh. 5d), there is no indication
that solar panels will be installed on the Starbucks drive-through structure or either of the parking
Puzzle Lifts (id., at Exh. 6c & 6d). Nor is there any discussion of whether battery storage will be
located at the Site. The MND should clarify this and commit to specific solar requirements as a
project design feature to be included in the MMRP, including but not limited to additional solar
panels placed on the Starbucks drive-through and Puzzle Lift structures. So too, the City should
consider whether or not the Site can achieve Tier 1 or Tier 2 CalGreen status or require more than
the Code-required amount of EV chargers.

2. Construction Noise from Excavation of Puzzle Lifts Needs Better Analysis
The MND states noise levels were measured near the Project boundary (see Fig. 25 below)
but fails to provide any details about the exact location where measurements were taken to ensure
they reflect an accurate description of existing conditions for sensitive receptors. The MND also
estimates construction noise based on generic assumptions from a 50-year-old guidance document
(Fig. 26 below), with no more specific consideration of the expected excavation and building
equipment used for the Puzzle Lift constructed on the Project Site’s northern boundary roughly 75
feet from the multi-family residence to the north. There should be a revised construction noise
analysis based on the equipment that will realistically be used. All feasible mitigation should be
incorporated into the MMRP, such as noise blankets/walls of sufficient attenuation and height if
appropriate to reduce noise impacts to the multi-family residents north of the Site.

3. Intended Rideshare/Vanpool Should be Clarified
The MND claims that the hotel operator intends to include “rideshare and vanpooling
opportunities for employees and patrons.” (MND, p. 5-7.) More details about this program should
be given, as well as a commitment to it as a project design feature to be included in the Project’s
MMRP. Local 11 urges the City to consider robust TDM measures for hotel operations, which also can
substantially contribute to air quality issues. Measures such as a hotel-specific mandatory
commuter reduction program could include:
• Specific performance level to be reached (e.g., specific VMT or average daily trip
reduction or both);
• Specified participation level (e.g., 100 % employees);
• Participation in guaranteed ride programs;
• Inventive employee carpool/vanpool access to preferential parking spaces or hotel valet
service or both;
• Subsidized transit passes for hotel workers and hotel patrons; and
• Dedicated shuttle service for hotel patrons toward nearby destinations.22

4. More Can be Done to Address Food and Plastic Waste
The MND does not address any Project-specifics as it relates to the State’s organic waste
collection regulations that cover both multi-family and commercial developments (i.e., SB 1383)23
or how the Project will avoid wasteful use of plastic materials. A hotel-specific recycling program
seems appropriate to address the acute single-use plastics issues facing hotels, which generate
higher than average waste per employee than other businesses, with 65 percent comprised of food
waste, mixed paper, and mixed plastics.24 Consistent with the State’s SB 1383 and other plastic
reduction efforts, Local 11 urges the City to consider requiring hotel-specific recycling and food waste
programs, which can include various elements like:
• Promote recycled paper and other products like soap;
• Bans on disposable (i.e., designed to be used once and discarded) foodware items and
accessories;
• Allowing customers to bring their own reusable items (waiveable to accommodate
kosher or other religious standards);
• Requirements for hand soap in refillable containers;
• No promotional items made of plastic;
• No water in plastic bottles or disposable single-use cups;
• No expanded polystyrene (i.e., Styrofoam);
• Require reusable napkins and tablecloths with recyclable disposable napkins only
allowed for takeout;
• Hand dryers in areas accessible to customers;
• Requirement for reusable laundry bags;
• Reusable dishware for room service;
• Eliminate coffee pods/coffee machines that require pods;
• Offer toothpaste tablets in refillable packaging such as glass bottles or jars;
• Provide bamboo toothbrushes;
• Offer toiletries on request rather than automatically;
• Key cards made out of non-plastic materials, including traditional metal keys or wood,
bamboo, and paper options for chip-based cards;
• Incentives for returning keys to discourage waste;
• Non-plastic shower caps, razors, shaving cream, slippers, eye masks, ear plugs;
• Remove minifridge items that use plastic;
• Eliminate the use of garbage bags if possible, or use bags made of compostable material;
• Choose home compostable gloves;
• Do not use plastic wrap;
• Serve employee meals with reusable dishware and cutlery, as well as provide reusable
water bottles for all employees with accessible water bottle refill stations;
• Replace paper towels with reusable dish rags; and
• Source plastic-free sponges. 25

II. CONCLUSION
In short, the MND appears to have various flaws that may mask the real impacts caused by
the Project. Local 11 has a substantial interest, with thousands of members who live or work in
Anaheim. For the reasons discussed herein, we respectfully ask that the City not grant the Project
Approvals until a CEQA-compliant MND is recirculated that incorporates all fundamental
assumptions, project design features, and feasible mitigation into an enforceable MMRP.
Local 11 reserves the right to supplement this letter at future hearings and proceedings for
